Dear Ms. Thomas:
The following took place at a meeting of the Southold Town Board on Monday, March
11 , 2002:
The public hearing was closed.
The following resolution was adopted:
WHEREAS, the applicant proposes to set off a one (1) acre lot with 150.0 ft. frontage
along the east side of Breakwater (Luther's) Road from a 25.8 acre lot; and
WHEREAS, the applicant has received a letter from the Suffolk County Water Authority,
dated September 20, 2001 , confirming that water is available to the lot via a water main
on the west side of Breakwater Road; and
WHEREAS, the lot is located within a R-80 Zoning District and does not conform to the
R-80 minimum zoning requirements; and
WHEREAS, the Zoning Board of Appeals has approved a variance (Appeal No. 3819)
for the proposed one (1) acre lot set-off granting relief from the R-80 Zoning District
regulations; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, performed an uncoordinated review of this
unlisted action, made a determination of non-significance and granted a Negative
Declaration on January 30, 2002; and

WHEREAS, the final public hearing was closed on said subdivision application at the
Town Hall, Southold, New York on March 11, 2002; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated July 19, 2001, and authorize the Chairman to endorse the maps.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and
filed in the Office of the County Clerk. Any plat not so filed or recorded within sixty (60)
days of the date of final approval shall become null and void.

Appeal No. 3819 :
Upon Application of RUT?LANN BARTRA for a Variance to the
Zoning ordinance, Article =__ , Section 100-32 for approval of
lot containing insufficient lot area located along the easterly
Side of Breakfwater (or Luthers) Road, Hamlet of Mattituck, NY;
identified on the Suffolk County Tax Mapsas District 1000 ,
Section 106 , Block 9, Lot 1.004 (part of 2 . 1) . The premises is
located in the R-80 Zone District.
WHEREAS, a public hearing was held on April 13 , 1989 in the
Matter of the Application of RUTHANN BARTRA under Appeal No.
3819 ; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and dccumentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1 . The premises in question is located in the "Low-Density
Residential R-80" Zone District and is referred to as District
1000 , Section 106 , Block 9 , Lot 2 . 004 on the Suffolk County Tax
Maps , conveyed by executor' s Deed at Liber 10707 cage 351 dated
September 1, 1988.
2. The subject premises as exists:
(a) contains a total lot area of 43 , 560 sq. ft. with
150 .0 ft. frontage along the east side of Breakwater (or
Luthers) Road;

( b) was conveyed to the applicant on September 1 ,

October 12, 1983 . (Letters Testamentary were issued on
December 13 , 1983) ;
(c) was -part of a 26 .715 acre parcel described in
deed recorded in Liber 1797 page 512.
3 . Article III, Section 100-21, Bulk Schedule, of the R-30
Zone Regulations provide for a minimum lot area of 80 , 000 sq.
ft. Although the relief requested in relation to the
requirement is substantial, the lot area as proposed is not out
of character with the lots in the immediate vicinity, as
described, infra.
4 . In viewing the immediate area of the subject premises,
the following information is noted:
( a) the subject premises immediately abuts the R-40
Low-Density Residential Zone District to the north;
(b) the premises to the west is a Development known
as Captain Kidd Estates which is also located in the R-40
Low-Density Residential Zone District and which consists of lots
generally of 10 ,000 to 12,000 sq. ft. in area;
( c) premises adjacent and adjoining the northerly
property line of the subject lot contains a lot area of one acre
and is improved with multiple residences (ID$1000-106-9-1 new or
formerly of Gannone) ;
(d) premises adjoining the subject premises to the
south/east is a 26+- acre parcel presently vacant and
undeveloped at this time.
S . For the record it is noted that:
(a) the predecessor in title died only a few months
after the enactment of Local Law #7-1983 adopted May 13 , 1983
which provided for an increase from 40,000 sq. ft. to 80 , 000 sq.
ft;
(b) the evidence does prove the intentions of the
decedent/predecessor in title to convey the land in a manner
permitted under zoning near the time of his death;

( c) the map submitted and pending before the Southcld
Town Planning Bcard does confirm the propesed laycur of the

the lots without fu-ther lot area reductions and as required by
the minimum lot area regulations of the zoning code ( and as
deemed proper under the subdivision regulations by authority of
the Planning Board) .
6 . In considering this application, the Board also finds
and determines: (a) the relief as reauested does not in turn
increase the dwelling unit density; (b) the evidence
submitted, and practical difficulties hated, are sufficient to
warrant a grant of this variance;
(c) there l be no
substantial change in the character of the neighborhood or
detriment to adjoining properties for reasons as noted in the
above paragraphs; (d) the difficulties cannot be obviated by
some method feasible to the appellant to pursue, other than a
variance; (e) that the relief requested is not out of
character with those lots generally existing in the immediate
area; ( f) that in view of the manner in which the
difficulties arose, and in considering all the above factors,
the interests of justice will be served by granting the
variance, as conditionally noted below.

David W. Cooner, now in the ownership of devisees under the Last
Will and Testament, are subject to authority of the Planning

f FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method wherebv applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifving the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

NOTICE OF PUBLIC HEARING
§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§58.1. Providing notice of public hearings. .
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon.The board or commission
reviewing an application shall provide for the giving of notice:
A, By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not less than seven (7) days

The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, February 11, 2002:
WHEREAS, the applicant proposes to set off a one (1) acre lot with 150.0 ft.frontage
along the east side of Breakwater (Luther) Road from a 25.8 acre lot; and
WHEREAS, the applicant has received a letter from the Suffolk County Water Authority,
dated September 20, 2001, confirming that water is available to the lot via a water main
on the west side of Breakwater Road; and
WHEREAS, the lot is located within a R-80 Zoning District and does not conform to the
R-80 minimum zoning requirements; and
WHEREAS, the Zoning Board of Appeals has approved a variance (Appeal No. 3819)
for the proposed one (1) acre lot set-off granting relief from the R-80 Zoning District
Regulations; therefore be it
RESOLVED, that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, do an uncoordinated review of this unlisted action.
The Planning Board establishes itself as lead agency, and as lead agency, makes a
determination of non-significance and grants a Negative Declaration; and be it

FURTHER RESOLVED, that the Southold Town Planning Board grant sketch plan
approval on the maps dated July 19, 2001.
Sketch plan approval is conditional upon the submission of final maps within six months
of the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.

An Environmental Assessment Form has been submitted and reviewed, and it was
determined that no significant adverse impacts to the environment were likely to occur
should the project be implemented as planned.
The applicant will have to comply with the requirements of the Suffolk County Sanitary
Code (SCSC) and all relevant standards of water supply and sewage disposal systems.
Design and flow specification, subsurface soil conditions and site plan details will have
to be approved by the Suffolk County Department of Health Services (SCDHS). This
impact is not considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required relevant
permits.

Dear Chairman Orlowski and Planning Board members:
I am the attorney for Jeff Grathwohl and Audrey Grathwohl,
owners of the above referenced parcel or property. As you know, Mr. and
Mrs. Grathwohl have made application to your Planning Board for a set
off of this parcel from the larger parcel owned by Mr. Cooper. This
application was commenced in 1989 when Mr. Cooper's sister, Ruth Ann
Bartra, obtained an approval from the Zoning Board of Appeals allowing
the creation of a one-acre parcel in an R-80 zone. Mrs. Bartra was
deeded this lot in 1989 by her brothers as part of the settlement of their
father's estate.
While I was unable to attend your last work session due to a death
in the family, Mr. Grathwohl did attend and advised that there was a
discussion concerning the applicability of section A106-38 of the Town
Code of the Town of Southold, which requires the payment of fees in lieu
of reserving land for recreation purposes, to this set off application.
We are respectfully requesting that your Board not apply the fee
requirement to this "set-off" application. The reasons for our request are
as follows:

1. Your code specifically distinguishes "set off" applications from
subdivisions (See, A106-13 SUBDIVISION). Within the definition of
"Subdivision", in Chapter A106-13 the code states as follows:
"The division of any parcel into two (2) or more lots, plots, blocks,
sites or other divisions of land ... provided however, that the term
"subdivision" shall not include the setoff or creation of a single lot from a
parcel of land ..."
Thereafter the code provides the Planning Board with criteria to
determine whether the set off constitutes a "subdivision". Those criteria
include consideration of possible adverse municipal impacts, none of
which this lot will create. I believe that this set off application meets all
of the criteria necessary to be considered a simple "set off", rather than a
subdivision, and thus could be exempted from the fees imposed on
subdivision pursuant to section A106-38(E) of your code which apply
only to subdivisions.
Additionally, it is clear from a reading of A106-38 that the payment
of fees in lieu of creation of park or recreational facilities are geared
toward subdivisions that require major improvements such as roadways,
drainage and street trees. This "set off" will not require these traditional
subdivision improvements and would not have the recreational impacts
of a large subdivision. The subject lot fronts directly on an existing road
with existing utilities and is being split off for the construction of a single
family dwelling for Mr. and Mrs. Grathwohl and their two young sons.
The Suffolk County Water Authority will provide public water.
2. The larger parcel from which this lot is being divided is a legally
existing lot, which is currently in active agricultural production. There
are no recreational needs that will be generated by its existence as a
separate parcel. Without a "nexus" between the need for recreation and
the payment of a fee, such a fee cannot be imposed on the farm lot. To
protect the Town against loss of fees for future development on that
larger parcel the Planning Board could condition the set off upon the
payment of whatever fees may be required upon the development of the
larger lot as a residential parcel whenever, and if ever, that occurs.
3. Pursuant to section A106-38, the payment of the fee could only
be imposed after a finding by your Board that the reservation of a
recreational area within a subdivision is inappropriate. Assuming your
Board determined this set off to be a subdivision under A106-13,
imposition of the fee would still be discretionary and not mandated.
Upon imposition of the fee, I believe that the Town would bound to use
the fee within a reasonable time toward some identifiable recreation to be
located within the vicinity of the parcel subdivided.

4. Finally, the imposition of a $5,000.00 upon my clients, who are
not developers that can pass along these types of fees to their buyers,
would present a financial hardship and would seriously reduce the funds
available to complete their new residence.
We would certainly appreciate any consideration you could grant
my clients on this issue. Both myself and the Grathwohls will be
available to answer any questions you might have at your next work
session.

I am the owner of a parcel of property located on Breakwater Road in
Mattituck. The Suffolk County Tax Map No. is: 1000-106-9-2.3. The parcel
comprises approximately 26 acres and is in active agricultural production.
In 1968,myself and my brother Douglas Cooper, as executors of our
father's estate, deeded a one-acre portion of this larger parcel to my sister Ruth-
Ann Schiavone(formerly"Bartra`). This tnansfer was part of the settlement of
our father's estate. We always intended that Ruth Ann would proceed to
subdivide the parcel for sale as a building lot Ruth Ann subsequently sold the
deeded one-acre parcel to Mr. and Mrs. Grathwohl on January 9, 2001 and they
are finalizing that process.
