BRESSLER 516-298-8353 ABIGAIL A.WICKHAM Septerrber 28, 1981 Southold Tuan Planning Board Town Hall Southold, NY 11971 Re: Edward and Kathryn Rcbedee Pine Tree Road, Cutchogue, NY Gentlemen: Pursuant to the suggestion of Mr. Raynor, I wrote to the Board re- questing that this matter not be required to proceed through formal sub- division proceedings, with a copy to Mr. Tasker. I recently spoke to Mr. Tasker, kho suggested that I write to the Board and request that the division of the property into two lots, as approved by the Board of Appeals by decision no. 2370, be considered as a set off under the new definitional section A106-13 of the Ocde. The lot requested to be set off was approT�;ed as to size and dimension by the Board of Appeals in their variance proceeding in 1977. One of the considerations of the Board was that the size of the lot, although small, conforms to the pattern of lot size in the neighborhood. Tine adjoining lot cannot be further divided because of the location of the house, garage, and driveway, thus its large size omwensates for the insufficient area of the lot in question. Dear Sirs: We represent the Robedees, who own property at Pine Tree Road, Cutchogue, New York, shown on the enclosed survey. In 1977, the Board of Appeals granted a variance to divide the parcel into two lots, one containing the residence, and one vacant parcel containing 17,400 square feet. The Board of Appeals approved the subdivision, and I enclose a copy of the Board's decision. However, the subdivision was ap- parently not approved by the Planning Board under the Grandfather procedure. I would appreciate it if you would consider the subdivision of the property as part of your Grandfathering procedure without the necessity of a formal subdivision application.
