Alt application for the subdivision previously was before the Planning Board in 1990. However, final approval was not obtained. Ms. Cross wishes to revive the application in order to subdivide the 5.918 acre parcel into two lots. A house would be constructed on the southern lot (# 2 on the 1990 survey) and access for that lot would be over Wagon Wheel Lane. The other lot (# 1) would have access over the adjacent property on which the Environmentals nursery is located. Based on the assumption that Lot 1 is to be merged with the adjacent property on which the development rights have been sold, and the fact that the Tuthill lot received approval for access by the Zoning Board of Appeals in June 1977, the following items are required. 1. The building envelope for Lot 1 must be shown on the map. It must be stated on the map that this lot is to be merged with the adjacent lot. In addition, a statement referring to this merger must be included in a Declaration of Covenants and Restrictions. 2. Access to Lot 1 shall be over the property it is being merged with. This too must be stated on the map and in the Declaration of Covenants and Restrictions. Access to Lot 1 shall not be permitted from the Wagon Wheel right-of-way. 3 . A covenant and restriction must be submitted stating that there shall be no further subdivision of Lot 1 in perpetuity. 4 . Access to the Tuthill lot shall remain as is, or shall be improved as per the June 23 , 1977 decision of the Zoning Board of Appeals. 5. Lot 2 shall be at least 80 ,000 square feet in area. An easement over this lot, and over Lot 1, shall be granted to preserve access to the Tuthill lot. This easement is also to be included in the Declaration of Covenants and Restriction. The covenants and restrictions requested above must be contained in one Declaration of Covenants and Restrictions. Upon submission of revised maps and a draft Declaration of Covenants and Restrictions, the Planning Board will proceed with their review. Please contact this office if you have any questions regarding the above. Very truly yours, / Bennett Orlowski, Jr. Amf Chairman enc. V June 23 , .
