Dear Mr. Raynor: In accordance with your request the staff has examined the proposed subdivision layout for a 11.233 acre tract reputedly owned by Dalchet Corp. and offer the follow- ing comments on the map for your use. The proposed layout appears to be satisfactory provided: 1. All stormwater runoff is retained on-site by adequate drainage structures so that it will not flow into Main State Road. 2. Ingress and egress to Lot 1 along Main State Road and the first 50'± on Harbor Lane is prohibited. From the Town's point of view you may wish to consider the following if you have not done so already: 1. Requiring a short radius curve at the intersection of Main State Road and Harbor Lane to facilitate turns at the corner. 2. Making Lot 2 a panhandle lot rather than creating a landlocked parcel with access by means of a right-of-way. The panhandle strip would provide the lot with actual frontage on the Town road. 3. Requiring a large radius curve at each bend in Harbor Lane to improve the alignment of the road and to help preserve the aesthetic qualities of the road. 4. Developing a plan for the improvement of Harbor Lane at Pierce Drive (See map for one possible solution) . Land needed for highway purposes can be obtained through dedication at this time. RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the subdivision of property entitled Dalchet `Corporation lo- cated at Cutchogue. An initial determination of non-significance has been made. Would you submit to our office a completed application in duplicate along with the filing fee for this proposed subdivision. I have en- closed an application and a copy of the Southold Town Subdivision Code for you reference. Please note Article 106-23 A(2) regarding the filing fee. Because it is the only ingress and egress for the property of Pung with the exception of a cut on the Main Road, an extension of Pierce Drive should be constructed to Town Highway specifications between Lot and Lots 8 and 9 . There is no provision for park and playground but the board would prefer money in lieu of land in an amount to be - determined. The flaglot into Lot 2 should be changed to incorporate the 25 feet into Lot 1 with a right-of-way over same of Lot 2 . When maps are received containing the above the matter can proceed. Y. 11935 Re: Dalchet Corporation to Rakowicz Dear Mr. Cron: At a regular meeting of the Southold Town Board of Appeals held on May 20 , 1976 IT WAS RESOLVED that the Southold Town Board of Appeals GRANT approval of the sale made to Stanley M. and Barbara Rakowicz on January 19 , 1976 . After investigation it was noted that the parcel set off consists of front and rear frontages of 150 feet and depths running to 308 . 31 feet. There is an overage of the size of land sold to Mr. and Mrs . Rakowicz . In terms of area, there is in excess of 45 ,000 sq. ft. of area in parcel conveyed. The >Board also finds that granting the applicant' s request to sell off existing residence with an undersized lot would not change the character of the neighborhood provided that conditions are imposed to assure the maintenance of density requirements of the Town. " The Board finds that strict application of the ordinance would produce practical difficulties or unnecessary hardship; , the hardship created is unique and would not be shared by all properties alike in the inunediate vicinity of this property and in the same use district; and the variance will not c1pnge the character of the neighborhood, and will observe tMe spirit of the ordinance. THEREFORE IT WAS RESOLVED, Dalchet Corporation, Pec1mash Avenue, Cutchogue, New York, be GRANTED permission to set off existing dwelling on lot with insufficient area and frontage on property located on the south side of 'lain Road, Cutchogue, New York, as applied for, subject to the following conditions: 1. That the Dalchet Corporation shall furnish three (3) copies of survey showing .all of the Corporation' s property under a;r_lication as of date of Rehearing of Appeal !,Io. 1809 , May 2 , 1974 , and defining the lot to be set off for sale. 2. Future sales of all, or any part, of the land remaining to Dalchet Corporation shall be approved by the Board of Appeals. The purpose of imposing this condition requir- ing approval of the Board of any future sale is to assure that the substantial area deficit, of more than 20, 000 sq, ft. , created by setting off lot, in the present Action, is compensated for and corrected by increasing the size of any future tract or tracts which may be sold or set off.
