G r _ _ L � July 11, 1960 Southold Town Board Southold, New York Gentlemen: This is to certify that the following action was taken by the Southold Town Planning Board at their meeting on July 6, 19601 "Moved by Mr. Unkelbach, seconded by Mr. Young: WHEREAS Harry E. Mason and William M. Beebe have petitioned the Southold Town Planning Board for final approval of their plat known as "Moose Cove" at East Cutchogue, New York; and WHEREAS the SoutholdTown Superintendent of Highways has inspected the plat and found the highways in satisfactory con- dition for reasonable access and in compliance with the Highway Specifications of the Town of Southold, and his report is approved by the Planning Board; and WHEREAS the Southold Town Planning Board, pursuant to due notice thereof, held a public hearing on the matter of approval of the plat at which time all interested persons were given an opportunity to be heard; and WHEREAS the Southold Town Planning Board waives the provisions in the rules and Regulations for the Subdivision of Land requiring park and playground area or cath equivalents Page 2 - Southold Town Board NOW THEREFORE BE IT RESOLVED that the subdivision known as "Moose Cove" at East Cutchogue, New York, consisting of 38.12 acres and owned by Harry E. Mason and William M. Beebe, be approved on the basis that if dedication of the highways to the Town of Southold is not completed within 90 days from this date, performance bond for their completion will be required. The adjacent land is "the commons and open space" for map of Little Neck Properties a major subdivision filed November 30, 1973. 1 have attached a copy of the adjacent subdivision as exhibit B. A 50 foot area was reserved for a road on the Moose Cove subdivision. This land is an unimproved "paper road end" which does not provide access to the adjacent parcel (the adjacent land is private open space). I have marked the road end in blue marker. My clients applied to the building department for a gazebo but they were advised that this "paper road end" creates a front yard and would require a variance. We would like to have this road end discontinued and extinguished since it does not provide access to the adjacent property. My clients would prefer to have this land remain wooded and undisturbed, creating a buffer between lot 6 and lot 7 which are improved properties with existing driveways on Deerfoot Path. Please place this matter on your work session to discuss. Since the map is a Planning Board approved map I believe the discontinuance of the paper road and designation of the 50' x 125' as a buffer would be in your jurisdiction. A resolution by the Planning Board extinguishing the road end as a"street"and making it a buffer may be all the building department requires enabling the owners of Lot 6 and 7 to use their side yard, as the subdivision intended.
