The following action was taken by the Southold Town Planning
Board, Monday, February 10, 1986.
RESOLVED that whereas a formal application for the approval of
a subdivision plat entitled Martin Kruse (plat entitled Elsa
R.Kruse) located at Mattituck was submitted to the Planning
Board on February 14 , 1984 , and filing fee of $100 was paid
on February 14 , 1984 and,

WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on January 27,
1986 at 7 : 30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application
NOW, therefore, be it RESOLVED that the application of Martin
Kruse for approval of said subdivision plat prepared by Rod Van
Tuyl dated as last amended July 26, 1985 be approved and the
Chairman be authorized to endorse approval on said subdivision

Dear Mr, Orlowski:
The Suffolk County Planning Commission at its regular meeting on September
4, 1985, •reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Elsa R. Kruse", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reasons:
1 . The proposed subdivision will result in the creation of three land-
locked parcels; that is, parcels that do not have frontage on an
existing or proposed public road. The creation of such lots is con-
trary to good subdivision layout principles and creates problems as
far as access by emergency and service equipment is concerned; this
could result in health, safety and welfare problems for the future
residents of these lots. Creation of landlocked lots also places
the Zoning Board of Appeals in the awkward position of having to
grant a building permit for each of these lots under Section 280-a
of the Town Law as the future owners of these lots cannot be held
responsible for the landlocked nature of the parcels .
2 . It was not stated if the 25 foot right-of-way through Lots 2 and 3
will be restricted to pedestrian use. If this right-of-way is to
be used by vehicles then greater consideration should have been
given to the constraints imposed by the topography.

State Environmental Quality Review Act and 6NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Elsa R. .Kruse is for 4 lots on
9 acres, located off Grand Avenue, Mattituck. Tax Map No.
1000-107-1-10
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence from the
Department of Environmental Conservation it is assumed
that there is no comments or objections from that
agency.
The Suffolk County Department of Health Services has no
objection to our designation of lead agency, they have
received an application and it is incomplete. The department
is awaiting final maps to be submitted for approval .
Individual sewage disposal system can be utilized. Although
the testwell results meed SCDHS standards , the quality is
marginal , with high nitrates and trace carbofuan contamination.
A test well will be required on each lot prior to construction.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

Dear Diane:
With respect to this matter the last entry in your file
should be a negative declaration dated July 8, 1985.
Prior to that there was correspondence from Charles G.
Lind dated June 6, 1985 to Bennett Orlowski, Jr. advising that
the lot lines must have exact dimensions, the lots must have exact
areas, and the lot lines must have bearings.
In the intervening period and on July 2, 1985, Roderick
Van Tuyl amended his prior survey only to reflect the test well
detail at the bottom center of the survey, the sewage disposal
detail at the lower left hand side of the survey and left space
of four inches by five inches for the Suffolk County Health Department' s
approval stamp. On the same date, the survey as amended for the
purposes of Roy Reynolds at the Health Department was sent to
Roy Reynolds and awaits his approval. I had spoken to Roy Reynolds
on June 19, 1985 and it is my understanding that the Health
Department has all but approved this application, subject only
to the July 2, 1985 amendments, but I believe we are now caught
in the eight-week time drag that is prevailing at the Suffolk
County Health Department.
With respect to the letter of Charles Lind on June 6,
1985, I am now submitting seven copies of Mr. Van Tuyl' s revised
plan dated July 26, 1985 which shows lot line bearings and distances
and the area of each lot.
Could this matter be placed on the agenda of the Planning
Board whenever possible and could we be notified of the new hearing
date.

Services and he has advised me that the reason that he has
noticed this matter as an incomplete application is that your
office has failed to supply his office with a drawing leaving
sufficient space C41'x5l'}_ for the approval stamp, with a drawing
showing sewage disposal locations and details and with a
drawing showing the test wells and details , Could you please
amend the drawings that you have supplied to date and send
sufficient copies directly to the undersigned. I will then see
to the submission of these documents to Mr. Reynolds so that
this matter can move forward,
Mr. Reynolds advised me that the application has been
effectively approved subject to receipt by the Health Department
of the required drawings from your office, Until then the
application stands incomplete with the Health Department office,
Would you please make certain that you send all documents
directly to the undersigned. Do not send any documents to the
Kruse family at their post office box in Mattituck since they are
in 'Vermont for the summer,
Please advise the undersigned, by telephone, upon
receipt of this letter if there is any problem with these rete

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with. the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal .
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements .
The Health Department maintains ,jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval .
Other portions of the Suffolk County Sanitary Code also apply to

Dear Ms. Schultze:
My client, Martin Kruse, advised today by telephone
that he stopped in your office this past week and was advised
that you are awaiting a survey from me. I do not have any
record of a request for a survey. The last correspondence
here was August 27, 1984, to which you responded on September
19, 1984, advising that the Board would approve the 30-foot
right-of-way on the condition that, if there is another sub-
division adjacent and Northerly of the subject premises, the
current applicant would join in the dedication of their road
bed to permit the development of a municipal road serving
this subdivision and the adjoining subdivision.
I wrote to you on September 19, 1984 to advise you
that this condition would be acceptable.
I have not had any further information from you, and
I would be grateful if you could directly advise me whether
you are awaiting anything from me.

Dear Ms. Schultz :
I have your message with respect to the Kruse
subdivision. The Board, as I understand it, will approve the
30-foot right of way on a condition that if there is a further
subdivision adjacent, presumably northerly, of the subject
premises, the Kruse family would covenant that they would
join in a dedication of their portion of the road so as to
permit the development of a municipal road. That is a completely
acceptable condition and I would be grateful if a resolution could
be prepared and forwarded to me so that I can prepare the necessary
covenant.
I have not spoken to my clients about this, but I
will draft a letter to them in the morning and I am sure that
they will have no problem.

Dear Mr. Orlowski:
Thank you for your letter of August 21 , 1984. I know
that the Kruse family would be pleased to comply with the Board' s
request but unfortunately they do not own the right-of-way from
Grand Avenue to the property except to the extent of 30 feet.
They are, therefore, unable to widen that area to 50 feet. Assuming
that the Village is interested in the width of the pavement rather
than the width of the bed of the road, inclusive of shoulders and
the like , I am not sure how the 30 feet improved to its full width
is a problem. Could you let me know the Board' s thoughts on this
particular point.
With respect to the 25 foot right-of-way along the Fox
right-of-way, this is not a problem and I would assume that the
drawing as submitted will be acceptable.
One thought occurs that I perhaps should mention. Would
you like the easterly most portion of the Kruse property between
the 30 foot right-of-way and the northeast corner of the Fox right-
of-way to be expanded to include an area where a car could pull to
the side in the event of passing traffic . This shouldn' t be
necessary to the extent that there would be an improved bed of 30
feet, but to the extent I am unable to ascertain the reason for the
50 foot request. I make this suggestion for whatever it is worth.

Avenue be widened to 50' and extended at a width of 25 '
along the northerly boundary, parallel to the right-of-
way of Fox.
Would you please submit six (6 ) copies of the survey amended
to reflect the change in the right-of-way as per the
Planning Board' s request. (see the enclosed copy for
details) It was also noted that the application for
approval of plat was not submitted; enclosed is a copy
for you to fill out and return.
