Elizabeth is my daughter. On May 16, 1985 Mike and Beth took title to lot #1 on a filed minor subdivision for Blum & Littell at a price of $27,000. The purchase price was, for the most part, financed with a first mortgage by Southold Savings Bank. Since date of purchase Mike and Beth have both carried extra jobs with a goal of satisfying the mortgage debt so that they could eventually begin to think about building a new home. As of this writing, the debt is now paid through their own efforts and they wish to persue their dream which is typical of all hard working young married families. They have now been advised by the building inspector that notwithstanding the fact that their lot is within an approved and filed subdivision, no building permit can be issued without approval from the Southold Town Zoning Board of Appeals, Trustees and the DEC. Incidentally, Mike and Beth also took the added precaution of obtaining a vacant land certificate of occupancy at the time of purchase. Surely no more cautious approach could have been taken to assure the utilization of a property by a young couple about to make such a major financial undertaking. They also have obtained Suffolk County Health Department approval of the proposed site plan. I personally have a major problem with the dilemna they are now confronted with. Not only because they are daughter and son-in-law but also on behalf of anyone that purchases a legal building plot within an approved and filed subdivision only to find that it is not necessarily buildable at some future date. In Mike and Beths case we are dealing with afour lot minor subdivision with two of the four lots already built on. If the requirement for ZBA and DEC approval is valid, what happens if approval is denied? They can't assume approval is pro forma, for if that was the case why should additional review be required? The very restrictive process of having a subdivision map filed provides for every imaginable approval and review prior to final approval and filing. The public perception of such an approval process, which I ack- nowledge as appropriate, is to assure compliance with the various laws, re- gulations and government bodies that control and dictate that which consti- tutes a legal building plot. Assuming all criteria was met at the time of subdivision approval and subsequent issuance of a vacant land C.O., how can the validity of their lot as a building plot now be withdrawn and/or exposed to additional Trustee, ZBA and DEC approvals? Half or one acre subdivisions properly filed under zoning at the time of filing remain in effect today even though we now have upgraded minimum plot size to 80,000 s.f. The point being made is that once a subdivision is approved and filed, a deal has been made with the public. A buyer is on notice that the town fathers have deter- mined acceptability of the subject subdivision. This determination should not be subject to unilateral retraction. As the situation now exists, Mike and Beth are faced with the delay, expense and, more importantly, the possibility of denial from the government bodies they have been instructed to appear before. In my view this is unfair, if not unjust, to a young couple who not only don't understand why but can ill afford it. While I apologize to the Board for a certain level of ignorance in these matters, and a lack of complete knowledge of its duties and responsibilities, I none-the-less solicit guidance and assistance on behalf of Mike and Beth Lademann in this matter. A plastic 12" cross drain has been installed under the road where fill was placed in the iow area at Lot No. 3. Contours on the map indicate the low area. One C.B, ar L.B. has been placed west of the plastic pipe. AnDarently there is a drainage problem at the pipe crossing. Today the pipe was clear but there was evidence of drainage runoff going over the road, eroding the ~op and south side of the fill. Large areas of the adjacent vinyard drain toward the iow point at the pipe crossing. Another 12" pipe may be necessary. Pipe crossings should have headwalls - end sections can be used instead for a direct flow into the pipe. If the grading has been centered in the R.O.W. the fill at the pipe crossing should be widened on the south side and the pipe length increased. Grading for approximately the first 300 ft. slopes to Stillwater Avenue. Drainage ~unoff from subdivisions into Town roads is not acceptable. Drainage structures should be installed of this intersection. ~be material in this R,O.W., a mixture of sandy loam and some small gravel, appears to be satisfactory for a road base except for the first 50 ft.-~ from Stillwater Avenue and scme of the fill at the pipe crossing. RECOMMENDATIONS: 1. Drainage: a) Install another 12" pipe at Lot No. 3. Use end sections and havea graveled area lower than the inverts at the intake side.
