Dear Mr. Kassner:
On January 13, 1997 we met to discuss the above referenced property, and the impact of
the Town's new Merger law on the property. I am writing this letter to confirm my
understanding of same.
Pursuant to Section 100-24 of the Merger law, the six parcels noted above were all created
by deed during the period from 1962 to 1966, and 2 of the 6 parcels, lot # 22 and lot
#18.1, meet the minimum bulk requirements set forth in Bulk Schedule AA. Pursuant to
section 100-25, the adjacent non-conforming parcels then merged with the conforming
parcels, thereby creating two legally recognized lots: Parcel 1 being comprised of lots #
18.1, 19 & 20 and improved with a single family dwelling; Parcel 2, a vacant lot being
comprised of lots # 22, 21 & 16. Each parcel exceeds the minimum bulk requirements
under the present zoning code. Although one of the front yard setbacks of Parcel 1 does
not conform to the present zoning code, the structure is a pre-existing, non conforming use
and is therefore not required to meet those requirements.
An application for a Pre-C.O. for the residence is pending with the Building Department.
The new Pre-C.O. together with deeds for the newly recognized lots could then be
presented to assessor with a request for the assignment of new tax map numbers.
Please confIrm that this interpretation of thl(, Code is correct. Thank you for your time and
assistance with this matter.
