WHEREAS, the Declarants are the owners
certain parcel of land situate at Mattituck,
Suffolk County, New York, asd designated on
Tax Map as DJ. strict 1000, Section 106.00, Block 10.00 and Lot
001.000, containing approximately nine acres, being the same
premises acquired by the De¢larants by deed dated December 20,
198~ and recorded in the Suffolk County Clerk's Office on
December 31, 1984 in Liber 9705 of deeds at Page 580, and
referred to herein as the "premises" and
WHEREAS, the Declarants ~n~end to subdivide said premises
for residentisal purposes and desire to subject said premises to
certain conditions, covenants and restrictions in order to
preserve the maximum open space, natural scenic beauty and
natural vegetation and to prevent overcrowding and to conserve
the ground water resources of the Town of So~thold, and
WHEREAS, the De¢larants have applied to the Planning Board
of the Town of Southold for approval of the s~bdivision and
development of the premises as a Minor S~bdivision, to contain
four (4) lots or parcels.
NOW, THEREFORE, the Declarants do hereby declare that the
aforesaid premises and every portion thereof is hereby held and
shall be conveyed s~bject to the conditions, covenants and

restrictions hereinafter set forth, and that every purchaser of
said premises, or any portion thereof, by the aeeeptance of a
deed thereto, covenants and agrees that the premises so purchased
shall be held subject to the covenants, eonditions, and
restrictions hereinafter set forth.
1. No lot or plot as shown and designated on the Minor
Subdivision map approved by and filed with the Southold Town
Planning Board shall be further subdivided.
2. That ail of the covenants, conditions and restrictions
contained herein shall be construed as real covenants running
with the land and shall continue and remain in full force and
effeet at all times as against the owner of the premises or any
portion thereof in perpetuity. Said covenants, eonditions and
restrictions shall be binding upon, inure to the benefit of and
be enforceable by the Declaran~s, their heirs, suceessors and
assigns; any owner of any portion of the aforesaid premises,
their heirs, successors and assigns, and the Town of Southold,
and its successors and assigns, and the failure of any of the
foregoing to enforce any of such covenants, conditions and
restrictions shall in no event be deemed a waiver of the right to
do so thereafter.

Dear Mr. Lundstedt:
The following action was taken by the Southold Town Planning Board,
Monday, April 14, 1986.
RESOLVED that whereas a formal application for the approval of
a subdivision plat entitled "Markiewicz Estates" located
at Mattituck was submitted to the Planning Board on February
22, 1985 and filing fee of $100 was paid on February 22, 1985
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on Monday, March
24, 1986 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat
and application,
NOW, therefore, be it RESOLVED that the application of Mark
and Katherine Markiewicz for approval of said subdivision plat
prepared by Howard Young dated as amended August 23, 1985 be
approved and the Chairman be authorized to endorse approval
on said subdivision plat, subject to the following conditions
within six (6) months from the date of this resolution:
1. Filing the covenants and restrictions with regard
to no further subdivision in the Office of the County Clerk.
When the covenants and restricitons have been filed, will
