The property referred to as owned by Mr. Henry Zabahonski
has not been before the Southold Town Planning Board for. s.
subdivision of property.
The building inspector will not issue a building permit
until such time as the property is legally subdivided. This
has not been done. If it is the intention of the owner to
set off one piece of property he must come before the Board for
a minor subdivision. I enclose the procedural sheet for same.

Dear Mrs. Brush;
On October 16, 1978, I wrote to your office (copy enclosed)
regarding the purchase of property from the late Henry
Walsh (Henry Zabahonski) on Fishers Island, N.Y.
Your office replied that Mr. Walsh does not have on file
a subdivision plan approved by the planning board.
1iy information indicates that the present 25 .1 acres tract
owned by Walsh, was subdivided and approved for sale of
a one acre lot to N1r. Thomas Duff on Crescent Avenue, in
March of 1074.
Will the Planning Board of Southold approve the division
and sale of an additional one acre lot from the 25 .1 acre
tract adjacent to, and directly east of the Duff property
without new subdivision approval for the entire tract?
Vihat information and procedures would be required by the
Planning Board, so that the sale and purchase of this lot
conforms to PlanninS Board requirements?

on Crescent Avenue adjacent to, and east of Mr.' Thomas. Duff.
This is Lot # 7 and measures 160 X 250 ft. (40,000 square
feet) . According to Mr. Walsh, this lot meets all zoning re--
quirements enabling me to build a home with a minimum of_1200._ : -
square feet. He has indicated that the lot is part of an approved
sub division.
Will you kindly confirm the status of this property .that it.
conforms to all Zoning Requirements, and I will be able to
build on it now or in the future.

Long Island.
Would you be so kind as to provide me written confirmation that this
lot is part of an approved subdivision and that I will have the
ability to build now or in the future. I understand the minimum
square footage of the building structure must be 1200 square feet.

The Planning Board would like to ,bring to the attention
of the Appeals Board the fact that Henry Zabahonski (Walsh)
has withdrawn his proposed subdivision on Fishers Island and
that Mr. Duff, the present owner of former lot #25 on that
proposed subdivision, has met with this Board in an effort
to obtain a building permit on this parcel
Stanley Corwin, Esq. also attended our meeting and
informed this Board that Mr. Zabahonski had informed him that
he would meet the requirements of Section 280A of the Town
Law. He also informed us that Mr. Zabahonski is interested
in presenting a multiple residence petition on this property.
This Board feels that in accordance with past practice "-*Lamm
a "casual sale" can be granted a building permit if access
is acceptable. Access in this case is not acceptable and I
enclose copies of letter from the Superintendent of Highways
on this subject.
Beyond this it would appear to me that this "casual
sale" is open to question since Zabahonski has stated his
intention of making a multiple residence petition.
It would seem to us that a twenty foot crushed stone
base plus paving as suggested by our engineers would be a
reasonable condition under these special circumstances.

on August 26, I inspected the road on Cresent Avenue
on Fishers Island with Mr. Alfred Grebe from the Parsons
proberty ( the end of the town maintained roadway) to
lots 25 of the proposed subdivision of Mr. Walsh, with
a total length of approx. 375' • Dae to the construction
of a home by Mr. Thomas Duff, Jr. on lot 25 it is
recommended that this section of be improved by the
developer as follows:
1. From the easterly line of lot 25 to the end of
the caved section in front of the Parsons property, the

Gentlemen:
In the matter of Zobohonski (Walsh) & Duff, Crescent
Avenue (Private Road) , Fishers Island. Please be advised:
At the Board of Appeals hearing on Thursday, September
12 , they were unable to determine that either Henry Zobohonski
or Thomas Duff had legal right to use the Private Road for
access.
A conditional requirement to improve the road by clearing,
grading and draining, with minimum of 15 ft. width of crushed
stone 3 inches or deeper, to a maximum of 20 ft. width, was
set, on condition that they could prove a right to use of the
right of way.

Gentlemen;
In the matter of Henry Zabohonski (Walsh) property on
"North Hill", Fishers Island, bounded by Fox Ave on the south and
Crescent Ave . -private road- on the north, part of Hay Harbor on the
west, and private owners on east, please be advised:
The lot on SIS of Crescent Ave adjacent to land of Nitze , which
has been sold to Mr Duff can be considered as a "casual sale" as no
other lots have been sold from this property in quite some time .
However this lot with frontage on Crescent ave is far beyond
the Town owned and maintained section of this road. Access to this
lot must be improved to meet requirements of Section 280-A of the
Town Law. The present road is and has been used for many years as
a private right of way, and has constantly deterioated to the point
where it is impassable at times.
Further up North Bill, in front of the former "Wykoff" and
O 'Neil property a small .part of this right of way was paved with
blacktop, even this is1a not wide enough to meet requirements of section
280-A. Beyond this paved section the existing road was ripped up
and bulldozed in places when 'Er. Zabohonski regraded property on both
sides of the right of way to the northerly side of Fox Ave . We issued
a notice to him to not fill in the wetland along the Hay IT arbor section
of his property.

Yesterday I talked with hr Duff, Er Zabohonski and his attorney
Stanley Corwins office, John 'Nickhan, Ray Dean and Henry Raynor about
this matter.
Yr Duff will be at the Planning Board meeting on Aug 26th, I
have advised Attorney Corwin to consult with Mr . Zabohonski and find
out if he will actualy subdivide the property or will make application
for a multiple residence zone with apartments on this prorerty.
