Dear Mr . Raynor :
I made an application in 1981 and processed some of it in 1982 ,
to your Board for sub-dividing the former Sidor property in Mattituck .
This is in the name of Long Island Nurseries and at that time , the
application called for four (4 ) plots , namely, 10 acres with a dwelling
and barn or potato storage building fronting on Wickham Road , and the
balance of 12+ acres divided into three plots , fronting on the four
land highway .
Because of the tremendous opposition I received from prospective
purchasers of this property, the chief objection was to the Covenant
which restricted further sub-division of these parcels in the future ,
I had to rethink this thing out . This type of approval has an effect
on the future value of that land , and it is quite obvious because no
one has proceeded to buy any one of these plots .
I have decided now since there appears to be interest in this
property by garden farmers , and grape growers , that i would divide this
into two parcels ; thel0 acres with improvements being one parcel , and
the 12 . 4 acres fronting on the four lane highway would be the 2nd parcel .
I would appreciate yours advising me whether it would be necessary
to proceed with an application for another sub-division map . I am
certain that the covenant would not apply in this particular case
more because it is two large parcels that would be used for the present ,
by farmers , and of course they would be interested in the general area
to develop sub-divisions, that they be permitted to make those sub-
divisions with the guidance of the Planning Board for whatever size plots
they would require at that time , and permitted by the Town of Southold
in their Zoning Ordinance .

Dear Mr . Raynor :
I have decided against a sub-division of my Nursery.
At the present time, I relish to dispose of just Lot 1 , which
consists of 10 .1003 acres and it is shown on the attached
map.
My question to you is whether this could be sold
without going through a sub-division Map, since it contains
10 acres and is being sold to a farmer who has use for the
land , machinery and the home. This will leave me with 12
acres on the County Highway.
The 10 acres , you will note, fronts on Wickham Ave.
and this would be appreciated very much, if it can be done ,
through some section of your Town Law which permits this .
I happen to know there have been parcels sold off that way
in Southold, and I believe this request would be pretty
much in line with others that were released in the area .
Your early reply and suggestions would be greatly
appreciated.

I ' m in receipt of your letter dated November 25th , giving
me unanimous approval for my requested application, provided that
I file Covenants and Restrictions which you have presented to me
for consideration. I appreciate your action in this matter , how-
ever, I cannot encumber my property with those Covenants and Re-
strictions since they will affect the parcel 's value in perpetuity.
It is quite obvious that I do not intend to work these four
parcels as an individual . I intend to sell them off to prospective
farmers or gardeners , and I am sure that in the future , if and when
Mattituck begins to develop, there may be reasons why these people
may further wish to subdivide the parcel . At that time , they would
be saddled with a problem and this would also affect their mortgage-
ability, and the re-sale values , and in all fairness to these people ,
I would not want to have this property encumbered, as I just stated.
Would my alternative here to be sub-divide it into one acre
plot$ , which, I believe, is the zoning covering this property:
In that event , I would naturally build up the density which I thought
the Town of Southold would like to minimize . If there is no other way
I could proceed with this minor-sub-division application , would it be
suggested on your part for me to proceed with a major sub-division
and convert this parcel into possibly 22 , one acre plots , or is it
possible that I may further appeal to your Board , once again, to
consider the enclosed form of a Covenant which is being used in the
Town of Riverhead, and which appears to be acceptable to most
applicants .
Your early replyvould be appreciated so I could proceed with
my alternative , if necessary.

with request of the Riverhead Town Planning Board wherein
a part of a parcel of land is subdivided and there remains
other land which could be subdivided

WHEREAS, (name of owner of property and address) is the owner of approximately
acres of land bounded and described as follows: (brief description) ,
and
WHEREAS, (owner) has requested the Planning Board of the Town of Riverhead,
for permission to subdivide into lot(s) , the said lot(s) being a part
or portion of the above described parcel of land, and
WHEREAS, on July 11, 1973, the Planning Board of the Town of Riverhead
resolved that where only a part of a parcel of land is subdivided there should
be submitted to the Planning Board a covenant restricting the remainder of the
above described parcel of land from further subdivision until the owner or
successor in title shall comply with Article XX of the Code of the Town of
Riverhead, now
THEREFORE BE IT RESOLVED, that the undersigned, (owner and address) ,
does hereby covenant and agree with the Planning Board of the Town of
Riverhead that no further application for the subdividing of any portion of
the hereinabove described parcel of land will be made either to the Planning
Board of the Town of Riverhead or to the Board of Appeal of the Town of
Riverhead or to the Building Inspector of the Town of Riverhead until such
time as a, subdivision map affecting all or a portion of the subject premises
be submitted to and approved by the Planning Board of the Town of Riverhead.
(d) Before granting final approval to a minor sub-
division plan, the Planning Board of the Town of
Chapter 108, Article XX, Riverhead shall require a covenant restricting the
Section 108-96A, Paragraph 2-B subdivision of any lot or remaining parcel of land
which could be further subdivided into lots
of the Code of the Town of meeting the area and width requirements of the
Riverhead Zoning Ordinance of the Town of Riverhead until
a major or minor subdivision plan is submitted to
the Planning Board complying with the rules and
regulations of the Planning Board for the sub-
division and platting of land. The instrument
containing the hereinafter set forth convenant
above referred to must be recorded in the Suffolk
County Clerk's office at the expense of the
subdivider, and a certified copy of the filed
a covenant shall be submitted to the Clerk of the
Planning Board of the Town of Riverhead. The
covenant shall be executed by the owner of the
entire parcel of land being subdivided and/or
shall be executed by the purchaser of a parcel of
land, designated as a lot.

Dear Mr. Raynor :
Thank you for the copy of the Covenants and Restrictions
you sent me, and we spoke about, at the hearing I attended on
October 19th .
Reviewing those Covenants and Restrictions , I think it is
most unfair for me to accept these restrictions , particularly
where I am agreeing to covenant these parcels that they will never
be sub-divided in perpetuity which is really extending it a long
ways and burdening the owners that might purchase this property.
At this moment , I felt I would keep a rural atmosphere by
having the large parcels sub-divided as I had shown in the Map I
presented to the Board, at the hearing. This , obviously will be
sold to people who are thinking of continuing their practice of
agriculture . This may go on for many, many years , However, like
most of us , we are human beings and God forbid, these people get
old and find they don ' t have any successors to follow them in their
business , they may be forced to sell it for a sub-division or
whatever. But in any event , I don' t see where there is any danger ,
on the part of Southold, to give this type of a breakdown that I ' m
requesting, because any further sub-dividing would have to be brought
back to the Town of Southold, and at that time , and whenever that
might be, whether 10 or 20 years from today, depending on conditions,
the Board at that time would decide if it is practical or not . I ' m
sure whoever the applicant may be , would have to abide by whatever
is stipulated at that time , for him or her to abide by.
At this point , a Covenant such as you are asking me to place
would make it very difficult to mortgage that parcel . It is bad
enough at this time to get financing without such Covenants . As an
appraiser , and I know what I would appraise a piece of property with
a Covenant of that sort, which I ' m sure would be detrimental to anyone
trying to finance the construction of his home , barns , and whatever
other requirements they might have to develop that particular parcel .

I am willing to abide by a Covenant that the Town of Southold
could provide , and one which the Town of Riverhead has , which I have
just recently accepted on a sub-division in Riverhead. If this is
agreeable to you , and I ' m sure you are familiar with that Covenant
where it states that the applicant would have to come to the Planning
Board at the time he decided to do any further sub-dividing, this
would be okay with me .
Kindly consider this , and let me know, and if there are any other
suggestions , it would be greatly appreciated.

The Southold Town Planning Board is in receipt of correspondence
from the Suffolk County Planning Department dissapproving the minor
subdivision entitled Long Island Nurseries for the following reasons :
1 . It is obvious that further subdivision of this tract
is proposed. Such subdivision can only have a detri-
mental impact upon the traffic carrying capacity and
safety of the county road by creating an unwarranted
number of points of access .
2 . The layout is considered to be poor planning.
As a result, the board suggests that you contact this office prior
to October 9, to arrange an appointment for our October 19 meeting,
so that we can discuss this matter further. Thank you.

DECLARATION OF COVENANTS
AND RESTRICTIONS
THIS INDENTURE made this day of 1981, by

hereinafter called the Declarant.
WHEREAS, the Declarant is the owner in fee simple of a certain parcel of land
situate at Greenport, Town of Southold, Suffolk County, New York, and designated on
the Suffolk County Tax Map as District �ection ;��Block and Lot contain-
ing approximately acres, being the same premises acquired by the Declarant by
deed dated and recorded in the Suffolk County Clerk's Office on
in Liber of deeds at page and referred to
herein as the "premises" and
WHEREAS, the Declarant intends to subdivide said premises for residential
purposes and desires to subject said premises to certain conditions, covenants and
restrictions in order to preserve the maximum open space, natural scenic beauty
and natural vegetation and to prevent overcrowding and to conserve the ground water
resources of the Town of Southold, and
WHEREAS, the Declarant had applied to the Planning Board of the Town of
Southold for approval of the subdivision and development of the premises as a Minor
Subdivision, to contain not more than four (4) lots or parcels.
NOW, THEREFORE, the Declarant does hereby declare that the aforesaid
premises and every portion thereof is hereby held and shall be conveyed subject to
the conditions, covenants and restrictions hereinafter set forth, and that every
purchaser of said premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the premises so purchased shall be held subject
to the covenants, conditions, and restrictions hereinafter set forth.
1. No lot or plot as shown and designated on the Minor Subdivision map
approved by and filed with the Southold Town Planning Board shall be further sub-
divided.
2. No dwelling, or other building or structure shall be erected or maintained
within feet of the top of the bluff or cliff adjacent to Long Island Sound.
3. In order to prevent the erosion of the bluff or cliff adjacent to Long Island
Sound, no vegetation shall be removed therefrom nor disturbed in any manner, nor
shall any stairways, paths or other structures be placed or maintained thereon,
without the written approval of the Southold Town Planning Board.
4. That all of the covenants, conditions and restrictions contained herein shall
be construed as real covenants running with the land and shall continue and remain
in full force and effect at all times as against the owner of the premises or any
portion thereof in perpetuity. Said covenants, conditions and restrictions shall be
binding; upon, inure to the benefit of and be enforceable by the Declarant, their heirs,
successors and assigns; any owner of any portion of the aforesaid premises, their
heirs, successors and assigns, and the Town of Southold, and its successors and
assigns, and the failure of any of the foregoing to enforce any of such covenants,
conditions and restrictions shall in no event be deemed a waiver of the right to do so
thereafter.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on September
2, 1981, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Long Island Nurseries", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to disapprove said
map for the following reasons:
1. It is obvious that further subdivision of this tract is proposed.
Such subdivision can only have a detrimental impact upon the traffic
carrying capacity and safety of the county road by creating an un-
warranted number of points of access.
2. The layout is considered to be poor planning.

Dear Mr. Kasper:
The following action was taken by the Southold Town Planning
Board at a regular meeting held August 3 , 1981.
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review Act
for the minor subdivision of Long Island Nurseries located at
Mattituck. An initial determination of non-significance has been
made.
In order to proceed with this determination the Southold Town
Planning Board would like to request that we need six (6) more maps
sent to us. I am enclosing a draft of covenants and restrictions in
regard to the boards request for a large-lot easement.
