Re: Major Subdivision Map of Elijah's Lane - Section II
Dear Mr. Orlowski:
Receipt is acknowledged of your September 5, 1986 letter with enclosures
noted therein.
You ask two questions : (1) Whether the subdivision may be approved and
developed with one acre lots, and (2) What are the procedures to be
followed to reactivate and finalize the subdivision.
As to the first question, it appears that a hearing for preliminary plat
approval was held by the Planning Board on September 16, 1974. Section
100-31 (Bulk E Parking Requirements) Subdivision B(2) of the Zoning
Code provides that one acre zoning shall apply to "all lots shown on major
subdivision maps upon which the Planning Board has held a hearing for
preliminary map approval prior to May 20, 1983". Accordingly, since a
Planning Board hearing for preliminary map approval was held prior to
May 20, 1983, the one acre zoning requirements (Column A-40 of the Bulk
Schedule) are applicable.
As to the second question, i.e. what procedures are to be followed to
reactivate and finalize the subdivision, I have the following comments;
On August 18, 1975, the Planning Board adopted a resolution granting
final approval of Section 2 of the subdivision, subject to the five
conditions set forth therein. It would appear that at least conditions 2, 3
and 5 have not been complied with.
Section A106-24F(2) of the subdivision regulations provide in part that
"conditional approval of a final plat shall expire within 180 days after the
date of the resolution granting conditional approval unless such
requirements have been certified as completed". This provision also
a

provides that the Planning Board may extend the time when the map may
be submitted for signature for not to exceed two additional periods of 90
days each. Since the conditions imposed by the resolution granting final
map approval were not complied with within 180 days, final map approval
has expired. It, therefore, will be necessary for •the applicant to apply
for final map approval and the Planning Board must proceed as in any
other proceeding for final plat approval.

Dear Mr. Orlowski :
Receipt is acknowledged of your September 5, 1986 letter with enclosures
noted therein.
You ask two questions : (1) Whether the subdivision may be approved and
developed with one acre lots, and (2) What are the procedures to be
followed to reactivate and finalize the subdivision.
As to the first question, it appears that a hearing for preliminary plat
approval was held by the Planning Board on September 16, 1974. Section
100-31 (Bulk 6 Parking Requirements) Subdivision B(2) of the Zoning
Code provides that one acre zoning shall apply to "all lots shown on major
subdivision maps upon which the Planning Board has held a hearing for
preliminary map approval prior to May 20, 1983". Accordingly, since a
Planning Board hearing for preliminary map approval was held prior to
May 20, 1983, the one acre zoning requirements (Column A-40 of the Bulk
Schedule) are applicable.
As to the second question, i.e. what procedures are to be followed to
reactivate and finalize the subdivision, 1 have the following comments;
On August 18, 1975, the Planning Board adopted a resolution granting
final approval of Section 2 of the subdivision, subject to the five
conditions set forth therein. It would appear that at least conditions 2, 3
and 5 have not been complied with.
Section A106-24F(2) of the subdivision regulations provide in part that
"conditional approval of a final plat shall expire within 180 days after the
date of the resolution granting conditional approval unless such
requirements have been certified as completed". This provision also

provides that the Planning Board may extend the time when the map may
be submitted for signature for not to exceed two additional periods of 90
days each. Since the conditions imposed by the resolution granting final
map approval were not complied with within 180 days, final map approval
has expired. It, therefore, will be necessary for the applicant to apply
for final map approval and the Planning Board must proceed as in any
other proceeding for final plat approval.

As I indicated to you on the telephone , I represent Zanieski Farms,
Inc. , the owner of the parcel of property in Mattituck shown on the
subdivision map known as "Map of Eli jah' s" Lane Estates , Section 2" . It
is my understanding, based upon our telephone conversation, that
preliminary approval of this subdivision was granted by the Town of
Southold in 1974, and further that, final submission can now be made
upon the amendment of the map to comply with the present Town of
Southold Code highway specifications, and further upon compliance with
Section 106-24 and Section 106-43 of the Town of Southold Building
Code.
I would appreciate your obtaining from the Town Attorney of the Town of
Southold a written opinion confirming that our client is able to submit
its final subdivision map showing lots having an area of 40 ,000 square
