At the hearing on July 8, 1988, you had an opportunity to
present your appeal of the department's ruling on the subject
application.
In accordance with the provisions of Article 2, Section 220,
of the Suffolk County Sanitary Code, the determination of the
Board of Review is as follows.
Based on the information submitted, the Board denied the
request for a variance for the 7 lot subdivision. Article 6
requires that in situations where groundwater is not potable
that a community water supply is required.

DECLARATION OF COVENANTS
AND RESTRICTIONS
DECLARATION made this day of ,
1987, by MATTITUCK CREEK ESTATES, having its principal
office at 131 Awixa Avenue, Bay Shore, New York 11706,
hereinafter referred to as "Declarant".
WI TNESSETH :
WHEREAS, Declarant is the owner in fee simple of a
certain parcel of land situate at Mattituck, Town of
Southold, County of Suffolk and State of New York,
containing 18.9108 acres, and designated on the Suffolk
County Tax Map as District 1000, Section 107, Block 01 and
Lot 02; being the same premises conveyed to Declarant by
deed dated , . recorded in the Suffolk County
Clerk's Office on , in Liber page ,
and referred to herein as the "premises".
WHEREAS, the Declarant intends to subdivide said
premises for residential purposes and desires to subject
said premises to certain reservations, restrictions,
conditions, covenants and agreements.
NOW THEREFORE, the Declarant does hereby declare
that the aforesaid premises and every portion thereof is
hereby held and shall be conveyed subject to the conditions,
covenants and restrictions hereinafter set forth, and that
every purchaser of said premises, or any portion thereof, by
the acceptance of a deed thereto, covenants and agrees that
the premises so purchased shall be held subject to the
covenants, conditions, and restrictions hereinafter set
forth.
ARTICLE I - DEFINITIONS
The following words when used in this Declaration
or any supplement(s) or amended Declaration shall, unless
the context otherwise prohibits, have the meanings set forth
below:
(a) "Property" shall mean and refer to the real
estate (described below in Article II), together with the
appurtenances thereto, any and all improvements thereon, or
any portion thereof, as well as to any of the Lots contained
therein.
(b) "Lot" shall mean and refer to any and each of
the pieces or parcels of land numbered 1 through 7,
inclusive, as shown on the Subdivision Map referred to in
Article II hereof, and particular Lots shall be identified
herein according to the respective numbers appearing on such
Subdivision Map.
(c) "Developer" shall mean and refer to James
Cohill, his successors and assigns.
(d) "Lot Owner" shall mean and refer to the
record owner of fee simple title to any Lot, including the
Developer with respect to an unsold Lot. Every record owner
shall be treated for all purposes as a single owner for each
Lot held, irrespective or whether such ownership is held
jointly, in common or by the entirety. Where such record
ownership of any Lot is held jointly, in common, or tenancy
by the entirety, the majority vote of such owners shall be
necessary to cast any vote to which such Lot Owner is
entitled. Any one Lot Owner owning two or more Lots shall
be treated as a separate Lot Owner for each Lot held for
purposes of any approval, voting or majority requirements
herein.
(e) As used herein, "Homeowners Association"
shall refer to an association, corporation, organization or
other voluntary or involuntary grouping of Lot Owners which
may be formed by one or more Lot Owners, including the
Developer, subsequent to the date hereof, and which provides
for the administration of any and all other Lot Owners upon
such reasonable terms and conditions as may be established
for membership by the Lot Owner or Lot Owners who form or
establish such Homeowners Association. All decisions of any
such Association shall be made by at least a majority of
Owner-Members in good standing. The purpose of such
Association shall be the preservation of community
appearance, standards and values, the enforcement of these
Covenants and Restrictions, and the control of and
jurisdiction over all portions of the Property, if any,
owned in common by all the Lot Owners. In the event that
two or more such Homeowners Associations should exist at the
same time, then the Association with the greatest number of
Owner-Members shall be entitled to the powers and duties
specified herein.
(f) "Cutoff Date" shall mean and refer to the
earlier of (1) four years after the Developers have conveyed
away all its fee simple title to the Property, (2) nine
years from the date hereof, or (3) at such earlier time as
the Developers transfer all their rights, duties,
privileges, obligations and powers hereunder to the
Homeowners Association, which transfer shall be evidenced by
a writing filed in the same office as this Declaration.
(g) "Open Space" shall mean the interior 10.5
acres as shown on the subdivision map.
ARTICLE II - PROPERTY SUBJECT TO THIS DECLARATION
The real property which is and shall be held,
transferred, sold, conveyed and occupied subject to this
Declaration is all that certain plot, piece or parcel of
land situate, lying and being at Mattituck, in the Town of
Southold, County of Suffolk and State of New York, being
lots numbered 1 through 7, inclusive, designated on a
certain map entitled "Map of Mattituck Creek Estates",
prepared by Young and Young, surveyors, heretofore approved
or about to be approved by the Southold Town Planning Board
and filed or about to be filed in the Suffolk County Clerk's
Office.
ARTICLE III - USE OF PROPERTY
(a) No lot shall be improved or have placed or
maintained thereon any structure other than a single family
dwelling, not to exceed two stories in height.
No dwelling shall be erected having less than
1,600 square feet of interior living area. A two story
dwelling shall contain a first floor area of not less than
1000 square feet exclusive of detached garage, open
breezeways, patios, terraces or basement. Each dwelling
shall have a full basement made of concrete block or poured
cement walls. Each dwelling shall be side with natural
materials only, no vinyl or synthetic sidings will be
permitted. Each dwelling shall have a garage, either
attached or detached for not more than three automobiles
with an asphalt or bluestone driveway extending therefrom to
the street pavement line. Each dwelling shall have a gable,
hip, or pitched roof. No flat roofs shall be constructed.
(b) No building of the type commonly referred to
as "mobile" or "modular" shall be installed on any lot.
(c) No building or structure shall be erected on
any lot until the building plans as to the location on the
lot, the outward appearance and design have been approved,
in writing, by the Declarant. There shall be no alteration
to the exterior of any dwelling or structure except in
accordance with the plans and specifications which have
received the prior written approval of the Declarant or its
successors or assigns. All dwellings and structures shall
conform to all applicable codes and regulations of the Town
of Southold, and no variance thereof may be obtained without
written approval of the Declarant or its successors or
assigns. Two copies of proposed plans and specifications
shall be submitted to the Declarant, its successors or
assigns, one of which, when approved, shall be returned to
the owner with such approval endorsed thereon. If the
Declarant, its successors or assigns, shall neither approve
or disapprove the plans and specifications within 30 days
after they have been submitted to and received, the plans
and specifications shall be deemed approved.
(d) No lot shall be used or maintained for any
purpose other than a one-family residence. No trade,
business or manufacturing shall be carried on in any
residence or anywhere on the property. Specifically exempt
from this restriction, however, are the practice of
medicine, dentistry, law and architecture, providing the
profession does not exceed the licensed practitioner and one
assistant. No obnoxious or offensive activities shall be
carried on upon any lot, nor shall anything be done on a lot
which may become an annoyance or nuisance to the neighboring
properties.
(e) No signs other than one identifying the
owner's name and number of the house or professional sign
shall be erected on the premises. Permissible signs shall
not exceed 10 inches by 20 inches, comprised of a white
field with black letters or a black field with gold letters.
This restriction shall not prohibit the Declarant, its
successors or assigns, from using said premises or any part
thereof for the sale of real estate, including the right to
place subdivision advertising signs or model home signs on
the premises.
(f)

(g) All exterior construction, including roof,
exterior walls, painting, windows, doors and landscaping
shall be completed within one (1) year from the date
construction commences.
(h) No commercial vehicles, recreational
vehicles, trailers, or campers shall be kept ungaraged on
any lot. Any boat stored on the premises is to be stored
along the rear line of the plot, if not garaged.
(i) No fences, either natural or man-made, shall
be grown or erected in that area of each plot which is
forward of a line established by extending the rear line of
each house to each side line of the plot. Each corner lot
shall for these purposes be considered to have its front
yard facing the subdivision road.
(j) No more than two domestic pets shall be
maintained on the premises by any lot owner.
(k) Exterior clothes lines shall not be installed
on any lot.

No area of the premises may be used for the
(1) No title in and to the bed of the road is to

ARTICLE IV - OPEN SPACE
It is the intention of the Declarant that the
premises are to be subdivided and developed as as a cluster
type development in order to preserve the maximum open space
and to impose certain restrictions on the use of such open
spaces for the purposes of natural beauty and open space;
the preservation of natural vegetation; and prevention of
overcrowding; and the conservation of water resources. To
effectuate such purposes, the following conditions,
covenants and restrictions are hereby imposed on that
portion of the premises designated as open space on the
subdivision map, to wit:
(a) The interior 10.5 acres as shown on "Map of
Mattituck Creek Estate, Town of Southold, Suffolk County,
N.Y.", heretofore approved or about to be approved by the
Southold Town Planning Board and filed or about to be filed
in the Suffolk County Clerk's Office, shall be leased to
Declarant, or to whomever he shall designate, for
agricultural purposes. The term of the lease to be for such
a period of time as determined by Declarant, or his
designee, at the inception of the lease. The consideration
shall be that tenant shall pay the real estate taxes on the
said 10.5 acres and maintenance costs. Upon the termination
of such lease, the Open Space shall be subject to the sole
jurisdiction of the Homeowners Association, in accordance
with the terms hereof.
(b) No structures shall be erected or placed in
or on any open space.
(c) No sand, gravel, top soil or other material
shall be removed from any open space nor shall any such
materials be deposited thereon, except as may be required
for agricultural use.
(d) No trees, or other vegetation shall be
removed from any open space except dead, diseased or decayed
trees, or such other removal of vegetation as may be required
for the proper natural preservation thereof and/or proper
agricultural use.
(e) Subject to the foregoing provisions of this
Article, the open space shall be used solely for drainage
and agricultural and recreational use of lot owners and
their guests.
(f) The use of the open space shall be subject to
such reasonable rules and regulations, including fees and
charges, as may from time to time be established by the
Declarant, or its successors and assigns.
ARTICLE V - GENERAL PROVISIONS
(a) Beneficiaries of Easements, Rights and
Privileges - The easements, licenses, rights and privileges
established, created and granted by this Declaration shall
be for the benefit of, and restricted solely to, the
Developer, the Homeowners Associations, the Lot Owners and
their respective heirs, executors and administrators, legal
representatives, successors and assigns, and any Lot Owner
may grant the benefit of such easement, license, right or
privilege to his tenants and guests and their immediate
families for the duration of their tenancies or visits, but
the same is not intended nor shall it be construed as
creating any rights in or for the benefit of the general
public.
(b) Duration and Amendment - The Covenants and
Restrictions of the Declaration shall run with and bind the
land, and shall inure to the benefit of and be enforceable
by the Developer, any of the Lot Owners and their respective
heirs, executors and administrators, legal representatives,
successors and assigns, and/or the Homeowners Association
(if any). However, nothing in this Declaration shall be
construed as obligating the Developer to supervise
compliance with or to enforce these Covenants and
Restrictions and no person shall have a cause of action
against the Developer for their alleged failure to so
supervise or enforce. Prior to the Cutoff Date, the
Developer may, in his sole discretion, modify, amend, renew
or abolish this Declaration or any portion thereof. After
the Cutoff Date, such power may be exercised by the
Homeowners Association or, if no such Association exists, by
any Lot Owner upon proof of the written consent of at least
60% of all Lot Owners. This Declaration shall terminate and
be of no further force and effect as of January 1, 2008,
unless the same is renewed prior thereto.
(c) Limit to Developers' Obligations -
Notwithstanding any provisions herein to the contrary, the
Developers shall have no further obligations, duties or
responsibilities pursuant to or resulting from this
Declaration subsequent to the Cutoff Date. If any written
approval is required subsequent to the Cutoff Date from the
Homeowners' Association, and no such Association, as defined
in Article I (f), exists, the the approval requirement shall
be deemed to have been waived.
(d) Severability - Invalidation of any of the
covenants, limitations or provisions of this Declaration by
judgment or court order shall in no way affect any of the
remaining provisions hereof, and the same shall continue in
full force and effect.

No drainage installations were shown on the map which was
forwarded to the County Soll and Water Conservation District for
comment. The report from this agency recommended a properly sized
recharge basin located in the property at the low point in the road
profile at Grand Avenue. The Town has a catch basin and a pipe
under the road at this low point to a drainage easement on the other
side of Grand Avenue. This installation will not be capable of
handling on slt~ runoff when house construction and grading operations
are completed. Based on the plan contours approximately ?5% of this
subdivision property drains to the one low point.
Installation of a recharge basin as recommended by the County
agency is approved but at a different location. Location to be at
the lower southeast corner of the open space, pipe connected to a
catch basin at the Grand Avenue low point via a 20 ft. easement for
access and pipe layin§ along the westerly property llne at'Lot ?
for 200 ft.± and in the Town R.O.W. for the remaining length of
502 ft.i along frontage for Lots ? and 6.

Dear Stan:
I have reviewed the preliminary plan for the JAMES COHILL SUBDIVISION at your
request. My comments are based upon an onsite investigation of the site and
review of the plan map submitted.
Soil Data and Interpretations:
The site, outlined in red on the enclosed soil survey sheet is comprised of
three soil types. Haven loam, 0-2 percent slopes (HaA) covers the majority
of the property. This soil has few limitations for homesites. A steeper
sloping phase of this soil, Haven loam 2-6 percent slopes (HaB), is found in
the natural drainageway located along the south property line directly west
of lot 7. There is definitely an erosion hazard within this area. It should
be planted to permanent grass, especially if it is to be used for agricultural
purposes. The grass should extend up to contour elevation 46 as a minimt~n.
Carver Plymouth sands, 3-15 percent slopes is found in the northwest corner of
the property within lot 1, forming the steep bank along Mill Road. The slope
of this bank is between 20-25 percent and creates a real problem for access
into lot 1. The driveway into lot 1 should be installed on the contour. Guts
perpendicular to the slope should be avoided. Disturbance of this slope should
be kept to a minimum. Ail native vegetation currently protecting this slope
should be protected as much as possible. Any exposed areas should be limed,
fertilized and seeded to a grass mixture tolerant of dry sandy conditions such
as:
Creeping Red Fescue 1 LB per 1000 square feet
Tall Fescue 1 LB per 1000 square feet
Redtop 0.5 LB per 1000 square feet
The seeded areas should be mulched immediately after seeding. Hydroseeding
would be the preferred method if available.
Storm Water Mana~ement~
Onsite disposal of roof runoff from the house in lot 1 should be mandatory (see
attached sketch). Any increase in runoff traveling over the steep bank may
cause erosion problems and eventual sedimentation of Mattituck Creek.
The majority of the runoff travels in a north to south direction, collecting in
the southeast corner of the property in lots 5 and 6. A culvert pipe was installed
at this point under Grand Avenue. It appears that this culvert was installed

to help alleviate ponding and flooding problems along Grand Avenue. The
culvert pipe outlets on the southeast side of the road onto private property.
With the construction of six houses within this watershed, runoff will in-
crease significantly. I would recommend that the town remove the culvert pipe
since its outlet is suspect. The developer should then be required to handle
all runoff onsite. The installation of a properly sized recharge basin at this
location would be one solution to this problem.

TOWN OM SOUTHOLD - James Coh~Subdivision

These soils are deep, excessively drained and coarse-textured. Soils
in these units can be made up entirely of Carver sand, entirely of
Plymouth sand, or of a combination of the two soils. The texture of
the Carver soils is fine sand and coarse sand 0 - 22 inches. Coarse
sand and gravelly sand is found 22 - 60 inches. The Plymouth soils
have textures of fine sand and sand 0 - 27 inches. The permeability
of these soils is rapid or very rapid. Available moisture holding
capacities are low to very low. Natural fertility and organic matter
content of Carver and Plymouth soils is low. The crop response to
lime and fertilizer applications is fair. If fertilizer is applied,
frequent applications of small amounts should be made to reduce nutrient
loss by leaching. These soils are not well suited to crops cormmonly
grown in Suffolk County. They are too droughty, too steep, too
stony or too sandy for crops, pasture or nursery stock. These sandy
soils severely limit installation and maintenance of lawns and land-
scape shrubs. A permanent cover of plants should be maintained or
restored on all soils in this unit to reduce erosion.
CpC Carver and Plymouth sands? 3 to 15 percent slopes.
These soils are mainly on rolling moraines; however, they are also
found on the side slopes of many drainage channels. Some areas of
these soils are as much as 25 percent gravel. In the bottom of
many closed depressions~ these soils have siltier accumulations
from adjoining hillsides. Silty lenses are sometimes found deep
into the lower layers. The erosion hazard is moderate to slight,
but a permanent cover of plants should be maintained or restored
on this soil.
.TOWN O~ SOUTHOLD - James Coh Subdivision
~AVEN SOILS (RaA; RaB~ RaC~ He).
Haven soils are deep, well-drained, medium-textured soils that formed
in a loamy or silty layer over stratified coarse sand and gravel.
The texture from 0 - 19 inches is loam, silt loam, and very fine
sandy loam. From 19 - 28 inches the range is silt loam, very fine
sandy loam, and gravelly loam, while the texture from 28 - 55
inches is gravelly sand, loamy sand, sandy loam or stratified sand
and gravel. The permeability is moderate in the root zone (surface
layer and subsoil) and rapid or very rapid in the underlying layer.
These soils have moderate to high available moisture capacities (see
attached table). Haven soils have low organic~atter content and low
natural supply of plant nutrients, but crops respond well to lime
and fertilizer. When the soils are intensively cultivated the
likelihood of crusting is great, however the returning of cover
crop residue decreases this problem. Generally, these soils are
well suited to crops commonly grown in Suffolk County.
,.TOWN O~ SOUTHOLD - James Coh~Subdivision
HaA Haven loam? 0 - 2 percent slopes.
These soils are usually large in area and nearly level with some areas
of slight undulation. The erosion hazard of these soils is slight but
erosion problems are likely to occur in undulating areas. Irrigation
water should be applied at a moderate rate. Management concerns in-
clude crusting after rain, maintaining tilth, and reduction of the
plow pan.
HaB Haven loam? 2 - 6 percent slopes.
Most small deposits of this soil have short slopes, but larger areas
are undulating. Cultivated areas of this soil are 2 - 3 inches shallower
to gravel than the representative Haven soil because of past erosion.
'The erosion hazard of this soil is moderate to slight. The number of
consecutive years these soils can be safely cultivated depends on
practices used for erosion control and water management. These soils
should not be cultivated intensively unless adequate measures are used
to help control erosion. In addition to erosion control, management
concerns include increasing the organic matter content to help keep
the soil loose and crust free, and breaking up the plow pan. Irri-
gation water can be applied at a moderate rate. Practices that help
control erosion greatly increase the effectiveness of natural rainfall
and irrigation water. Areas of soil that are eroded have reduced
water holding capacities.
"TOWN OF SOUTHOLD - James CohiOSubdivision
Riverhead Soils (RdA~ RdB? RdC).
Riverhead soils are deep~ well drained, moderately coarse-textured soils
that formed in a layer of sandy loam or fine sandy loam over thick layers
of coarse sand and gravel. The texture from 0 - 32 inches is sandy loam
and fine sandy loam. Sand, loamy sand, gravelly sand and gravelly loamy
sand is found at depths of 32 - 65 inches. The permeability is moderately
rapid in the root zone (surface layer and subsoil) and very rapid in the
underlaying layer. Riverhead soils have moderate to high available
moisture capacities (see attached table). Natural internal drainage is
good, but in many places where these soils have been farmed a plowpan has
formed. These soils have iow organic matter contents and low natural
supply of plant nutrients~ but crops respond well to lime and fertilizer.
Generally~ these soils are well suited to crops co~mmonly grown in Suffolk
County.
RdA Riverhead sandy loamy 0 to 3 percent slopes.
Areas of these soils are usually large and uniform and nearly level with
some areas of undulating slopes. The erosion hazard is slight. Moderate
droughtiness somewhat limits plant growth unless irrigation water is ap-
plied. Returning crop residue to the soil and growing winter cover crops
help to protect the surface layer from wind and water damage. The addition
of this organic matter also improves the available moisture holding capa-
city of the surface layer.

subdivision proposal, as well as, your correspondence

It is the consensus of the Board that this proposed subdivision
be re-drawn and they offer the following for your consideration:
In a cluster subdivision, any utility easements must be
deleted from the gross ~rea of the land prior to computing
the maximum number of lots. (refer to §100-136 A 1)
The Board requests, if this subdivision is to be a cluster,
that the lots be one-acre. Or, they recommend a conventional
layout of two-acre lots. The current proposal mixes the cluster
~nd conventional layouts since some lots are two acres or more.
When we are in receipt of amended maps, the Board will
review them and forward any additional recommendations.
If you have any questions, please don't hesitate to contact
