A resolution was passed at the regular lIleeUng. of
the Planning Board held on June 23, 1975 reaffirming the
approval of the above-captioned subdivision to the
County Planning Commission. I have today sent that

A further resolution was passed as follows:

The following action was taken by the Southoll! Town
Planning Board at a regular meeting held June 23. 1915.
'RESOLVED to reaffirm approval to the County Planning
Comni1ssion on the map of property of Alma Suter called
Tut's Acres based on access being obtained from the Boa~d
of Appeals of the Town of Southold with provision that
the aoc.ss be extinguished at such time as access if
provided through the subdivision to the west owned by
Werner Ade1, Jr.'

Suter, residing at New Suffolk Ave. Mattituck, N.Y., hereinafter
called the "Owner";
WHEREAS, the Owner has title to certain lands situate,
lying and being at Mattituck, in the Town of Southold,
County of Suffolk and State of New York, said lands hereinafter
being more particularly described; and

lands be subdividen into a minor subdivision consisting of not
more than 4 (four) residential lots:
NOW, THEhEFORE, the following described lands shall be
restricted as hereinafter set forth:

DECLARANT does hereby warrant, covenant and represent
that on approval of the aforesaid described lands as a minor
subdivision by the Planning Board of the Town of Southold, no
further application will be made to that Board or to any other
Board in the Town of Southold to further subdivide any of the
lots set forth in said minor subdivision.
DECLARANT does hereby further warrant, covenant and
represent that the aforesaid described lands within the minor
subdivision cannot be subdivided into more then four lots and
that each such lot shall comprise an area of not less than
four acres.
DECLARANT does hereby further warrant, covenant and
represent that the foregoing restrictions and 8greements shall
bind the undersigned, his heirs, successors and assigns, and
any and all rerson or persons who shall succeed to the owner-

Dear Mr. Cross:
The following action was taken by the Southold Town Plan-
ning Board, Monday, March 28, 1983.
RESOLVED to accept the field report of Bennett Orlowski, Jr.
and William F. Mullen, Jr. in which report noted the right-of-.
way located to the west of the property is in very poor condition, the
condition of the right-of way located to the west does not allow
for emergency vehicles to travel as it is almost nonexistant and
the right-of-way located to the east is in excellent condition.

Dear Sirs:
Regarding Mr. Davis' inspection ~~d report of the right-of-
way to the existing minor subdivision known as "Tut's Acres",
I feel a letter is necessary to obtain the Planning Board's
attention so that the issue involved can be clearly identified
for what it is and what it is not. Up to this point the mat-
ter has run an inappropriate course only to become confused
and associated with other issues properly of the Board's
responsibility but which have no relavance in this specific
situation.
The right-of-way from Route 25 into "Tut's Acres" and up to
the property on which a home has now been constructed was
formally approved by the Town in 1975 as a basis for the
Planning Board's approval in 1976 of this four lot minimum
subdivision. A letter evidencing approval by Howard Terry
of the improvements made by contractor Raymond Nine in ac-
cordance with the then prevailing specifications is in the
Board's file. Affidavits of these two persons could be ob-
tained should there be any reason to challenge the approval.
Nothing has changed in the intervening years because of nature
or use, other than the presence of some grass from lack of
sufficient traffic to keep it down. Accordingly, this matter
should not properly be concerning the Planning Board and
should not have called for an inspection in the first place.
The roadway remains as it was originally approved by the Town.
The only change is that the eastern two parcels have been pur-
chased, one of which has gone back to farmland and the other
containing a new house.
If the Board should now accept Mr. Davis' report andlthereby)
years later require significant new road work to be done, it,
in reality, would be arbitrarily withdrawing the Town's ap-
proval of the right-of-way. Such action would create a clear
cut detriment to the innocent purchaser of the first part of
thi s subdivision to be sold. Thi s, surely, does not serve
any useful purpose for the Town of Southold. If anything, it
would serve to defeat one of the very purposes of requiring
approval in the first place of the work done on this subdivision.

This is not one of those cases of long-in-use rights-of-way
which were never subject to specifications at their origin
and where the Planning Board can only exercise its more
recent requirements when a new potential user appears on the
scene. The right-of-way to "Tut's Acres" was approved by
the Town under its own specifications and before any use
of or sale of the parcels.
I respectfully submit that the right-of-way is legal as it
st~~ds according to the facts and that no further action is
required.

'lhe road aection in the 18 ft. R.O.W. is not in the best of condition. Most of the
length is below the original .djacent ground level. '!here are a few mud hol... '!be
road material appears to haye a high loam content. Fifteen test holes were made in
the first 1350 ft. Some of the holn indicated und, gravel and loam (3" to 5"),
others showed mostly loam. A few tut holes in the road where the R.O.W. is 50 ft. wide
w..re the same, some 3" to 4" of sand, gravel and loam, others with hlrdly any gravel.
'lhe road width is 9 ft.:!: and topsoil st.ripping is 14 ft.t: in width through the 18 ft.
R,O.W. Thpsoil stripping may have bun done at. grut.er width in the 50 ft. R.O.W.

Recommendations:
1. Leyel the existing surface where necessary.
2. Place a 4" course of bank run moterial with a grayel content of 20% or more on
the existing surface at a width of 10 ft. from the Main Road to the wood 11111I at
Lots 1 and 3.
3. A turn around area should be provided.

Please review the enclosed map. The right-of-way
designated in red had received 280-A approval in 1975.
The right-of-way designated in orange giving access to
Mr. Cross' property has not been approved by the Town
of Southold.
Would you please inspect the area and report to our
board if the area designated in red has been maintained
in satisfactory condition and if not please advise what
improvements are necessary. We also request that you
advise what improvements are necessary for the right-of-
way designated in orange.
The purchaser of the two easterly lots has inquired
as to what would be acceptable to the Building Inspector's
Office for a permanant CO.

Regarding what you indicate as right-of-way in Tut' s Acres
leading to state road 25 is in effect totally within the subdiv-
ision and fee title at the time the subdivision was developed
was owned solely by M~ Alma Suter.
As you are aware at the time the business relationship
by myself and MrS. Suter I had abstained from any action on this
subdivision.
On the instruction of the Building Inspector's office that
all 280 A's in 1975 were controlled by the Board of Appeals con-
trary to the metes and bounds of the subdivision.

Dear Mr. Raynor:
The R.O.W. in Tut's Acres is approved to the south end
of (Alma Suter) sub-division. From that point on, inside the
metes and bounds, the R.O.W. is holes and mud. This part of
R.O.W. is within the jurisdiction of the Planning Board.
Cross R.O.W. (Board of Appeals) was approved with certain
requirements of improvement indicated in the red bracket area.
This was never acted upon and applicant indicated possible
withdrawal.

Dear Mr. Wickham:
Re: Approval of Access - Alma Suter
The Board of Appeals sent the following recommendation
to the Suffolk County Planning Commission on May 27, 1975:
"The Board recommends approval of improved
right of way access up to Lot No.1, which
would be temporary, until the 50 foot road
proposed for the center of Tut's Acres is
connected to a Town road. At that time, the
right of way will be abandoned. The Board
would set a condition that 15 feet of topsoil
be removed from applicant's right of way from
Main Road to a point of intersection of Lots
1, 2, 3, 4 - to be improved by bankrun and sand,
subject to Building Inspector's approval."
Mr. Gerald Newman, Chief Planner, replied that the
above captioned application is not within the jurisdiction
of the Suffolk County Planning Commission.
At a regular meeting of the Board of Appeals on
June 12, 1975, IT WAS RESOLVED, Alma Suter, New Suffolk
Avenue, Mattituck, New York, be GRANTED approval of
eighteen (18') foot access, as applied for, in accordance
with the Board's recommendations to the Suffolk County
Planning Commission, as stated in the May 22nd, 1975 minutes.
This approval is subject to the following conditions:
1. That 15 feet of topsoil be removed from applicant's
right of way from Main Road to a point of intersection
of Lots 1, 2, 3, 4.

The Suffolk County Planning Commission at its regular meeting April 9,
1975, reviewed the above captioned proposed subdivision plat referred to it
pursuant to Section 1333, Suffolk County Charter. After due study and delib-
eration, it did take the following action:
The Map of Tut's Acres, as submitted, was disapproved.
The Commission also offers the following comments on the map:
It is recommended that access for the Map of Tut's Acres and the Map of
Werner L. Adel, Jr., be coordinated so as to provide a single access point in
the manner recommended by the State of New York and that the other recommenda-
tions made by the State regarding the access point be carefully considered
and initiated in order to eliminate dual access points which condition can
create traffic carrying and safety problems on the State Road.

for this Department's comments on the above-noted site. plan.
Our Traffic Department has studied the attached plan and
found the following:
The 50' Right-of-way as sho\Yn on plan, Job #74-212, should also
include the adjoining 18 I strip of land of o"mer Alma Suter.
A street intersection would provide one point of access for
both parcels. The intersection is to be designed perpendicular
to Route 25. and is to inclucle 20' radii with concrete curb
returns. Include concrete curb and concrete sidewalk for the
frontage property.
