This property is owned by Mill Lane Building and Contracting Corporation and is being developed in the cluster concept with the approval of the Southold Town Board and Southold Town Planning Board. Section 100-136 A. of the Code of the Town of Southold reads "The maximum number of single-family lots that may be approved in a cluster development shall be computed by subtracting from the total gross area a fixed percentage of twenty percent of said area and dividing the remaining eighty percent of the area by forty thousand square feet. " The developer has proposed ten lots on the road with the rest of the property remaining in open space which is directly behind your property. A public hearing has not yet been scheduled for the final map . Feel free to call this office from time to time to determine if a date has been set. Pell, III Town of Southhold Town Hall Main Road Southhold, New York 11971 Dear Mr. Pell: On the occasion of a visit to my property on N/S Wickham Avenue (just east of Mill Lane) in Mattituck this past Sunday, I discovered from conversation with a neighbor that the owner of a 15+ acre parcel (which physically adjoins the north property line of my 2.16 acre plot) fronting on Mill Lane is attempting to have his property down-zoned in order to develop it with high density housing. I most strenuously object: : : I I purchased my 2 acres in 1976 from the then owner of the subject 15+ acre parcel. I purchased it as the location of my proposed future retirement home. One of the reasons I purchased it and paid a premium for it, was the minimum one acre building plot zoning in the immediate area. This one acre zoning means to me that the rural character of the area will not be marred by such development as apparently is being, suggested in this case. The one acre zoning is a protection for me, as a taxpayer and property owner against ruthless, fast-buck, so- called builder developers who would swoop in, down-zone, construct and be off to spoil another area (with his pockets stuffed at the t expense of the other property owners left behind and at the expense of the loss of one of the few remaining rural areas on Long Island) . 1� n • y • • • • THE SEAMENS BANK Supervisor William R. Jr. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The major subdivision of "Mill Lane Building and Contracting Corporation" located at Mattituck is a ten-lot residential subdivision of 15.438 acres. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because it is more than 300 feet from tidal wetlands, it is not under the jurisdiction of the New York State Department of Environmental Conservation. The Suffolk County Department of Health Services had indicated no objection to the designation of lead agency and upon submission, will make a review of the proposed water supply and sewage disposal facilities for the subdivision. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land Regulations and the Southold Town Board has approved the cluster concept subdivision. Raynor, Jr. , Chairman Planning Board Main Road Southold, New York Re: Mill Lane Building & Contracting Corporation Dear Mr. Raynor: At the public hearing on the preliminary map of the subdivision known as Mill Lane Building & Contracting Corporation located at Mill Lane, Mattituck, New York, an objection was made that the subdivision conflicts with Article 25 AA of the Agricultural and Markets Law of the State of New York. As you are aware, this statute provides for the establishment of agricultural districts. On behalf of the applicant, Mill Lane Building & Contracting Corporation, we believe that the objection is without basis because of the following: 1) An examination of the proposed map indicates that the subject property is not within the agricultural district, the district being composed of a number of designated parcels. 2) The agricultural district in the Town of Southold does not appear to be in effect since the map has apparently not been filed with the County Clerk and has not been published as required by Section 304 of Article 25 AA. While we will take issue with the assertion that inclusion in an agricultural district would prohibit the use of the proposed property, it is not necessary to further discuss that issue since the land is not included in the proposed district nor is the district in effect. We are aware that the board will further investigate the question Henry E.
