The final public hearing, which was held at 7:30 P.M., was closed. The following resolution was adopted: W~EREAS, Barbara Sowinski is the owner of the property known and designated as SCTM~1000-103-1-20.2, located at the west side of Harbor Lane in Cutchogue; and WHEREAS, this Minor Subdivision to be known as Minor Subdivision for Barbara Sowinski, is for 2 lots on 4.3075 and acres; WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Delcaration on December 18, 1989; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on February 4, 1991; and WHEREAS, all the requirements of the Subdivision Regulations of the town of Southold have been met; and be it therefore, Page 2 Barbara Sowinski RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated October 2, 1990, with the condition that prior to the Chairman's endorsement of the maps that street trees be planted 40 foot on center, along Harbor Lane. The aforementioned Restrictive Covenants shall be enforceable by the County of Suffolk, State of New York, by injunctive relief or by any other remedy in equity or at law. The failure of said agencies or the County of Suffolk to enforce the same shall not be deemed to affect the validity of this covenant nor to impose any liability whatsoever upon the County of Suffolk or any officer or employee thereof. These covenants and restrictions shall run with the land and shall be binding upon the DECLARANT, its successors and assigns, and upon all persons or entities claiming under them, and may be terminated, revoked or amended only with the written consent of the DEPARTMENT. If any section, subsection, paragraph, clause, phrase or provision of these covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid, or held to be unconstitutional, the same shall not affect the validity of these covenants as a whole, or any other part or provision hereof other than the part so adjudged to be or unconstitutional.
