We also will make a statement in general. The planning
Board requires a minor subdivision for the development
of 2 to 5 lots, but we have been informed by our attorney

Dear Mr. Wickham:
We have had an inquiry concerning a building now under construction an Harbor Lane in
Cutchogue. From information are were able to obtain, it seems that this is a private hone
being built by a Mr. Austin on land purchased from Mr. Chet Orlowski.
To answer the inquiry are first need some additional information that we hope you can
furnish to us.
1. Is this lot part of a subdivision? If zoo what is the name of the subdivision?
2. If it is not part of a subdivision, then has many lots have been sold or created from
the main tract of land involved?
3. Is this an illegal subdivision under the provisions of Article VI, Section I of the
Suffolk County Sanitary Code? This section reads as follows:
"A realty subdivision is any tract of land which is hereafter divided into five (5) or
more parcels along an existing or proposed street, highway, easement, or right-of-way
for sale or for rent as residential lots or residential building plots, regardless of
whether the lots or plots are 'to be sold or offered for sale, or leased for any period
of time, are described by metes and bounds or by reference to a map or survey of the
property or by any other method of description."
4. Do you exercise any control over the subdivision of lands on existing road frontage?
People are looking to us to ensure that building will be limited to lots of 400000 square
feet. We all realize that there are many, many building plots of lose than 40,000 square
feet existing on filed maps. However, there mist be soma control placed over the selling
Off of lots an existing road frontage if none exists at this time. It is very difficult
for us to determine the status of these plots. Therefore, we are seeking your advise and
assistance.
If you would like to discuss this problem in more detail, we would be happy to meet with you.
