Dear Mr. Jung:
The following took place at a meeting of the Southold Town Planning Board on Monday,
March 11, 2002:
The public hearing was closed.
The following resolution was adopted:
WHEREAS, James George and Linda Schaffer are owners of the property known and
designated as SCTM#1000-107-5-6.2 & 6.3 on Wickham Avenue, Hamlet of Mattituck;
and
WHEREAS, the applicants propose to set off 2.24 acres (Parcel 1) from a 22.28 acre
(Parcel 2); and
WHEREAS, the Town of Southold purchased the Development Rights for 20 acres of
Parcel 2; and
WHEREAS, on June 11,2001 the Planning Board granted sketch plan approval on the
map, dated April, 2001; and
WHEREAS, the Planning Board, pursuant to the State Environmental Review Act,
(Article 8), Part 617, performed an uncoordinated review of this unlisted action, made a

determination of non-significance and granted a Negative Declaration on June 11,2001;
and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated December 12, 2002, and authorize the Chairman to endorse the final surveys.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and
filed in the office of the County Clerk. Any plat not so filed or recorded within sixty (60)
days of the date of final approval shall become null and void.

and
WHEREAS, the applicants propose to set off 2.24 acres (Parcel 1) from a 22.28 acre
(Parcel 2); and
WHEREAS, The Town of Southold purchased the Development Rights for the 20 acre
Parcel 2; and
WHEREAS, on June 11,2001 the Planning Board granted sketch plan approval on the
map, dated April, 2001; and
WHEREAS, the Planning Board, pursuant to the State Environmental Review Act,
(Article 8), Part 617, performed an uncoordinated review of this unlisted action, made a
determination of non-significance and granted a Negative Declaration on June 11, 2001;

Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shah provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.

BE IT FURTHER RESOLVED, that the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, do an uncoordinated review of this unlisted
action. The Planning Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-significance, and grants a Negative Declaration.
Sketch plan approval is conditional upon submission of final maps within six months of
the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.

The Planning Board has reviewed the property and has determined that there is no
potential impact on park and playground use. Therefore, there is no requirement for the
reservation of land or fee for park and playground use.
The final maps should be amended in accordance with the letter from the Planning

of preparation.

Dear Mr. Jung,
The Planning Board has reviewed the proposed set-off application and maps and found
them to be acceptable for sketch plan approval. This will be granted at our public
meeting on June 11. We will also be doing an uncoordinated SEQRA review and
granting a negative declaration, because no new buildable lots are being created. Your
attendance at the meeting is not required.
There are a few items that need to be addressed for final approval. A Transactional
Disclosure Form, which is attached, should be filled out by the owners and submitted to
the Board. Also, the following changes should be made to the maps:
1. The scale should be 1 inch = 100 feet
2. The A-C zoning should be listed on the map
3. Since the two maps you submitted are nearly identical, you should only use
one. The set-off map is fine (except for the above), but the Health Dept. map
would need elevation contours and have "Set-OW' in the title.

Dear Mr. Jung:
The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, June 11, 2001:
WHEREAS, this proposed set-off is for 2 lots on 22.28 acres on the north side of
Wickham Avenue, between Mill Lane and Elijah's Lane in Mattituck; and
WHEREAS, Development Rights have been sold to the Town of Southold on 20 acres
of Lot 2; and
WHEREAS, there is an existing house on the proposed 2.24-acre Lot 1; be it therefore
RESOLVED, that the Southold Town Planning Board grant sketch plan approval to the
subdivision map, dated April, 2001.
BE IT FURTHER RESOLVED, that the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, do an uncoordinated review of this unlisted
action. The Planning Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-significance, and grants a Negative Declaration.
Sketch plan approval is conditional upon submission of final maps within six months of
the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.
Schaffer Set-Off- Pa,qe Two -June 12, 2001
The Planning Board has reviewed the property and has determined that there is no
potential impact on park and playground use. Therefore, there is no requirement for the
reservation of land or fee for park and playground use.
The final maps should be amended in accordance with the letter from the Planning
Board, dated June 5, 2001. In addition, future maps should list the month, day and year
of preparation.
Enclosed please find a copy of the Negative Declaration for your records.

them to be acceptable for sketch plan approval. This will be granted at our public
meeting on June 11. We will also be doing an uncoordinated SEQRA review and
granting a negative declaration, because no new buildable lots are being created. Your
attendance at the meeting is not required.
There are a few items that need to be addressed for final approval. A Transactional
Disclosure Form, which is attached, should be filled out by the owners and submitted to
