Lind, Chief Planner Suffolk County Department of Planning Veterans Memorial Highway Hauppauge, New York 11787 Re: Crown Land Lane File #S-SD-75-07 Dear Mr. Lind: At a regular meeting of the Southold Town Planning Boar* lfl August 18, 1975 the following action was takWOW RESOLVED that the Southold Town Planning Board reaffirm its action approving the final map of the subdivision known as "Crown Land Lane". The Southold TownPPlanning Board con- curs with recommendation #1 that .vehicular access to Lot 1 shall be restricted to Crown Land Lane. We also agree with recommendation #2 that *ocean to the Main Road be coordinated with the State of Now York requirements. The cross -street (Crown Land Lane and Spur Road) will coonect with the 'proposed Spur Road in the subdiVision immediately to the east, "Highland Estates", which is riot yet in -its final stage. Were the entrance road on the Main Road eliminated, the only access to this&40dhd vision would be 'through "Highland Estates" *Nr6il1 would make a potentially dangerous intersection by the Cutchogue Presbyterian Church should this be the only access. It in the opinion of the Planning Board that the letter from the Suffolk County Department of Planning is not con- sistent within itaelS. Edson, Developer Subdivision Map of Crown Land Lane, Map No. 6289 MADE this 114j'day of May, 1976, by Lefferts P. Edson, residing at (no number) Main Road, Southold, New York 11971, hereinafter called the Declarant; WHEREAS, the Declarant is the owner in fee simple of a certain parcel of land situate at Cutchogue, Town of Southold, County of Suffolk and State of New York, as described in deed made by Crown Land Lane, Inc. to the Declarant dated December 27, 1972 and recorded in the Suffolk County Clerk's Office in Liber 7312 at page 132 on December 28, 1972. WHEREAS, the Declarant has subdivided said premises, which is now known as Map of Crown Land Lane, filed in the Suffolk County Clerk's Office as Map No. 6289, and desires to subject said premises to certain conditions, covenants and restrictions. NOW THEREFORE, the Declarant does hereby declare that said Lot Nos. 2 through 18, inclusive, shall be conveyed subject to the conditions, covenants and restrictions herein- after set forth, and that every purchaser of said premises, by the acceptance of a deed thereto, covenants and agrees that the premises so purchased shall be held subject to the covenants, conditions, and restrictions hereinafter set forth. The following Covenants and Restrictions applying to the construction, maintenance and future care of the property are hereby imposed upon each lot conveyed by the developer: 1. No dwelling shall be erected having less than 1200 square feet of interior living area on the ground floor. Each dwelling shall have a basement of concrete block or poured cement. Each dwelling shall have an attached double garage, the entrance to which shall not face on Crown Land Lane as shown on said map. 2. No above -ground swimming pools shall be erected or maintained on any of the said lots. 3. All plans and specifications for construction shall be subject to the approval in writing of the developer, which approval shall not be unreasonably withheld. There shall be no installation of a "mobile -type" or "modular" home on any lot. 4. No commercial vehicles, recreational vehicles, trailers, or campers shall be kept ungaraged on any lot. Any boat stored on the premises is to be stored along the rear line of the plot, if not garaged. 5. No more than two pets shall be maintained on the premises by any lot owner. 6. No fences, either natural or man made, shall be erected or maintained on any lot in excess of four (4) feet in height. However, no fences whatsoever shall be erected or grown in that area of the front yard of each plot which is forward of a line established by extending the front line of each house to each side line of the plot. Each corner lot shall for these purposes be considered to have a front yard on each street. 7. No title in and to the bed of the roads is to :be conveyed to the lot purchasers. The grantor retains the said title and the right to dedicate and convey the said title to the Town of Southold, as the developer at his sole discretion shall determine. In addition, no title, right or use is or shall be granted by the developer to that parcel of land delineated on the filed subdivision map as "Recharge Basin, Type A." 8. No accumulation of rubbish, garbage, junk or materials of any kind shall be permitted to remain on said premises. No advertising signs, billboards or other sign devices shall be permitted on any of said lots, excepting a developer's sign of reasonable dimensions, or a "for sale", "for rent", or "professional office" sign not larger than 12" x 24". 9. No sand, earth or sod shall be removed from the premises, or excavation be allowed to remain open thereon, except as may be necessary during building construction periods. Individual lot grading shall be completed before occupancy. After construction, lawn and landscaping shall be installed and maintained thereafter in an attractive manner. 10. In order to accommodate proper drainage, the swale area five feet in depth running along the street frontage of each lot shall not be covered with earth, nor seeded, nor have plantings of any manner installed, in order to insure unobstructed and continued permeability of water through the swale area. -2- These Covenants and Restrictions shall expire on .7ant:ary 1, 1995, excepting Numbers 7 and 10, which shall remain as Covenants running with the land. The subdivision was designed at the R-40 zoning density. However, due to the inclusion of Spur Road, Lot Number 12 was reduced in size to 37,729 square feet. All other lots remained at 40,000 square feet or larger. DATE: October 23, 1979 RE: CRO`dNLAND LANE at CUTCHOGUE Corrazzini and Sons.completed the seal coat on Spur Road (East Section) today. Prior to the seal coat, a 21' •blacktop cap for the last ho ft. of roadway had been placed by Corrazzini.. Also, placed were blacktop aprons around the two catch basins installed by the grading contractor' at this location. The road cap was the best method to correct the subbase which was disturbed by the drainage work and then regraded with from 1" to 2" of Those material. The disturbed az'ea was too small to use a pulvermix machine effect- ively. Measured length of road sealed 219 L.F. 876 S.Y. RC-250 (Bit. cutback) E=on - delivered 1550 Gal. returned 1120 Gal. Used 470 Gal. Yield, 430 876 = 0.491 Gal./S.Y. Sand cover rolled with 8 ton roller. Remaining work on this subdivision: Fencing not installed at recharge basin. The westerly section of Spur Road (stabilized top had raveled) was remixed for full width with-400 gal of MC 250. The pavement washout area at the recharge basin (140 + L.F.) was remixed for full width, also a small pavement washout vicinity Lot No. 13. Used BOO gal. of MC250 at these areas. Asphalt pads (121 x 141=' ) have been placed around catch basins at the recharge basin (Sta. llt 30 Rt. and Lt.) An end section has been placed on the discharge line into the recharge basin. Erosion at the R.B. on the west side has been filled in and the excess material removed from the -bottom. the berm here has been widened and made higher. If this berm does not contain the runoff while the C.B.is function, other methods to prevent flooding and erosion will have to be used. An asphalt paved gutter from the road swale into and down the R.B. slope would provide a direct outlet at this main law point in the profile. Roads Most of the pulvermixed road area appears to be in good condition allthough the seal coat has not been placed. 'There is some raveling on Spur Road which will have to be repaired and two pavement areas that will have to be remixed due to washouts. Drainage Catch basins are in place at the main road entrance and at Sta. 11 '-30. Could not find the catch basins at the east end of Spur Road, if installed, they are covered. There is heavy erosion at Station 11 + 30 (catch basin on left and east side of recharge basin). The pipe from this C.B. to the basin has no headwall cr apron. There is also erosion in the swale starting on the right side of the road between Lots 12 and 13 that runs down and across the road into the north east corner of the recharge basin. This runoff has cut through the pavement in two areas and washed out the side of the recharge basin. There are some smaller washes around the sides from the farmland drainage. The bottom is silted and there is about 200 t C.Y. of washout material to be removed. The owner should make the necessary repairs at these eroded areas now. Further delay will worsen the condition. Swales Most -of the swale areas will have to be regraded. Some are eroded from heavy rain storms, others filled in from runoff from the adjacent farmland. Worst m ndition is at both sides of the road at the recharge basin. A solution for erosion at the sides of the recharge basin would be to set the fence in concrete curb. Also, a concrete curb along the outside of the swale for the length of the recharge basin and===the swale paved with asphalt might control the drainage problem there. C.C. Southold Planning Board C. TIME WEATHER The failure at the recharge basin that I mentioned in my Report #254 of April 49 1978 has not been corrected. Since that time two more failures of this recharge basin have occured. The westerly sidewall and the southerly sidewall have been eroded by water draining off the adjacent fields. These eroded ate must be filled in and to prevent reoccurence of this erosion asphalt gutters must be installed. These asphalt gutters must be placed at the points of the erosion. These gutters should penetrate the berm at the top of the basin and lead down the face of the sidewall to the floor of the basin. To correct this condition it will be necessay to install concrete curbing along the length of the recharge basin. Integral curb and gutter should be installed for 10 feet on both sides of the curb inlet. The road surface is to be brought to the face of the curb. 3. The road base, other than the area by the recharge basin, is in good condition and is satisfactory for receiving the oil and sand seal coat. 4. This would exceed the expected 25 year frequency, 24 hour storm peak flow from the estimated 13 acre watershed, (Soil -Cover- Complex Method), if the sand swales failed totally. Apart from the above drainage suggestion I might also point out that if the "park and playground" footage was relocated near the drainage area, and the proposed 10,000 square foot sand drain were placed along the edge of the combined parcels, there would be a much larger open space area for recrea- tion. I do not recommend the use of Swale, or recharge swales, for disposing of storm runoff water in this subdivision area. The soils are generally more than 3 feet deep with silt and silty clay loam over coarse sand and would involve considerable excavation and replacement of sandy material to create the sand swale. Also this site does not provide for easy disposal of excess run- off, such as is required in any swale system plan. BRUER July 9, 1974 Mr. John Wickham, Chairman Southold Town Planning Board Southold, New York 11971 Re: Map of Crown Land Lane, Cutchogue, New York Dear Mr. Wickham: After the final map of CROWN LAND LANE was signed by the Suffolk County Department of Health the map was forwarded to the Suffolk County Department of Environmental Control for its signature. This was some eight to ten months ago. During that period I have made repeated calls and spoken with Mr. Ames and Mr. Risso about progress in the signing of the map. No definitive information was ever given to me about the signing until this past week. When I talked to Mr. Ames he said that the map will not be approved by that authority. Mr. Ames also said that Mr. Risso would write me a letter setting forth the reasons. I have not received such a letter as yet. I asked Mr. Ames the reason for the refusal of the Environmental Control Board to sign the map and his explanation implied that there was a jurisdictional dis- pute between the Board of Health and Environmental Control. I asked him about the special committee that was set up to consider cluster plans which I understand is now functional. He stated that Crown Lane Lane would not go before this new committee for the reason that my map antedated the creation of the Board. In any event, I could not see any reason for the refusal of Environmental Control to consider my map other than the fact that a jurisdictional dispute exists in which my map is the pawn. It seems to me that all of the authorities in the County are for cluster zoning except for Environmental Control. Discuss- ions between the two agencies have been going on for some time, and have recently come to head because I understand that there are about fourteen cluster plans before the Sewer Agency for approval. Within the last week, Mr. Ames of the Sewer Agency advised me that they had met with the supervisors of the eastern towns and that as a result a decision was made by the Sewer Agency to consider the cluster applications on an individual basis. In order to consider the cluster applications on an individual basis, it was necessary for the Sewer Agency to set up standards to be used in their consideration of each, which are more or less as follows: 1. Actual square footage per lot and compliance with the distance requirements for wells and cesspools. 2. The characteristics of the soil underlying the sub- division. 3. over-all density of the lots and the open spaces. 4. Proximity to creeks and There are other standards that m but these were the principal one subdivision, including the bays. y be added to the above list, given to me by Mr. Ames. I feel that ultimately, approval of Crown Land Lane will be received.
