Dear Mr, Orlowski: The Suffolk County Planning Commission at its regular meeting on September 4, 1985, •reviewed the proposed subdivision plat entitled, "Minor Subdivision - Elsa R. Kruse", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: 1 . The proposed subdivision will result in the creation of three land- locked parcels; that is, parcels that do not have frontage on an existing or proposed public road. The creation of such lots is con- trary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the landlocked nature of the parcels . 2 . It was not stated if the 25 foot right-of-way through Lots 2 and 3 will be restricted to pedestrian use. Lind dated June 6, 1985 to Bennett Orlowski, Jr. advising that the lot lines must have exact dimensions, the lots must have exact areas, and the lot lines must have bearings. In the intervening period and on July 2, 1985, Roderick Van Tuyl amended his prior survey only to reflect the test well detail at the bottom center of the survey, the sewage disposal detail at the lower left hand side of the survey and left space of four inches by five inches for the Suffolk County Health Department' s approval stamp. On the same date, the survey as amended for the purposes of Roy Reynolds at the Health Department was sent to Roy Reynolds and awaits his approval. I had spoken to Roy Reynolds on June 19, 1985 and it is my understanding that the Health Department has all but approved this application, subject only to the July 2, 1985 amendments, but I believe we are now caught in the eight-week time drag that is prevailing at the Suffolk County Health Department. With respect to the letter of Charles Lind on June 6, 1985, I am now submitting seven copies of Mr. Van Tuyl' s revised plan dated July 26, 1985 which shows lot line bearings and distances and the area of each lot. I know that the Kruse family would be pleased to comply with the Board' s request but unfortunately they do not own the right-of-way from Grand Avenue to the property except to the extent of 30 feet. They are, therefore, unable to widen that area to 50 feet. Assuming that the Village is interested in the width of the pavement rather than the width of the bed of the road, inclusive of shoulders and the like , I am not sure how the 30 feet improved to its full width is a problem. Could you let me know the Board' s thoughts on this particular point. With respect to the 25 foot right-of-way along the Fox right-of-way, this is not a problem and I would assume that the drawing as submitted will be acceptable. One thought occurs that I perhaps should mention. Would you like the easterly most portion of the Kruse property between the 30 foot right-of-way and the northeast corner of the Fox right- of-way to be expanded to include an area where a car could pull to the side in the event of passing traffic . This shouldn' t be necessary to the extent that there would be an improved bed of 30 feet, but to the extent I am unable to ascertain the reason for the 50 foot request.
