Although I do not wish to formally take a position at this time, it would appear from my initial review that your position may, in fact, have a measure of validity. However, by this letter I am asking that you defer any action in regard to this particular matter for a period of ninety days from the date of this letter, during which time I intend to address this both legislatively and otherwise with the Town so that we need not make an exception for your client, but rather address it in a more appropriate fashion. (emphasis supplied) In reviewing the Town Code and Subdivision Regulations, I can find no basis for the Planning Board's determination to exclude from lot area, for minimum lot size purposes, any portion of the property where the slope exceeds 15 percent. A provision of §100-13 defines "Buildable Land" as excluding portions of property having slopes of 15 percent. While the application of this definition to any given lot precludes construction on such portion of the lot having a slope in excess of 15 percent, the definition does not justify excluding such portions of such lot from the calculation of "lot site" (square feet) " as set forth in the "Bulk Schedule for Residential Districts." SCTM# 1000-106-6-13 . 3 Dear Mr. Klein: The Planning Board reviewed the Yield maps dated August 17, 1989, and the Cluster maps dated August 17 , 1989 , for the above mentioned subdivision. The following pertains to the Yield map: 1 . Lot #6 is not an acceptable lot because it does not meet the requirements of the Zoning Code. Therefore, this lot cannot be counted towards the yield for the cluster layout. 2 . All lots must be at least 80,000 square feet excluding any areas where the slope exceeds 15 percent. On lots that include slopes in excess of 15 percent, indicate the area of the lot that is less than 15 percent in slope. The following comments pertain to the Cluster map: i. The area for Lot #13 (Lot #7 on the Yield map) was shown as 9. 1 acres on the Yield map. The area of this lot must remain 9. 1 acres on the Cluster map, The additional land, approximately 1. 8 acres, that is included as part of Lot 13 on the Cluster map, should be shown as open space for the residential development. 2 5 ;, 14 f,IE T rt j ' 2. The layout should be redesigned so that all the lots lie on the south side of the cul-de-sac. This can be done by reducing the lot sizes to 30,000 square feet, or by placing one lot on the west side of the proposed cul-de-sac. This arrangement will afford each lot the maximum view of the open space. 3 . Lot 12 should be designed as a flag lot with access to the cul-de-sac. Lots 11 and 12 would then be required to have a common driveway. As stated in previous correspondence, the Board is requiring that the existing access to Lots 11 and 12 be eliminated, and that future access be over the proposed subdivision road. 4. The bond estimate for the proposed road and subdivision improvements will include the construction of the tap road. Thus, the statement that this road is to be offered for dedication to the Town of Southold for future highway purposes should be removed. Upon submission of revised maps, the Board will proceed with their review. Please contact this office if you have any questions regarding the above. As part of submissions to your Planning Board, our client' s engineering consultant, Young and Young, submitted on December 3rd, 1987 prints of a yield map and prints of a cluster map. On each, there is a parcel consisting of 41, 182 sq.ft. designated with the name "Katherine Erbert. ” In fact, the property is owned by Mattituck Holding Company and occupied by Mrs. Erbert. It was the intention of the owners of the Holding Company sometime ago to convey title to Mrs. Erbert to the subject property on which she has constructed her existing single-family dwelling. Mr. Erbert is the mother-in-law of one of the partners in Mattituck Holding, William Boscola, Jr. who occupies an adjoining parcel. The purpose of this letter is to inquire as to whether the Planning Board will consent and approve of the transfer of title of this parcel to Mrs. Erbert as indicated above, without in anyway negatively impacting the approval process for the overall subdivision. Mattituck Holding Company does, of course, recognize that such a conveyance would constitute a commitment of at least one unit of yield on the subject property.
