After reviewing your letter dated May 8, 1991, and the
history of this property, the Planning Board decided that it is
not necessary for you to make an application.
At present, the upper part of the right of way is separate
from the original parcel and the other lots in the subdivision.
Before the Tuthill-Kelly transfer, the entire right of way was
part of the Tuthill lot. The recent transfer, in effect, was a
subdivision of that lot without approval. Accordingly, the
entire right of way should be merged again, with either one or
all of the lots.
It is strongly recommended that the new deeds and surveys
be filed in the County Clerk's office and with the Town Tax
Assessor's office. I would appreciate a copy being sent to this
office so that our records on this subdivision are accurate.

Dear Mr. Orlowski:
Please be advised that this office represents Ralph Tuthill,
Jr. Mr. Tuthill inherited his father's house on Wickham Avenue,
Mattituck, designated as tax map number 107-4-9.1, and all of the
right-of-way from Wickham Avenue to the creek. By deed dated
June, 1990, Mr. Tuthill conveyed his father's house to Mr. and
Mrs. Christopher Kelly. The description of the property conveyed
by this deed included that portion of the right-of-way adjacent
to his father's house.
It was understood at the closing and recorded in writing
that it was the intention of Mr. Tuthill and Mr. and Mrs. Kelly
that that portion of the right-of-way be conveyed back to Mr. and
Mrs. Tuthill so that the entire right-of-way may be merged with
his house located directly behind the house now owned by the
Kelly's.
The transfer of the right-of-way from the Kelly's to Mr. and
Mrs. Tuthill will have no effect on the development of the
parcel. There will be no increase in the number of lots and all
those entitled to access through the right-of-way will continue
to enjoy same.
Before transferring the right-of-way Mr. Tuthill would like
guidance from your Board. Please advise if this transfer is
acceptable or if further information or appearance before the
Planning Board is required.

At one of the past work sessions, I brought the
above-referenced "subdivision" to your attention. If you recall,
the Tuthills had originally asked for a lot line change, which
was returned because this property was not part of a filed
subdivision map. At the work session, the Board decided that it
was in favor of granting set-off approval, provided Mr. Bruer
could obtain some kind of Health Department approval.
Yesterday I spoke with Harvey A. Arnoff, Town Attorney,
about the Tuthill subdivision in accordance with the procedure
that we have been following pursuant to the prior Town
Attorney's memorandum of September 1989. A copy of same is
attached for your convenience.
Harvey is not in agreement with the procedure outlined in
the memorandum of September 8, 1989, which advised that problems
of this nature would be resolved on a case by case basis by the
Planning Board, the Building Department and the Town Attorney.
Accordingly, that procedure will no longer be followed.
It is his opinion that the Tuthill's situation, and others
of that genre, could be handled by Changing the Town Code to
allow, as I understand it, the automatic grandfathering of
approval of lots that were created by deed, but that were later
merged by dint of a will. (For example, a father deeds out a
building lot to a child, who later inherits the adjoining land.
If both properties were deeded to the same person, a merger
occurs.) He indicated that he would be presenting such an

amendment to the Legislative Committee in the near future. Until
such time as there is a change in the Code, he is not
recommending that the Planning Board take any action on this
particular matter.
Accordingly, Rudy Bruer, who is representing the buyer of
one of these lots, was advised by this office to speak directly
with Harvey on this matter.

This memo will confirm our conversations and agreement concerning
certain illegal subdivisions.
As a result of our requirement for a title report showing single and
separate ownerships we have discovered a number of illeg'll subdivisions.
We have also discovered. on more than one occ'lsion. a p'lst practice by the
Planning Board of advising applicants that subdivision approval was not
necessary if the parcel to be "set off" was to be conveyed to a family
member or not to be sold. We have heard this same story from different
residents. This practice was going on during the late 1960's and
1970's. Now the family wishes to subdivide the remaining parcel only to
be told. and correctly. that the illegal "set-off" parcel must be included
in the parcel to be subdivided. In some cases the "set-off" parcel
already has a home built. and in one case. a third party non-family member
owns the home.
The hardship of the applic;:mt is obvious and the equities indic'lte
th'lt the Town should rectify the problem it cre'lted.
It was 'lgreed by us th'lt the illegClI "set-off" p'lrcel will be tre'lted
as a leg'll lot. Building permits C'ln be issued for this lot. The
Pl'lnning BO'lrd will not include the "set-off" p'lrcel with the p'll"cel to be
subdivided.

It was further agreed that each application that falls within these
guidelines will be reviewed by us on a case by case basis for
determination. In addition. set back lines etc.. will be covered by the
code provision in existence at the time the "set-off" was created. and not
by our present code.
When applicable a copy of this memo should be placed in each Planning
Board and Building Department file. Also. a further memo will be placed
in the files indicating that the particular application was reviewed by
the Planning Board. Building Department and Town Attorney's office and
approved as falling within this particular area.
At present the only application agreed Upon is the Pontino request
for a building permit which is to be granted. There are others which need
further reviews.

Dear Mr. Ehlers,
Your letter of February 22, 1990, asked for a confirmation
that the sale of the two lots in question does not require the
prior approval of the Planning Board.
The facts of the case are as follows: Mr. Tuthill Sr.
subdivided these lots without benefit of Planning Board approval
at the time the lots were created. As a result, there is no
filed subdivision map on record.
An application for a lot-line amendment is, in effect, an
application to amend an approved, filed subdivision map. Since
there is no filed subdivision map on these lots, there can be no
application to amend such a map.
Subsequent conversations with Karen Heppner of your office
and Diane Foster of Rudolph Bruer's office revealed that both
parties are looking to ensure the validity of the lots and to
protect the status of the homes that have been constructed on
them.
Given the above-noted facts, the Board cannot guarantee
that which you seek in your letter. The options that this Board
can offer to your respective clients are:

1. Submit a subdivision application to formally subdivide
all the land that was deeded out by Ralph Tuthill Sr.
without benefit of an approved map.
2. Submit a set-off application for just the two lots in
question.
In either option, the proposed, rather than the existing,
lot line would be shown. Obviously, the set-off application
would be the simplest and quickest option. If this option is
chosen, documentation would have to be provided to show that
both lots have rights of way over the access road bordering the
western edge of the lots.
