Alfred Grebe William Unkelbach MINUTES SOUTHOLD TOWN PLANNING BOARD Oqtober 27, 1971 A regular meeting of the Southold Town Planning Board was held at 7:30 P.M., Wednesday, October 27, 1971, at the Town Office, Main Street, Southold, New York. There were present: Messrs:- JehnWickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle. Absent: Mr. Alfred Grebe (due to unfavorable weather conditions.) Also present: Howard Terry, Building Inspector Mr. Russell Case appeared before the Planning Board on behalf of the minor subdivision of Philip L. Babcock, located at private Eight-of-way off south side of Main Road, Cutchogue, New York. The Chairman read letter of October 13, 1971 received by the Planning Board from Mr. Babcock explaining his intentions for the property. The Chairman also read letter of October 41, 1971 received from Charles Lind, Director of the SuffolkCounty Planning Commission, letter containing the County Planning r'ec~endations ~n r~rd to this minor subdivision. Mr. Case presented the Plann~n~ Boa~d with three copies of revised map~ Southold Town Planning Board -2- October 27, 1971 The revised map shower'-the owner of the property as Case Estate. Mr. Case explained that this was an error on the part of Van Tuyl, owner should be prin~ed as. Margaret E. Babcock. The Beard informed Mr. Case that the map will have to be revised with the correct name of the owner of the property printed on it. The revised map showed a division of the property into five lots: lot no. 1 contained 43,363sq. ft. of area; lot no. 2 contained 43,560sq. ft. of area; lot no. 3 contained 50,225sq. ft. of area; lot no. 4 contained 43,560sq. ft. of area; lot no. 5 contained 50,166sq. ft~ of area. The lot lines have been revised to eliminate the sharp turns in the right-of..~way. Discussion was held in reference to the development of this property in the future. In regard to the County. Planning Board. recommendation, the Planning Board will require that provision be made for connecting the right-of-way with Case's Lane an future develop- ment. The Planning Board informed Mr. Case that they will require two (2) statements in writing from him: [1] "When and if the remainder of this property is developed, there will be a connection to this right-of-way on the Babcock minor sub- division from Case's Lane." [2] "It iA not the intention of Mr. Case to ask for another minor subdivision on this piece of property." Decision was tabled at this time for further deliberation of the Board later in the evening. Ralph M. ~h~resa Y. Asselta appeared before the Planning Board in reference to their proposed minor subdivision located at north side of Main Road, Cutchogue~ N.Y~ The Planning-Board was presented with three copies of revised map date~ October 18, 1971. The map showed a division of the property into five (5) lots: lot no. 1 contained 21,642sq. ft. of area; lot no. 2 contained 28,275sq. ft, of area; lot no. 3 contained 25,5~7sq. ft. of area; lot no. 4 contained 24,896sq. ft. of a=ea; lot no. 5 contained 25,211sq. ft. of area. The right-of-way has been increased to 25 feet in width. The Chairman read the Planning Board's letter of October 6, 1971 to Mr. & Mrs. Asselta, said letter granted final approval to this minor subdivision s~bject to receipt of three (3) copies of revised maps, two (2) cepies of of formal application and fee of $40. ASSELTA, 30 Dewey Avenue, Fairport, NY hereinafter referred to as the DECLARANTS, as the owner of premises described in Schedule "A" annexed hereto (hereinafter referred to as the PREMISES) desire to restrict the use and enjoyment of said PREMISES and have for such purposes 4etermined to impose on said PREMISES covenants and restrictions and do hereby declare that said PREMISES shall be held and shall be conveyed subject ~9~ ~he foll~ng covenants and restrictions: 1. Asselta dated October 18, 1971 by Roderick Van Tuyl and Son will be merged into a single parcel, so that the subdivision will now consist of four (4) lots. DECLARANT further covenants that the merged lots shall remain as a single parcel, shall not be further subdivided and shall only be improved by one single-family dwelling. 3. The DECLARANTS, their successors and/or assigns shall set forth these covenants, agreements and declarations in any and all leases to o~cupants, tenants and/or lessees of the above-described property and shall, by their terms, subject same to the covenants and restrictions contained herein. Failure of the DEC~ARANTS, their successors and/or assigns to so condition the leases shall not invalidate their automatic subjugation to the covenants and restrictions. 4. All of the covenants and restrictions contained herein shall be construed to be in addition to and not in derogation or limitation upon any provisions of local, state and federal laws, ordinances and/or regulations in effect at the time of execution of this agreement, or at the time such laws, ordinances, and/or regulations may thereafter be revised, amended or promulgated. 5. This document is made subject to the provisions of all laws required by law or by their provisions to be incorporated herein, and they are deemed to be incorporated herein and made a part hereof as though fully set forth. 6. The aforementioned Restrictive Covenants shall be enforceable by the County of Suffolk, State of New York, by injunctive relief or by any other remedy in equity or at law. The failure of said agencies or the County of Suffolk to enforce the same shall not be deemed to affect the validity of this covenant nor to impose any liability whatsoever upon the County of Suffolk or any officer or employee thereof. 7. These covenants and restrictions shall run with the land and shall be binding upon the DECLARANTS, their successors and assigns, and upon all persons or entities claiming under them, and may be terminated revoked or amended by the owner of the premises only with the written consent of the DEPARTMENT. 8. The declarations set forth in the WHEREAS clauses contained herein shall be deemed and construed to be promises, covenants, and restrictions as if fully repeated and set forth herein. 9. If any section, subsection, paragraph, clause, phrase or provision of these covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid, or held to be unconstitutional, the same shall not affect the validity of these covenants as a whole, or any other part or provision hereof other than the part so to be illegal, unlawful, invalid, or unconstitu- adjudged tional. 10. Local Law #32-1980 - The DECLARANTS represent and warrant that they have not offered or given any gratuity to any official, employee, or agent of Suffolk County, New York State, or of any political party with the purpose or intent of securing favorable treatment with respect to the performance of an agreement, and that such persons have read and are familiar with the provisions of Local Law #32-1980. As we discussed, this parcel was part of a 5 lot minor subdivision which was approved by the Southold Town Planning Board in 1971 (see attached correspondence). In 1991 a prior owner submitted plans for Health Department approval for construction of a single family residence. The Health Department rejected the plans stating that they should have received Health Department approval at the time the subdivision was approved in 1971. It is our understanding which you confirmed, that Health Department approval was not required as part of the approval process in 1971. Therefore, I am requesting that you provide me with a letter addressed to the Health Department stating that all requirements were met in concerning the subdivision in 1971 and that your Board did grant approval to the 5 lot minor subdivision at that time. Recently, Ralph Asselta and Michael Asselta (hereinafter referred to as the Declarants) were required, as a condition of approval from the Suffolk County Department of Health Services, to file a Declaration of Covenants and Restrictions stating that Lot 4 and Lot 5, as set forth on the minor subdivision map, be merged into a single parcel. The filing of this Declaration had the effect of changing the five (5) lot subdivision to a four (4) lot subdivision. The Declaration also states that the merged lots shall remain as a single parcel, shall not be further subdivided and shall only be improved by one single-family dwelling. Asselta as shown on a survey dated October 18, 1971 by Otto Van Tuyl & Son, Land Surveyor. For your convenience and guidance, I am endosing a copy of the survey as well as a copy of your letter dated November 1, 1971 which was addressed to Mr. and Mrs. Asselta. .Mr. and Mrs. Asseita maintained a principal residence on lot 2. Lot 3 was sold to the adjacent neighbor, M. McAfee, which has since merged with his property and is now not a buildable lot. The owners of the property did not sell lots 1, 4, 5 for the last 20 years. However, since the donth of the owners, their children Ralph A. Asselta and Michael F. Asselta are now trying to sell the 3 vacant lots. My client, Gisela Morchel, is under contract to purchase lot #1 and submitted her plans for Health Depa~httent approval for construction of a single family residence. The Health Depa, i~tent has taken the position that the 5 lot minor subdivision constituted a major subdivisoin and should have recieved Health Department approval at the time the subdivision was approved in 1971. The attorney for the seller advises me that his clients were not aware of this due to the fact that your Board did not require Health Department Approval as part of the approval process in 1971. I also spoke to the surveyor and he informs me uncommon to have 5 lot minor subdivisions 20 years ago. Page 2 We are appealing the decision to Mr. Roy Reynolds and ~luest any assistance from your office that you would be in a position to furnish. Could you please address a letter to the Health Department either directly or in care of my office, setting forth your requirements in 1971 and indicating that in fact your Board did grant approval to the 5 lot minor subdivision in 1971. I will also try to obtain a letter from the surveyor that a 5 lot minor subdivision was not uncommon 20 years ago. Perhaps with the above information, the Health Depa~..Lent will reconsider their position and treat the lot as a separate lot rather than part of a realty subdivision.
