Re: Minor Subdivision for
John Simon Estate
Gentlemen:
I am writing this letter to accompany the formal petition for
minor subdivision in order to explain its purpose.
The minor subdivision is to modify certain family interests in
the farm and not for any commercial venture. There are now ten
people who have interests in the farm. Five are children of John
Simon, who died in 1937 and five are the widow and children of
Charles Simon, a son of John, who died in 1956. The arrangement
is that the five living children of John will acquire ownership in
the residence property on the North Road. The three lots on the
Sound will be conveyed out to junior members of the family.
It is not the intention to make any changes in the farm land,,
which is now in the local agricultural district, and it will probably
remain that way for many years. Certainly, the Simon family is not
in any frame of mind to apply for development or to sell the property.
It will be helpful, however, to modify the ownership in order to
have the title of the residence property in the five senior members
of the family.
I shall be glad to go into more detail at the hearing.

Board at a regular meeting held February 26, 1981.
RESOLVED to approve sketch map dated August 25, 1970 and
amended December 9, 1980 of the minor subdivision of property of
the John Simon Estate located at Peconic subject to the right of
way being shown 25 feet wide and suitable for all weather
conditions, the surface being graded smooth (ruts filled, etc.)
and 6 inches of compacted bankrun sand and gravel (gravel to be
20%) placed for a width of 12 feet.
Upon receipt of your alternate plan, I will submit same to
Mr. Davis for his review.

RE: JOHN SIMON ESTATE at PECCNIC
PROPOSED ACCESS ROAD and R.O.W.
I was able to drive over the proposed road on above date in a vehicle provided
by Mr. Dean.
Toere is an existing farm road in the map R.O.W. which except for the first
100 ft. , runs in a straight line all the way to the wooded area at the
end. ~he road for most of the length is above the adjacent farm land on
both side~, there was no evidence of any sand or gravel on the surface.
In a few p~aces where the truck broke through ice in the ruts the condition
was muddy. Apparently this road is on original ground which could account
for the lower level of adjacent cultivated fields.
To make this existing road suitable for all weather conditions, the surface
should be graded smooth (ruts filled, etc.) and 6" of compacted bankrun sand
and gravel (gravel to be 20%) p~aced for a width of 12 ft. Some maintenance
would probably be necessary after spring thaws. Could see no drainage problemm
with existing gradient.

Proposed Access Road and R.O.W.
I was not able to make a good inspection of the access road. Due to snow cover,
snow fence, drifts, etc., it was not possible to drive over the 15 ft. R.O.W.
shown on the Van Tuyl survey. According to F~s. Bette Mead and Mrs. Simon,
there is an existing farm road in the R.O.W. that has been in use fc~ years
~hey had no information as to the road material except ~hat it was hard packed
and usable for farm equipment.
~his access road would be aDoroxtmately 4,740 ft. in length on one straight
course from ~tiddle Road (Rt. 27) to a single lot on the Sound.
I advised the owners that the R.O.W. would have to be 25 ft. in width, the
roadway 12 ft. and that provision for a turnaround be made at t~ end for
emergency vehicles. Also, that a 25 ft. R.O.W. more or less parallel to the
south side of the single lot should be shown over to the easterly adjoining
property. As to upgrading the existing farm road, I could not tell them today
what additional work would have to be done. I agreed to make an inspection at
a later date when conditions are favorable.
In order to estimate necessary work to have the farm road acceptable, I would
check the following: Type of present material, existing gradient, necessary
added msterial for stabilization, drainage, etc.
