Field inspection of Seven Eleven located at Cutchogue
SCTM# 1000-102-5-24
A field inspection was conducted on the above referenced
property on December 3, 1991, to determine if the site was in
compliance with the approved site plan of March 14, 1984.
The following items were not in conformance with the approved
plan:
1. Approved plan shows seventeen (17) parking spaces, the
inspection showed 14 spaces. (Three of the original 17 spaces
are being used for handicapped parking and are included in the
present 14 spaces.) The six parking spaces adjacent to Route 25
are parallel to Route 25 instead of vertical as shown on the
approved plan.
2 The sign location is to the east of the entrance
instead of west as shown on the approved plan.
3. The fence on the west side of the property is chain
link instead of wood as indicated on the plan. (This is unclear
on the plan, as it shows both wood and chain link?)
4. The ZBA decision of May 2, 1985 says that the
storage building must have a set back not less than eight (8)
feet from the westerly property line. The storage building is
Ten (10) feet from the west property line, however, the concrete
foundation which is twelve inches above ground level is only six
feet from the property line.
5. The dumpster which is located in front of the
storage building is not shown on the approved plan.
6. The gate on the east side of the property was unlocked
to permit access to emergency vehicles, however I believe the
gate is locked at night to prevent vandalism. (I mentioned to
the manager that this gate must be unlocked at night for
emergency use.)
I believe that most of the above are minor deviations from the
approved plan. (The signed approved plan is missing from the
file.) The approved plan did not show handicapped parking, three
of the 17 spaces were converted for this use. . ~

WHEREAS, a public hearing was held and concluded on April ll, 1985,
concerning the Matter of the Application of COLGATE DESIGN CORP.; and

Station, Inc., both adjoining property owners;
WHEREAS, the board members have personally viewed and are familiar
with the premises in question as well as its surrounding area; and
WHEREAS, the board made the following findings of fact:
1. The property in question is located in a 'B-l' General Business
Zoning District, is situated at the north side of Main Road (S.R. 25),
Cutchogue, and is more particularly identified on the Suffolk County
Tax Maps as District 1000, Section 102, Block 05, Lot 24.
2. The subject premises consists of an area of 26,117 sq. ft.
with a lot width of 99.08 feet and is improved with one, one-story
masonry building set back approximately 90 feet from the front property
line along the Main Road, from the westerly side property line 18½ feet
(exclusive of fence enclosure), 17 feet from the easterly side property
line (exclusive of portable dumpster), and 130 feet from the rear
property line.
3. Applicant is proposing by this application to construct a
10' wide by 12' deep accessory building for storage of empty bottles
and cans, necessary since the recently enacted New York State bottle
law, and will be utilized in lieu of the portable dumpster,
(which is to be relocated either to the north of the proposed

westerly side of the existing store with a setback of eight feet.

In considering this application, the board has determined:
(1) that the relief requested will not change the character of
the neighborhood; (2) that the relief requested will not be
detrimental to adjoining properties; (3) that by this proposal,
the easterly yard area would be left open for accessibility by
emergency (and other) vehicles; (4) that the interests of
justice will be served by allowing same as noted below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, that the relief requested under Appeal No. 3323
in the Matter of the Application of COLGATE DESIGN CORP. for
permission to locate 10' by 12' accessory building for the
purposes of storage of empty bottles and cans with a setback
of not less than eight feet from the westerly side property
line, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS:
I. The westerly sideyard be not less than eight feet;
2. That there be no protrusion of the subject building
into the frontyard area;
3. That the subject building be used only for storage
purposes (and not additional business sales area);
~/ That the easterly side yard must be open and
unobst"~ucted (except with an unlocked gate) to allow egress
and ingress for emergency and other vehicles, or this variance
will automatically be deemed null and void.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen, Douglass and Sawicki. This resolution was adopted by
unanimous vote of all the members.

The following action was taken by the So~thold Town
Planning Board, Monday, March 18, 1985.
RESOLVED that the Southold Town Planning Board recommend
that the proposed storage building be located in the rear of
the existing 7-11 building as previously recommended on
July 9, 1984.
It was also requested that the chain-link fence and guard
rail on the easterly side of the builddng be removed and replaced
with a gate in order to open the access for emergency vehicles,
provide access for the proposed storage building, and eliminate
the existing violation to the site plan.

The board made the following findings and determination:
This is an appeal from a Notice of Disapproval dated April 5, 1984
of the Building Inspector for which a permit to construct accessory
building was disapproved under Article VII, Section 100-71, Bulk and
Parking Schedule, due to an insufficient 7' sideyard setback from the
easterly property line. The building is proposed to be 10' by 12' in
size for storage of bottles and cans, necessary since the N.Y.S.
"bottle" law became effective.
The premises in question is located in the "B-l' General Business
District and contains an area of 26,117 sq. ft. The premises is
improved with one, one-story masonry building set back approximately
90 feet from the front property line, from the westerly s~de property
line 18½' (exclusive of fence enclosure), 17' from the easterly side
propertY line (exclusive of dumpster), and 130' from the rear property
line. Abutting the premises on the east is "Kull's Gas Service Station,"
on the west, a law office, and on the north, Cutchogue East School.
In viewing the premises and the surrounding properties, it is
the opinion of the board that the 120 sq. ft. storage building could
be placed in an area that would not block the only accessible side
yard. The fencing constructed at both side yard areas limits the access
for emergency vehicles; and this safety factor is one of the major con-
cerns of the board.
In considering this appeal, the board has also determined: (1)
that by allowing the variance as applied, a detriment may be caused

Dear Ms. Pascucci:
Following a field inspection of the 7-11 stores at
the above mentioned locations and review of same
at the Planning Board meeting of July 9, 1984, the
Planning Board makes the following recommendation.
It was the consensus of the Board that the proposed
accessory buildin~ should be located in the rear
of the stores. It was also suggested that a leanto
could be constructed in the rear of the stores rather
than the utility building in order to provide more
storage.
