Present Were: Jack McGreevy, Member James Eckert, Member Dave Bergen, Trustee Lauren Standish, Secretary Absent Were: Don Wilder, Chairman Tom Schlichter, Member Joyce Grigonis, Member Peter Young, Member Jacob Smith, Student Member CALL TO ORDER The meeting was called to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder was absent. REPORTS The members of the CAC accepts, with regret, the resignation of Jennifer Mannino. APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by James Eckert, to Approve the Minutes of May 10, 2006. 2 DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of BASILIO ESPOSITO to extend the existing dwelling by constructing 706 sq.ft. of additional living space on the ground floor, construct a new one-car attached garage and construct a second-story structure over the ground floor level. Construct a 10'X 8' accessory building (shed); install a new sanitary system and install a new pervious driveway. Located: 1745 Bay Shore Rd., Greenport. SCTM#53-4-7 The CAC recommends Approval of the application with the Condition a drywell is installed to contain the roof run-off from the existing dwelling as well as the additions, and a 1 O'non-turf buffer is installed landward of the concrete wall. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of FRANK & ANTOINETTE NOTARO to construct a covered porch with a hot tub and install an in-ground swimming pool with a chain-link fence around pool and rear of the house. Located: 625 Calves Neck Rd., Southold. SCTM#63-7-30.1 The CAC recommends Approval of the application with the Condition of a pervious patio, a drywell is installed to contain the pool backwash, and no large, mature trees are removed. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JOHN & JEAN WEBER to repair/replace the existing bulkhead and dock. Located: 590 Budd's Pond Rd., Southold. SCTM#56-5-17 The CAC recommends Approval of the application with the Condition a 6' non-turf buffer is installed from the property line for approximately 35'-40' to the east. 3 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of JOHN & NINA WINTER to install an in-ground swimming pool, buried propane tank, retaining wall, perimeter pool fence and garden shed, and install drywells to contain the pool backwash. Located: 590 North View Dr., Orient. SCTM#13-1-5.1 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, to TABLE the Wetland Permit application of THOMAS LUNIEWSKI to construct a 4'X 32' dock, 4'X 12' ramp and 6'X 20' floating dock. Located: 470 John's Rd., Mattituck. SCTM#122-3-25.2 The CAC Tables the application because the project was not staked. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of GREGERSEN'S KEEP, LLC to construct a 4'X 34' fixed elevated catwalk with steps secured with 6" dia. pilings, 3'X 15' hinged ramp, and 6'X 20' floating dock secured with 6" dia. pilings. Located: Gull Pond Lane, Greenport. SCTM#35-3-12.6 The CAC recommends Approval of the application with the Condition there is one residential dock on the property. The applicant should supply evidence that the existing docking facility is part of a single separate lot. Vote of Council: Ayes: All Motion Carried CLEAVES POINT CONDOMINIUMS to place approx. 200 cy. of clean beach sand fill to construct dune-like feature in curving area approx. 165' long by 10' wide; install low-profile rock revetment on filter cloth on seaward face of sand fill, using 200-300 lb. rocks in an area approx. 135' long and 8'-12' wide. Located: 2820 Shipyard Lane, East Marion. SCTM#38-7-15 4 Jack McGreevy made an inspection and he recommends Disapproval of the application because there should be no hardening of the shoreline in that area. Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of FRED FRAGOLA to remove the existing dock and wood bulkhead and remove the debris to an approved offsite location; install a 25'X 50' boat slip at the southwest corner of the parcel connecting to Fordham Canal, dredge (-6') below MLW, 1000 +/- cy. of material and bring to an approved offsite location. Install a 5'X 20' cutout off the boat slip in the northwest corner of the boat slip to accommodate a 5'X 20' float with a ramp to provide access for a vessel moored within the boat slip. Restore the natural shoreline vegetation to 1,092+/- sf. of area adjacent to the boat slip and create a vegetated 50' buffer area of non-disturbance and to include a 4' wide pervious gravel path to access the boat basin and shoreline area. Located: 1145 Gull Pond Lane, Greenport. SCTM#35-4-8 The CAC recommends Disapproval of the application because the removal of the bulkhead would cause substantial harm to the canal. The CAC recommends leaving the bulkhead in place, or slightly adjusting, and shortening the length of the dock. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL of the Wetland Permit application of JOAN & HAROLD KIEFER to construct a deck onto the existing dwelling, and for the existing beach stairs. Located: 1115 Terry Lane, Orient. SCTM#14-3-3 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to TABLE the Wetland Permit application of DOROTHY DICKERSON PETERS to construct a two-story, one-family dwelling with attached garage, deck, and steps; install a drainage system of drywells; and establish a 50' non-disturbance/non- fertilization buffer adjacent to the wetlands boundary. Located: 2280 Deep Hole Dr., Mattituck. SCTM#123-4-6 The CAC Tables the application because the proposed house was not staked. The CAC recommends all trees above 8" DBH remain. 5 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of JOHN DILLER to construct a single- family dwelling and sanitary system. Located: 60 Peconic Bay Blvd., Laurel. SCTM#145-2-1.2 The CAC recommends Approval of the application with the Condition the house footprint is moved to the north, in line with the adjacent houses. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the South old Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ROBERT & JACKIE SULLIVAN to renovate the existing residence with additions on the north, west, and landward sides of the existing dwelling. Located: 2715 Nassau Point Rd., Cutchogue. SCTM#104-13-8 The CAC recommends Approval of the application with the Condition gutters and drywells are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to TABLE the Wetland Permit application of DROUZAS REAL ESTATE DEVELOPMENT CORP. to construct a single-family dwelling. Located: 54120 County Rd. 48, Southold. SCTM#52-2-20.1 The CAC Tables the application because the project was not staked. Vote of Council: Ayes: All Motion Carried Moved by James Eckert, seconded by Jack McGreevy, it was RESOLVED to TABLE the Wetland Permit application of GARDINER'S BAY ESTATES HOMEOWNERS ASSOC. to remove the existing 4'X 30' fixed dock, (4) 3'X 20' and (1) 5'X 18' floating docks and (2) existing pilings. Construct a 4'X 12' ramp onto a new 4'X 30' 6 fixed dock with a new 42"X 12' ramp onto re-installed (4) 3'X 20' and (1) 5'X 18' floating docks. Install (1) 5'X 32' and (2) 6'X 20' new floating docks. Re-install (2) existing pilings and install (2) new pilings. Located: Fox Island, Gardiner's Bay Estates, East Marion. SCTM#37-4-18 The CAC Tables the application because the project was not staked. It appears that the proposed dock length is 32' beyond the existing dock. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ALLISON BYERS to replace the existing timber sheathed bulkhead along the eastern section of the subject property with vinyl sheathing and reinforce same with rock armor at the base. Located: 10335 Nassau Point Rd., Cutchogue. SCTM#119-1-14.1&14.2 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of FREDRIC FABIANO & HILDA HUTCHERSON to construct a 4'X 72' timber staircase with platforms down bluff face and 4'X 4' steps to beach at seaward end. Located: 2386 Hyatt Rd., Southold. SCTM#54-1-4 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the Wetland Permit application of DAVID & MARY JANE CASSARO to construct a 20'X 60' in-ground swimming pool with surrounding patio and a 10'X 30' pergola on the northwest side of the pool. Located: 3345 Cedar Lane, East Marion. SCTM#37-7-10.2 The CAC recommends Approval of the application with the Condition the wood wall is continued along the south end of the pool, to the west boundary, as a retaining wall, and a drywell is installed to contain the pool backwash. Vote of Council: Ayes: All 7 Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL of the Wetland Permit application of MELISSA & ARTHUR BEISEL to convert the existing boat ramp to a boat slip by removing existing marine railway and +/-21' and +/-24' north-south sections of existing timber bulkhead; constructing a new +/-22' east-west section of vinyl bulkhead; backfilling the portion of the ramp landward of AHW; and dredging the portion of the ramp seaward of the AHW to a maximum depth of -3' ALW. Widen the boat slip on its easterly side by +/-3' by removing and replacing (in-place) +/-51' section of existing landward timber bulkhead with vinyl bulkhead; removing +/-50' and +/-3' sections of existing seaward timber bulkhead, walkway, and steps; and excavating and dredging the fill area between the two bulkheads to a maximum depth of -3'ALW. Construct new steps and 3' wide walk along seaward side of new +/-51' vinyl bulkhead. Use approx. 145 cy. sand/silt excavated/dredge spoil to backfill ramp and bulkheads, and truck any excess material offsite to an approved upland source. Repair westerly side of boat slip by removing and replacing (in-place) +/-53' section of existing timber bulkhead along westerly property line with vinyl bulkhead; removing and replacing (in-place) +/-38' section of existing seaward timber bulkhead with vinyl bulkhead (to be raised +/-2' to meet landward grade); removing +/-3', +/-30', and +/-10' sections of existing landward timber bulkhead, walkway, and steps; and removing and replacing (in-place) +/-14' section of existing timber bulkhead fronting James Creek with vinyl bulkhead (to be raised +/-2' to meet landward grade). To east of boat slip, remove existing step-down platforms and +/-62' and +/-10' sections of existing landward timber bulkhead; and remove and replace (in- place) +/-63'section of existing timber bulkhead fronting James Creek with vinyl bulkhead (to be raised +/-2' to meet landward grade). SCTM#122-4-24 Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the South old Town Board of Trustees APPROVAL of the application of PETER BENOTTI to Amend Permit #6070 to construct a 3'X 15' ramp leading to a 3'X 66' fixed dock beginning at the edge of the tidal wetlands, a 3'X 14' ramp and 6'X 16' floating dock. Located: 930 Clearview Rd., Southold. SCTM#89-3-11.4 Vote of Council: Ayes: All Motion Carried 8 Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to recommend to the Southold Town Board ofTrustees APPROVAL WITH A CONDITION of the application of LAURA WElL to Amend Permit #4349 to construct a 3.5'X 80' fixed timber dock in place of existing dock consisting of 3.5'X 40 fixed catwalk, 32"X 20' ramp, and 6'X 24' float; remove and replace (in-place) approx. 185 linear ft. of existing timber bulkhead with vinyl; and backfill with approx. 50 cy. of clean sand fill to be trucked in from an upland source. Located: 2760 Village Lane, Orient. SCTM#26-1-20.1 The CAC recommends Approval of the application with the Condition of a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried STEPAN MINAKYAN to Amend Permit #4705 to increase size of the top platform to 8'X 8' and an 8'X 16' deck behind the bulkhead. Located: 2375 Sound View Ave., Mattituck. SCTM#94-1-21 The CAC did not make an inspection, therefore no recommendation was made. The next meeting of the Conservation Advisory Council has been set for Mon., July 17, 2006 at 6:00 PM in the Conference Room of Southold Town Hall.
