Dear Ms. Hefter:
In response to your letter of August 10th (and February
29th) I reviewed the Planning Board's subdivision records to no~
avail. According to the Tax Assessor's office, Grace Lomas'
property is part of an old filed subdivision map (The Cedars,
File No. 421., File Date: July 11, 1906). It is suggested that
you obtain a certified copy of same from the Suffolk County
Clerk's office. Then, compare the metes and bounds property
description of each lot on the map with the most current deed
and survey.~
If the proposed conveyance of "Lot X" incorporates
precisely the same land area and boundary of "Lot X" shown on
the filed map, then your client is free to simply convey
ownership to whomever she so chooses.
If, however, the proposed conveyance does not precisely
match up with "Lot X" as shown on the filed map, then your ·
client will most likely have to file an application for a lot
line amendment. This type of application would be, in effect,
petition to amend a filed map.

I have compared the Assessor's copy of the map which was
hard to read, with the tax map. It appears that Lot 6 may have
been divided at some point and merged with Lot 2.1, which may or
may not be a legal lot. Since this office does not have a
legible copy of the original "Cedars" map and further has no
record of any subsequent amendments, it would be of enormous
help if you could obtain a certified copy of same for our joint
review.
Contact my office when you have obtained the maps and we'll
arrange a convenient time to review them and determine what type
of application your client should place before the Planning
Board.

Dear Valerie:
On February 29, 1988 I addressed a letter to the Planning Board of
the Town of Southold concerning property owned by my client, Grace
Lomas, at Orient, New York. I am enclosing a copy of this letter.
As of this date, we have not received a response from the Planning
Board as to the issue raised in our previous correspondence.
Although the two lots owned by Mrs. Lomas were acquired at different
times and do, in fact, represent separate lots on the Suffolk County
Tax Map, they are held in the same ownership name. The question of
merger has prompted our inquiry as to whether the Planning Board will
require set-off approval prior to Mrs. Lomas' conveyance of one of
the parcels.
I appreciate your' cooperation in advising me, in writing, of the
requirements of the Planning Board at this time.

Dear Ms. Scopaz:
In accordance with your letter of August 18th, I am enclosing a
certified copy of the "Map of Cedars" which was filed on July
11, 1906. I further enclose a copy of a survey prepared by
Roderick Van Tuul, P.C., dated July 31, 1980, showing plot X.
My client, Grace Lomas, acquired title to plot X by deed from
Ezra H. Young dated July 2, 1948, recorded on July 8, 1948 in
Liber 2845 of conveyances at page 520. I am enclosing a copy of
this deed for your reference.
On November 2, 1942 Grace Stephenson Young, a previous owner of
parcel X, conveyed a portion thereof to David L. Gillispie.
This is the portion of property to which you refer to in the
last paragraph of the first page of your letter.
It is my understanding that we will be meeting to discuss this
matter further at your office on Friday, September 16th, at
10:00 A.M. After you have had the opportunity to review the
enclosed documents, should you have any further questions prior
to our meeting, by all means give me a call.
