Dear Mr. and Mrs. Jones:
The following action was taken by the Southold Town Planning
Board at a regular meeting held June 12, 1979.
WHEREAS, a formal application for the approval of a subdivision
plat, entitled Minor Subdivision of Thomas and Jean Jones, was
submitted to the Planning Board on March 16, 1979, and an
application fee of $20 was paid on March 16, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application on May 8, 1979 at 7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application except as noted below.
Now, therefore, be it RESOLVED, that the application of
Thomas and Jean Jones for approval of said subdivision plat prepared
by Roderick Van Tuyl, P.C., and dated March 13, 1979, be approved
subject to the following modifications, and that the Chairman of
the Planning Board be authorized to endorse approval on said
subdivision plat upon compliance by the applicant with such modifi-
cations as noted below. However, if such modifications are not
made within sixty days from the date of this resolution, the plat
shall be deemed disapproved.
1. Square footage of lot number 1 should be shown on map.

2. The following recommendations and conditions of the Suffolk
County Department of Planning shall be shown on the map.
a. No sanitary disposal facility shall be constructed
or installed within 100 feet of Wickham Creek or the
edge of the tidal marsh.
b. Any new construction on either lot shall be subject
to acceptable erosion and sediment control requirements
to insure proper control of runoff and erosion during
and immediately after construction on the site.
c. No stormwater runoff resulting from the development
and improvement of either lot shall be directly
discharged into Wickham Creek or onto the tidal marsh
bordering the creek.
d. Establishment of a minimum setback of 100 feet from
Wickham Creek for all residential structures.
Please have your surveyor prepare three maps showing the
above and have them sent to this office. Upon receipt of same in
proper order Mr. Raynor will sign the maps.

Date: June 12, 1979
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part Q17, Section
617.10 and Chapter 44 of the Code of the Town of So~old, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below, has determined that the project
will not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Thomas and Jean Jones is a two-lot
residential subdivision on 2.95 acres at Wickham Creek, Cutchogue,
New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned;
The NYSDEC has no objection to the project and has
made the comment that this parcel lies on the tidal
body of water and a tidal wetlands application will
be required from that Department. Further develop-
ment must be in compliance with the development
restrictions of the Tidal Wetlands Act;
The Suffolk County Department of Health Services
has stated that it is expected that the conditions
will be suitable for water supply and sewage disposal;
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land regulations.

In reference to the above minor subdivisions, this Department agrees with

A cursory review of the properties indicate that the availability of suffi-
cient potable water for the map designated as Old Town Park at Southold is
questionable and should require a test well prior to approval for home con-
struction.
The other minor maps are expected to have conditions suitable for water sup-

We have received your letters requesting lead agency status for the
projects listed below. We have no objections and are listing our comments
for each below:

Minor subdivision of Old Town Park at Southo1d, Catherine
Bitsis -- This project may lie within State jurisdiction
under the Tidal Wetlands Act as it appears to lie within
300' of tidal wetlands. We note that each of the lots
meets the minimum 40,000 sq. ft. requirements. We will
make further review on receipt of application.

Minor subdivision of Peter Sledjeski, Orient -- It does not
appear that this project lies within the jurisdiction of the
Tidal Wetlands Act due to distance from tidal water and ele-
vation.

The Suffolk County Planning Commission at its regular meeting on April 4,
1979, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Thomas Jones", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following conditions that are deemed necessary to help preserve the
natural and aesthetic attributes of Wickham Creek:
1. No sanitary disposal facility shall be constructed or installed within
100 feet of Wickham Creek or the edge of the tidal marsh;
2. Any new construction on either lot shall be subject to acceptable erosion
and sediment control requirements to insure proper control of runoff and
erosion during and immediately after construction on the site.
3. No stormwater runoff resulting from the development and improvement of
either lot shall be directly discharged into Wickham Creek or onto the
tidal marsh bordering the creek.
4. Establishment of a minimum setback of 100 feet from Wickham Creek for
all residential structures.

Due to the narrow width of the rights-oof-way (33') of Old Pasture Road and
Honeysuckle Road it is recommended that a short radius curve (R = 20 or 25 feet)
be required at the southeast corner of the intersection of these roads. Providing
such a radius will facilitate turning movements at the corner and will help to
prevent the encroachment of vehicles onto the shoulder area and onto private
property.

Gentlemen:
In accordance with my recent conversation with
Mrs. Brush, I wish to inform the Commission that we
intend to subdivide a three-acre residential parcel
we own on Old Pasture Road. Cutchogue. Mrs. Brush
has a copy of a 1961 survey map of the property.
We plan to subdivide the property into (1) two
acres on which our house is located and (2) one acre
on the west side. Each parcel will extend from the
street to the waterfront. We hope to sell the two-
acre parcel and retain the one-acre for our own use.
We ask your Commission's approval of this subdivision.
