DECLARATIONS OF COVENANTS
AND RESTRICTIONS
( THIS INDENTURE made the 20th day of February 1987 by ALICE MARIE
\ B'ERGEN, residing at no number Mill Road, Mattituck, New York, 11952,
hereinafter called the Declarant.
WHEREAS, the Delarant is the owner in fee simple of a certain parcel
\ of land situate at Mill Road, Mattituck, Town of Southold, Suffolk County,
New York, and designated on the Suffolk County Tax Map as District 1000,
Section 106, Block 9, Lot 8 containing 11 .063 acres which premises are described
in the annexed "Schedule A", and referred to herein as the "premises", and
WHEREAS, the Declarant intends to subdivide said premises for residential

purchaser of said premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the premises so purchased shall be held

PLease let this confirm the Planning Board' s comments
with regard to the proposed covenatns and restrictions for the
above mentioned subdivision.
It was the consensus of the Board that they would accept
the covenants and restrictions which you proposed in your correspondent
of September 24 , 1986 providing that they be revised to state
"The covenants and restrictions shall run with the land and
the property may not be further subdivided without the approval
of the Southold Town Planning Board. "
Also, the Board requests that a clause be added stating
that if there is to be further subdivision it must conform
in all ways to a major subdivision.

Board, Monday, July 14 , 1986.
RESOLVED that whereas a formal application for the approval of

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal .
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval .
Other portions of the Suffolk County Sanitary Code also apply to
