The Board will require contours and ,&Ievations. An Environmental Assessment Form will be sent for completion. There are five lots in the subdivision so it will have to be a major. Ms. Dowd told of a plan to casual sale one lot and come in with -the rest for a four lot minor. She was told this can't be done as there can only be four lots in a minor subdivision. Mr. Wickham suggested she go to the Board of. Health regarding the chance of having cesspools. Mr. Wickham doesn't feel the necessary space between wells and cesspools is there. Murphy-Raeburn minor subdivision. Laurie Dovid, Attorney, appeared. There has been a court order dividing the property into three pieces. It was originally two in joint tenancy. Mr. Raynor requested that the maps show building setback lines and setback lines from the top of bluff of 100 feet. The 65,000 square foot ✓ lot will require a covenant not to be further subdivided and a notation on the map. There was a question, after reviewing the deeds, that the easterly lot did not have a right-of-way to the road. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to authorize the expenditure of $50 or whatever it may cost to engage Van Tuyl surveyors to provide the Planning- Board with a suggested proposed road from Cummins property east in Orient. Vote of the Board: Ayes: Wickham, Raynor, Coyle Mr. Wickham reported that he had no. yet had a conference with the Town Attorney regarding the proposed division of the Haven Emerson property. Mr. Wickham reported that Mr. Robert Gillispie, Chairman of the Board of Appeals, had called him regarding five different actions the Board of Appeals had taken. They have granted the privilege of dividing into three lots the Hartung property and Mr. Gillispie said something like this wouldn't slip by the Board of Appeals again. In addition, the state SCS has been giving Mr. Wickham a bit of a problem. He needs to repair his dikes and the dikes are the only thing that is keeping salt water off land immediately north of the Village of New Suffolk. The only thing that keeps New Suffolk from having salt water intrusion problems and :if he had failed to make the necessary arrangements, there could be problems not only with that but emergency vehicles Southold Town Board of Appeals -5- April 8 , 1976 "With reference to the above matter scheduled for April 8 , 1976 , I would appreciate it if the Board of Appeals could hold the entire matter in abeyance. Because of what appears to be the overwhelming difficulties we would face with the Department of Environmental Conserva- tion and the Army Corps of Engineers , Mrs . Zebroski is attempting to negotiate a settlement of the two contracts of sale. " On motion by Mr. Gillispie, seconded by Mr. Hulse, it was RESOLVED that the Southold Town Board of Appeals DENY Appeal No. 2100, Julius Zebroski , Bayview Road, Southold, New York because of the difficulties which face the applicant with reference to the Department of Environmental Conservation ,, onservation and the Army Corps of Engineers, and other factors , indicating #at it is not possible for the Zebroskis to apply for a variance within a reasonable length of time. This application is denied without prejudice to future applications . Vote of the Board: Ayes :- Messrs : Gillispie, Grigonis , Hulse, Doyen. Review of Appeal No. 1892 , North Fork Baptist Church, Route 27A, Mattituck, New York, dated April 11, 1974 . The Chairman read the action of the Board dated April 11th, 1974 one of the conditions was that it be reviewed in two years . THE CHAIRMAN: In the absence of any objections to this special exception to expand the ministry to include a youth hostel (no criticism having been received by the Board of Appeals since this use was granted) , the Board feels that it can cease to review this application. Y. 11971 Dear Mr. Wickham: On February 5th, 1976 a public hearing was held on application of Philip J. Ofrias , Jr. , Esq. a/c Julius Zebroski , Bayview Road, Southold, New York. The applicant entered into contract for the sale of two parcels of land in 1965. At the time the contracts were entered into Mr. Zebroski was able to convey that portion of the property described in each contract. He, at that time, also promised to dig a canal behind each property. It is now time to convey the properties but during the ten years since the contracts were signed the Zoning Ordinance of the Town of Southold has set minimum lot sizes . (Copy of sketch and County tax map enclosed) . Copies of contracts are in Board of Appeals files. On February 5th, IT WAS RESOLVED that this hearing on Appeal No. 2100, Julius Zebroski , Bayview Road, Southold, New York shall be recessed until 7 :45 P.M. (E.S.T. ) March 18 , 1976 to allow time for applicant to seek Southold Town Planning Board and Department of Environmental Conservation approval. There were present: Messrs. John Wickham, Chairman; Henry Moisa, Vice- Chairman; Henry Raynor; Frank S. Coyle. Absent was Mr. Grebe. Julius Zebroski minor subdivision. Mr. Zebroski will be informed that he can't make more than one casual sale a year unless he brings his map in for a major subdivision and complies with all the rules and regulations therefor. Gasper Pisacano minor subdivision. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Chairman of the Southold Town Planning Board be authorized to sign the map of Van Tuyl dated March 12, 1974 of the minor subdivision of Gasper Pisacano on property located at Paradise Point Road and Cedar Beach Road, Southold, New York. CVote of the Board: Ayes : Messrs. Wickham, Moisa, Raynor, Coyle. Willow Point Estates , Southold. The following letter dated March 11, 1974 was read. To Mr. Raymond Dean, Superintendent of Highways ' I inspected the roads in Willow Point Estates and found that the repairs called for in my letter No. 103 dated April 23, 1973 had been accomplished. The roads are now in good condition and are in need of no repairs. The amount of drainage seems to be adequate; however, the location of the drainage pipes presents a problem. A Young and Young survey of November 26, 1973 shows the drainage pipe between lots 15 and 16 to be almost completely on lot 15 rather than in the original ten foot easement. According to Mr. George Stankevich, lawyer for Mr. John Szala, the owner of lot 15, this discrepancy was never revealed to him until after the purchase of the parcel had been consumated. (Van Tuyl survey of August 23, 1973 for John Szala does not show the drainage pipe. ) Mr. Stankevich states that his client will not grant an easement to encompass this pipe. In addition, if existing surveyor's marks are true, the pipe between lots 20 and 21 is not in the easement but on lot 21.
