This property is located in an R-MO Residential Zone District, being
situate along a private right-of-way which ext.ends off t.he the
east.erly side of Little Neck Road. The property as exists contains a
total area of 143,020 sq. ft. (or 3.28 acres) as depicted on the
map prepared by Garrett. A. StJ'ang, Al'chitect, dated July 16, HHl6.
The most northerly portion of the property is improved with an
existing one-story frame dwelling.

(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
b,)cause the applicant desires to create two lots on property that
contains a total of 3.28 acres rather than the 4 acres required for
two lots in this R-80 Residential Zone District.
(3) The requested area variance is substantial in relation to Lot
#1, representing more than a 50% reduction in lot area required for
this R-SO zoning district. However, Lot #2 will exceed the required
minimum lot size. In considering the total area of the parcel and
proposed yield, the variauce is not substantial and represents a 22%
reduction (4 acres to 3.213 acres) in total lot area.
(4) The propose\1 variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
dis trict because Lot # 1 is improved and similar in size and character
to others on the private right-of-way. Lot #2 will be protected by a
covenant to prevent further subdivision to preserve the integrity of
the vacant R-SO Residential Zoned property to the south.
(5) The situation has been self-created.
(6) This action is the minimum tha t the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.

Please find the following comments in response to your memo of December
20, 1996:
1. The Planning Board has not received an application to subdivide the
above mentioned property.
2. The Planning Board questions why the subdivision has been designed
with one small lot of 40,191 sq. ft. in area and one larger lot of
102,829 sq. ft., rather than two more equally sized lots. Is a
restriction prohibiting further subdivision proposed for the larger
lot?
3. Access to the subject property is over the existing travelled
right-of-way. A design with a flag lot with a 15' wide access to the
existing travelled right-of-way is acceptable to the Planning Board.
However, the Planning Board questions whether improvements will be
required to the existing travelled right-of-way as per the
requirements of the Highway Specifications.

SUBJECT: Proposed Division of Land - Mary Tangney at Cutchogue
Current Zoning: R-80 1000-103-5-2.1 (3.4+- acres)
A variance application is presently being processed for the above
proposed division of land at 1703 Little Neck Road, Cutchogue, for
the separation of a proposed nonconformity containing approximately
40,000 +- sq. ft. and retaining the remainder as a single conforming
parcel of 102,000+- sq. ft. Attached is a copy of the proposed
map.
Please let us know whether or not the proposed 15 ft. ROW within
the minor subdivision of the front lot is sufficient, or would the
Planning Board prefer a wider access. The access would be used by
the existing house lot, and the entrance to the vacant lot would be
over the existing traveled ROW from Little Neck Road.
If possible, please furnish your response on or before January 13,
1997. Thank you.

Dear Mrs. Tangney:

The Planning Board reviewed your inquiry in regard to subdividing the
above mentioned property at the March 11, 1996 work session.
The property is located within the Low-Density Residential R-80 Zoning
District. In this district a minimum of 80,000 square feet is required for
each lot.
The lots shown on the proposed subdivision do not meet the minimum
80,000 square foot requirement. The Planning Board cannot proceed with
the proposed subdivision of this property unless approval from the Zoning
Board of Appeals is obtained. In order to go before the Zoning Board of
" Appeals you must first receive a disapproval from the Building
Department. Please contact the Building Department if you have any
questions regarding the procedure.
