HIGHLAND ESTATES
DECLARATION OF PROTECTIVE COVENANTS made this 1st day
Augu~t, 1977, by 75 HIGHLAND ROAD CORP., a domestic corporation
with office and principal place of business" at 2 Feeks Lane, La~
tington, New York, hereinafter called the Declarant.
WHEREAS, the Declarant is the owner in fee simple of
the following premises:
ALL"that certain plot, piece or parcel'
of land in the Town of Southold, County
of Suffolk, State of ~ew York, known
and designated as Lots 1 through 39 on
a certain map entitled "Map of Highland
Estates at Cutohogue, Town of Southold,
Suffolk County, N.Y." filed in the office
of the Clerk of the County of Suffolk on
~he 26th day of April, 1977, as Map No.
6537.

WHEREAS, the Declarant desires to make this Declara~ic
setting forth reservations, restrictions, covenants, conditions

and agreements, subject to which the property shown on said map
now held and shall be sold and conveyed.
NOW, THEREFORE, the aforedescribed premises shall be

run with the land:

Definition of lot:

A "lot" is such parcel as is

separately numbered as a lot on the aforesaid map.
2. No lot shall be subdivided, sold or conveyed, ex-
cept as a whole, without the written consent" of the Declarant

and the consent of the Planning Board of the Town of Southold.
3. No lot shall be imprc;ved or have placed or main-
tained thereon any structure other than a single family dwelling,
not to exceed two stories in height with an attached private gar-
age for not more than three (3) automobiles. A two-story dwelling
shall co~tain a first floor area of not less than 1,000 square
feet and a one-story dwelling shall contain a floor area of not
less than 1,200 square feet exculsive of an attached garage, car-
port, open breezeway, patio, terrace or basement.
4. No building or structure shall be.erected on any
lot nor shall the exterior of any building or structure be altered,
except in accordance with the plans and specifications therefore
which have received prior written approval of the Declarant. All
dwellings and structures shall conform to all applicable codes and
regulations .of the .Town of Southold, and no variance thereof may
be obtained without written approval of the Declarant. No part of
any dwelling or garage shall be construct~d on anyone lot within
50' of the front line or 25' of the side lines. Asbestos siding

Two copies of proposed plans and specifications
shall be returned to the owner with such approval endorsed thereon.
If the Declarant shall neither approve or disapprove the plans and

received, the plans and specifications shall be deemed approved
5. No mobile type home or trailer shall be kept, use'
moved or allowed on said premises regardless of the size, with
exception of a boat trailer or camper which shall be stored in
enclosed garage. This restriction does not include contractor',
trailers, etc. when used during the construction of a house', pr'
viding same shall be removed from the premises upon completion '

6. No lot shall be used or maintained for any purpos'
other than a one-family residence. No trade or business shall
conducted on any lot. Specifically excepted' from this restrict

walls, painting, windows, doors and landscaping shall be completed
within one (1) year from the date construction commences. The
Declarant will provide curb cuts in the center of the plot but the
road shoulder to be installed by the Purchaser shall be paved or
black top.
11. The Declarant reserves the right to dedicate all
streets, roads, drainage areas and easements to the Town of South-
aid for highway and drainage purposes.
12. The Declarant has set aside and reserves for recre-
ational area the parcel appearing on the Map of Highland Estates
as "Park" subject to the following conditions:
(a) The Declarant reserves the right to convey the fee
title to the aforesaid "Park" as shown on the filed map as well
as any rights and duties of this Declarant hereunder, to a duly
incorporated assocaition of the owners of the real property af-
fected by these covenants and restrictions.
(b) Each owner of a lot on said map shall automatically
become a member of any property owners association hereinafter in-
corporated. Each lot on the filed map shall be entitled to one
(1) vote in said association.
.,;. (c) The use of the "Park" shall be in accordance with
such rules. and regulations as may be promulgated by the Declarant;
providing, however, that said "Park" is to be left in open space
in its natural state.

(d) The property owners association referred to shall
be .50 organized to assure each owner of the lots shown on said map'

shall be subject to an annual charge for each calendar year and
such amount fixed by the Declarant, or property owners associatio
as successor, not exceeding, however, in anyone year the sum of
$25.00 unless agreed upon by a majority of the lot owners on said;
map. Such charge shall become due on the 15th day of January of
each ,year and shall thereafter become a lien on said property and
shall continue to be such lien until fully paid. Such charge
shall be payable to the Declarant, or the property o\mers associ-

ation, and must be devoted to the maintenance of the "Park" and
other community purposes beneficial to the real property above
described.

located on the southeasterly portion of the aforesaid map and morE
particularly described as follows:
Lying and being at Cutchogue, in the Town
of Southold, County of Suffolk, and State
of New York, designated as 75 Highland
Road Corp. on Map of Highland Estates at .
Cutchogue, Town of Southold, Suffolk County,
New York, filed in the Office of the County
Clerk of Suffolk on April 26, 1977 as Map
No. 6537, said parcel being more' fully de-
scribed as follows:
BEGINNING at a point on the northerly line
of the Main Road (N.Y.S. Rte. 25) at the
southeasterly corner of the premises de-
scribed and the southwesterly corner of
land of Presbyterian Church; running thence
along said land of Presbyterian Church,
North 440 39' 10" l~est, 255.78 feet to Lot
No. 39 on said map; running thence along
said lot South 320 47' 20" \'lest, 51.12 feet
to the easterly line of Highland Road; run-
ning thence along said line the following
four (4) courses and distances: (1) South
570 12' 40" East, 18.99 feet; (2) on a course
to the left with a radius of 463.60 feet, a

14. These covenants and restrictions shall run with the
land hereby conveyed and shall bind and inure to the benefit of
the said parties hereto, their heirs, administrators and assigns
until January 1, 2000, and said covenants and restrictions may be I
enforced by action for damages or injunctions or both until the I
first day of January, 2000. \

, modify, extend, terminate or annul any of these covenants in whol .

16. Invalidation of any of the aforesaid covenants and
restrictions by, judgment or court order shall not effect any of
the other provisions which shall remain in full force and effect.
Failure to enforce any provisions herein contained in any part-
icular.~nstance shall not be deemed a waiver of the right to~o
so as to a~y continuing, subsequent or other violation.
The term Declarant shall be construed as if it read
"Dec,larant, its successors and assigns." ,

Re: Highland Estates at Cutchogue - Inspection of roads, drainage structures,
etc. with regard to acceptance by Town of Southold
Comments:
I. There are some small potholes and surface breaks in Highland Road -
about 12 in number from the State Highway to Bridle Lane.
2. Pavement on Spur Road is in good condition.
3. Crownland Lane pavement has a few surface breaks.
4. Bridle Lane has 4 small pavement breaks.
5. Bridle Court pavement in acceptable condition.
Road paving was done on this project as follows:
Highland Road, first 1200 ft. - pulvermix, seal coat and surface course of oil
and chips completed between 9/22/80 and 11/10/80.
Paving Highland Road Sta 12+00 to Sta 26+00, Spur Road east and west - pulver-
mix and seal coat done between 8/27/81 and 9/26/81.
Remaining pavement on Highland
Court - pulvermix on 11/22/82.

Road, Crownland Lane, Bridle Lane and Bridle
Seal coat, oil and chips not done until
Surface course, oil and chips on all other pavement, except for the first
1200 ft. on Highland Road was done on 9/12 & 15/84.
6. All catch basins are clean to pipe inverts. Man hole "B" casting in
Bridle Lane at end of 30" intake line to R.B. No.2 is covered hy the
surface course. Also, Manhole "A" at intersection of Spur Road and
Highland Road is covered by the surface course.
7. There is a hole in the pavement at C.B. No.8 (Sta 2+00 Lt. side) on
Brindle Lane that might indicate undl;."rmining. There are hurricane tree
limbs on the pavement, both sides, at this location and I could investigate
the hole no further at this time.

Recommendations for corrective work by Mohring Enterprises, Inc., Developers
for this project, prior to acceptance by the Town of Southold.
Correct the potholes and pavement breaks as indicated with asphalt plant mix.
Remove oil and chips from M.H. castings "A" and "B".

I have recently visited this subdivision several other times to see if any further
progress has been made on the punch list dated 9/12/83. 1bday R. Mohring was on the
site with a small crew and equipment.
Grading was underway for the two turnarounds
togehter with cleanup work along the curbs.
work done to date on the punch list.
on Bridle Lane that are to be paved.
Reminded Mohring of the small amount of
'!hE' paTelDent areas for the turnarounds are too small to use pulverm:iJd.ng equipment. I
have agreed to the fOllOWing alternate: Remove topsoil where necessary. replace with
bankrun. place 3" of crushed concrete. 2" of asphalt binder mix wi th oil and stone
chips far the surface. I discussed this with P. Corazzini and the owner on the site
several weeks ago.
'!he only part of the road"system in this subdivision that had the surface application
of oil and chips is the first 1200 L.r. from the State HI-/Y. '!his was done in November.
1980. I would recoll11lend tha t this section also have a surface application of oil and
chips when the remaining road areas are done.

Conunents:
Reference is made to lithe third wearing course" on Highland Road as
mentioned in the Mohring letter of February 21, 1985 to the Planning
Board. This statement is in error. All roads in this subdivision
have a single wearing course only as required. The only additional
surface work done was filling potholes and depressions with asphalt.
The asphalt patch work was necessary due to the long time period,
several years, between completion of the base course and placing
the final wearing course.
The fence (east side) at recharge basin No. 2 that had encroachment
in Lot No. 14 tas been moved.
All other punch list items on this project have been completed and
release of the performance bond can be considered.

indicating the procedure and items to be submitted in order to
dedicate the roads within the above mentioned subdivision.

TOWN OF SOUTHOLD
.
Any person or persons desirous of dedicat ing land for town highway purposes shall be re-
quired to iile six (6) prints of the proposed layout with corrections of such highway with the
Planning Board of the Town of South old 15 days prior to their regular meeting with full details.
The Planning Board shall examine such prints and prepare a written report thereon, containing
ib recommendations concerning the proposed la yout, and file the same with the Southold Town
Buard and one copy to the Superintendent of Highways, together with one print of the proposed
layout. The Planning Board shall retain one print for its files and shall return one print tc.1 '"1
plicant. Thereafter, the To\vn Board shall approve or disapprove such layout and so advise tl1<'
Planning Board and the applicant.
After such proposed layout has been approved by the Southold Town Board. the following"
specifications shall be complied with: _
1. Any person or persons desiring to dedicate real estate to the Town of Southold for high-
way purposes must execute and submit to the To\\-u Board the following: _
a. A duly acknowledged dedication and release. together with the required County Clerk's
recording fees.
b. Proposed consent to the Town Board.
c. Proposed order of the Superintendent.
d. A survey map of the property which shall show the actual location of the highway area
within the highway right-of-way.
e. An attorney's certificate of title and a 11 ahstract of title certified to the Town Board by
an attorney or a $2,000. title policy issued in the name of the Town of Sonthold.
f. A bargain and sale deed with covena nt against grantor's acts in the proper form for
recording in the County Clerk's Office.
The foregoing six documents shall be fastened together in one folder and the dedication and
release shall include the signatures of all fee ow ners. easement owners. mortgages and so forth,
:tnd the attorney's certificate shall certify to such.
2. All highways accepted by the Town as Town Highways mnst he at least fifty (50) feet
III width; such width shall hereinafter be knO\\'n as the bounds of the highway.

on October 12th and 15th. Not included was the first 1200 L.F. of Highland Road that

section of road have another surface application of oil and stone. '!he owner has
refused to do this.

Work to be completed
Comments:
The major item of road pavement work to be finished is
the final application of oil and stone chips amounting to
approximately 15,200 S.Y. The only surface treatment, the
first 1200 L.F. of road pavement, was done in November 1980.
The present stone chip surface is almost non-existent in the
1200 ft. length. I recommend that the surface treatment of
oil and chips be used here when the other pavement areas are
done.
Other remaining work as follows:
1. Install valley gutter at intersection of Highland
Road and Bridle Lane. Will involve removing pave-
ment and replacing with asphalt.
2. Complete patching pavement breaks and areas at
curb and gutters:
Gutters at intersection of Bridle Lane and Bridal
Court.
Gutters at intersection of Crown Land Lane and
Highland Road.
Gutters at C.B.'s on Crown Land Lane.
Pavement breaks on Bridal Lane west of Bridle Court.
Pavement breaks on Bridle Court.
Repair pavement at M.H. on Bridle Lane.
Most of large pavement potholes have been patched
intermittently during the past month. There are a
few minor holes to be repaired throughout.
3. Complete grading shoulders and seed behind curbs
where not done by property owners:
Most of Bridal Lane.
Both turnarounds (No curbs) on Bridle Lane.
Some sections on Highland Lane and Spur Road.
4. Recharge Basins:
Complete grading in R.O.W. access to R.B. No.2.
Regrade R.B. ramp at R.B. No. 2 - erosion on one
side.
Grade slopes at concrete headwall and ramp at R.B. No.1.

Located at Cutchogue
Gentlemen:
Inspection of May 10, 1984 discloses that the above subdivision
is in implurable condition as substantiated by the photos
attached hereto.
To review this subdivision, we direct your attention to the
fOllowing:
1. Sketch plan submitted on January 29, 1974 indicating 46.45
acres for 40 lots and to date 22 dwellings have been completed
and occupied. In addition, there is a requirement for park
and recreation area on the southwest side of Highland Court
which is impossible to designate as such.
2. Maps signed and approved on April 8, 1977.
3. Bond estimate for $200,000 was made and submitted to the
Town Board on November 18, 1975.
4. Bond was issued by the Republican Insurance Company on
July 28, 1976, No. 917249.
5. There have been to date almost 30 inspections on this
subdivision.
6. Letter form the Planning Board on July 7 1979 advising
that the bond expired, copy of letter attached hereto.
7. New bond estimate September 20, 1980 in the amounu of
$370,000.
8. Letter to the Town Board requesting to increase bond from

Our board has received repeated reports of def~ciencies in the road
construction of Highland Estates, located at Cutchogue. This was
discussed at our January 18, 1982 meeting. As a result, the follow-
ing action was taken:
RESOLVED that no building permits be issued to lots located within
the subdivision known as Highland Estates, located at Cutchogue, as
the road construction does not meet Planning Board specifications.
I have attached copies of the field reports, submitted by John Davis,
for your review. We would appreciate receiving any comments you might
have concerning this situation within a ten day period. Thank you for
your anticipated cooperation.

I have recently visited t.hill subdivision several other times to see if any further

Grading was underway for the two turnarounds on Bridle Lane that are to be paved,
togehter with cleanup work along the curbs. Reminded Mohring of the small amount or
work done to date on the punch list.

have agreed to the following alternatel Remove topsoil where necessary, replace vith

locations on Bridle Lane and two locations on Crown Land Lane for a total of
162 L.F. of curb and drop curb.

The following information covers the remaining pavement length of
Highland Road, Crown Land Lane, Bridle Lane and Bridle Court at the
above sUbdivision.
The stabilization (Pulvermixing) was done on November 22, 1982 and
November 2), 1982 by Corazzini & Sons. I was not available to inspect
the work on those dates. The areas covered using plan dimensions and
measuring wheel amount to 8562 S.Y. MC250 liquid asphalt used from
the Corazzini records was 25,020 Gal.
Yield per S.Y. 25020 + 8562=2.92 (Spec. ).00)

The stabilized road areas had been rerolled and some reshaping done
prior to the 27th and were acceptable for the seal coat with sand cover.

No.2. In order to use infonnation shown on the revised R.B. plan submitted by H. Young,
it will be necessary to cut trees on the west side of the recharge basin. The trees
. in question are all within the subdivision properW line. With the trees removed, the
chain link fence can be set 5 ft. from the propert;v line leaving the berm at 10 ft.
in width as agreed with H. Young.
The remaining drainage work, pipe lines and manholes were completed on April 27th.
Manhole castings have not been delivered to date.

Owners fourth curbing subcontractor te date on site ?nd placed curb on sections of
BRINDLE LANE and sections of t.he west end of HIGHLAl'D RD. '!his curb crew appears to
be some improvement over t.he others, but still had to be ordered to do tamping under
curb forms. Also, the wrong size of expansion joint material was used in today's
work. According to the curb foreman, the owner told him to const.ruct the curb
section 18" in depth with a battered face for a 6" tep width 1I1d a 8" bottom width.
This is acceptable. The town standard is a 6" uniform width. '!he expansion joints
used were for the standar:d width. This will cause snaUing and should be looked into
on final inspection.
The drainage crew placed a few lengths of' 3D" corrigat.ed pipe between M.H. Band C
(BRINDLE LANE and R.B. No.2). This work very slow as t.here were no grade st~kes
between M.H.'s (Length of 290 ft.) and grades h3d to be set for intermediate stakes
by the crew.

Curb work continued on BRINDLE LANE today. The right size exnansion joints to fit
the 6" top width and 8" bottom width were used. Curb is now completed on HiGHIAND
RD. Curb to be complet.ed, 400 ft.t at west end of lJRINDLE OOAD and 450 ft.:t at
BRINDLE COURT.
No drainage work today.

construction of Highland Estates, located at Cutchogue. This was
discussed at our January 18, 1982 meeting. As a result, the follow-
ing action was taken:
RESOLVED that no building permits be issued to lots located within
the subdivision known as Highland Estates, located at Cutchogue, as
the road construction does not meet Planning Board specifications.
I have attached copies of the field reports, submitted by John Davis,

Work has been started to complete the remaining roads and drainage systems on this sub-
division. At present, operations are on Crown Land Lane (connection to adjacent
westerly subdivision). Topsoil has been stripned. road base material placed and drain-
age structures set.
Received phone call from owner on November 29th advising that curb would be placed on
Novell'ber 30th. However, when I arrived on the site today, I found thBt some curb had
been pOured on Saturday, November 2tth. '!his situation with the owner (Hr. Mohring, Jr.)
has haDC)ened before. Also, the curb itself looked satisfact.ory, but had been placed on
loose uncompllcted material and probably will show settlement and crack-s in the future.
Curb work was unlerway t.oday under the same conditione - no t~ing under the curb.
Only e small amount of curb placed due to weather conditions. The subcontractor foreman
was ordered to compact the lIubgrade before placing any more curb.

I visited the site today. One ,oayloader and ore dozer were removing and stock-
oiling excess ITI'lterial between ,curbs:. According +0 R. Mohring, he intends to
remove all excess material between curbs now instc~d of the 20 ft. width as
proposed for access.
At nresent there are no LILCO or telephone trlmk line ire taUations beyond EI'ld
of the rresent mvement. Also (from Mohring), LILCO will do the trenching in
the center of the road and will not use any other location. There will be cross
trenching t,o each lot. Telenhone lines go in the sane trench. '!his work scheduled
to start next week and may intefer with the rresent gradi'lg worlr.
Grading nrogress with equioment being used not very efficient, a road grader
should be used.

Access to lots on Highland Road beyond present permanent pavement is not acceptable.
Grading between curbs by former contractors has been Je ft high. Consi derable exca-
vation will have to be done before pulvermixing. This high material is a loose
mixture of sand arrl small gravel and in nearly all areas is not stabilized or
compacted.
'1b provide sui table temporary access for emergency vehicles, etc.. I r econmend the
following:
G~ade to road elevations for a width of say 20 ft. on one curb side of Highlarrl Road
from present pavement to end of curbs and provide a turning area there.
Stabilize those areas for a 6" depth with addition of loam.
Compact with 8 ton roller.
This work could be accomplished now. The operation would have t.o be done anyway
prior to pllvermixing with the excention of rollin;,;. This type of roadway if
properly constructed should be sufficient for a few IIDnths and require 11 ttle
maintenance. An application of Calcium Chloride would be insurance far unraveling
in dry weather.
Curbs are in place to Lot 21 on Highland Read and complete on Spur Road.
According to Corrazzini and Sons, they expect to start permanent p3. vement on

Made an inspection of curb work and recharge basin No. 1 as done to date this year.
Curb has been placed on most of Spur Road and j)'lrtially COnnected to curb on
Highland Road. This curb has been placed on uncompacted s1lbgrade arid Will be
subject to settlement. Aloo, plans call for integral curb and gutter at catch
. basins and around curb radii at intersect.ions. This was not cbne for the above
curb. The gutt.er sections can ho placed later but this wi n not be as satisfactory
as t.he integral met.hod called for. r could not locate t.he curb contrac+~r but
did not.ify the owner via t.elephone as to my commen ts on t.he curbworX.
Grading in the recharge basin is satisfactoFJ, and tile fencing and gate conforms
to the plans and reqlirements of the 'Jbl-ll1. The concrete headwall and aprctl f~r
the outfall line in the recharge basin has not been inst~lled.

all responsibility to the Southold Town Board regarding
subdivisions for which the time to perform under the bond has
expired. What action they will take, if any, I do not know.
