Box 1083 Cutchogue, NY 11935 Re: Request for site plan waiver for furniture store located on property of William Smith, Rt. 25, Cutchogue SCTM# 1000-102-6-18.1 Dear Mr. Lang: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, February 10, 1997: WHEREAS, this property has an approved site plan dated March 27, 1979; and WHEREAS, William Smith is the owner of the property known and designated as SCTM~ 1000-102-6-18.1, located on Rt. 25 in Cutchogue; and WHEREAS, William Smith has given his approval to Cod Lang to lease the easterly building on his property for a retail furniture store; and WHEREAS, a furniture store is a permitted use in this Hamlet Business (HB) zone; and WHEREAS, Town Code Bulk Schedule requires 20,000 square feet of property per use; and WHEREAS, the subject property is 1.08 acres and has had four pre-existing, conforming uses: restaurant, real estate office and two residences; and WHEREAS, the proposed change from a residence to a fumiture store will not Page 2 Site plan waiver for Cod Lang February 11, 1997 exceed the four pre-existing uses on this property; and WHEREAS, the furniture store would require five parking spaces; and WHEREAS, an examination has been made of all uses and the existing parking was determined to be adequate for all uses; and WHEREAS, the ground floor will be used for fumiture sales and the second floor for storage; and WHEREAS, the specific items of merchandise to be sold are referenced in a letter dated January 28, 1997 and signed by Mr. Cori Lang; and WHEREAS this waiver is granted with the condition that if the above is not met, this waiver can be revoked at any time; be it therefore RESOLVED, that the Southold Town Planning Board grant a waiver of an amendment to the site plan. I do not call it a shopping center (Chapter 100, Section 62.) This is in B-1 Zoning, Chapter 100, Section 70° The existing dwellings are non-conforming, as dwellings are no longer permitted in any business zone. Since this is not a shopping center, the dwelling, store and restaurant use, does not need site plan approval as per Article XIII. Referring to Off-street parking Chapter 100, Section 112, restaurants need one space per five seats. The plan shows enough parking for the restaurant and the addition if it is used as restaurant. For the use as store, reasonable and appropriate off-street parking shall be determined by the Planning Board. The parking area screening shall be approved by the Planning Board. This parcel of land is zoned "B-l" General Business and is irregular in shape, consisting of .766 acre, containing 105.65 feet of road frontage and an average depth of a little over 300 feet. Due to the size and shape of this parcel and the location of the buildings thereon, the existing on-premises parking areas and exit driveway are not adequate, especially when the restaurant is crowded. Your petitioner is the contract vendee for the adjoining parcel which is described in paragraph 1 above which contains .352 acre with 100.25 feet of road frontage and a depth of 150 feet. Your petitioner is requesting that this parcel be zoned "B-l" General Business so that when combined with petitioner's existing restaurant premises, will have a total of 205 feetof road frontage and will provide satis- factory egress and ample off-street parking areas for the petitioner's restaurant as well as the proposed gift shop on the easterly portion of the premises. It is your petitioner's intention to eliminate the existing garage and the 1½ story frame building on the westerly portion of these premises as shown on Exhibit 3. In its place petitioner in- tends to construct additional paved parking areas with a wide drive- way exit to the Main Road, all as shown on Exhibit 4. This plan will enable your petitioner in the future to be able to change the entrance to the restaurant from the rear to the easterly side of the building thereby providing a more convenient, access to and from the parking areas to the dining room. It is also your petitioner's intention to completely restore the 1½ story building located on the easterly por- tion of the premises as shown on Exhibit 4, which is presently in a state of disrepair, and to renovate same t6 an attractive gift shop which will be an accessory use to the complex. When completed the restaurant will have ample off-street parking areas as well as an exit driveway with excellent visibility. As shown in Exhibits 1 and 2, the property is bounded on the north by Main Road (State Route 25) and immediately across this road the property in the vicinity from Griffing Street to Depot Lane is zoned "B-l" General Business District. The property is bounded on the east and south by land of John Wickham which is presently used as a fruit farm and for retail sales of farm products. The property to the west of petitioner's restaurant property is also zoned "B-l" General Business District. The parcel is well-suited for the proposed business use in that its present use is non-conforming for two residences due to the size of the parcel, and the existing buildings located thereon are in a state of disrepair. The proposed plan of the petitioner will improve the property as well as provide ample off-street parking areas and an~ improved exit for the restaurant premises. The proposed plan will pro- vide an attractive addition to the business section of Cutchogue and will be in conformity with the Comprehensive Development Plan of the Town of Southold.
