Dear Ms. Folts:
The following took place at a meeting of the Southold Town Planning Board on Monday,
June 24, 2002.
The final public hearing was closed.
WHEREAS, James F. Grathwohl & Emily G. Victoria & The Cutchogue Fire District are
the owners of the properties known and designated as SCTM#1 000-1 02-6-1 0 & 11
located on New Suffolk Road in Cutchogue; and
WHEREAS, this proposed lot line change is to subtract 28,880.975 sq. ft. from a
68,880.975 sq. ft. lot, SCTM#1 000-1 02-6-1 0 and add it to a 93,360 sq. ft. parcel,
SCTM#1000-102-6-11; and
WHEREAS, a final public hearing was closed on said subdivision application at the
Town Hall, Southold, New York on December 17, 2001; and

Subdivision Regulations of the Town of Southold have been met; BE IT THEREFORE

authorize the Chairman to endorse the final surveys.

Gentlemen:
The Cutchogue Fire District (hereinafter referred to as
"CFD") is the owner of a 2.143 acre (93,360 square feet) parcel
of land located at 355 New Suffolk Road, Cutchogue, Town of
Southold, Suffolk County, New York (SCTM #1000-102.00-06.00-
011.000. CFD has owned this property since 1957 and located
thereon are two aluminum storage buildings, a wood tournament
tower and timber planter. CFD utilizes this property for
storage, parking, tournaments, drills, and events.
On August 31, 2001, CFD entered into a contract to purchase
28,880.975 square feet (.663 acre) from its adjoining southerly
neighbors, James F. Grathwohl and Emily G. Victoria (hereinafter
referred to as Grathwohl/Victoria), subject to approval of a lot
line change by the Southold Town Planning Board. CFD wishes to
acquire this additional parcel for the purpose of expanding its
storage facilities, and the chain link fence along the northerly
boundary line of this parcel will be removed.
The adjoining parcel (SCTM #1000-102.00-06.00-010.000)
presently contains 68,880.975 square feet (1.581 acres) and the
sale of 28,880.975 square feet (.663 acre) will allow Grathwohl/
Victoria to retain a parcel of 40,000 square feet (.981 acre)
which is in conformance with the Hamlet Business zoning of their
property, and CFD will increase its present parcel containing
93,360 (2.143 acre) to 122,240.975 square feet (2.806 acres).
The properties of CFD and Grathwohl/Victoria as well as the
proposed lot line change are shown on the survey by Stanley J.
Isaksen, Jr. dated 07 September 2001.

WHEREAS, a final public hearing was closed on said subdivision application at the
Town Hall, Southold, New York on December 17, 2001; and
WHEREAS, the South old Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of South old
have been met; BE IT THEREFORE
RESOLVED that the Southold Town Planning Board grant conditional final approval on
the undated surveys, received by the Planning Board on October 30, 2001, and
authorize the Chairman to endorse the final surveys subject to fulfillment of the following
condition. This condition must be met within six (6) months of the resolution:

[IDSTORY: Adopted by the Town Board of the Town of
SouthoId 12-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
fi 58.1. Providing notice of public hearings.
Whenever the Code caHs for a public hearing, this section
shaH apply. Upon determining that an application is complete,
the board or commission reviewing the same shaH fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shaH provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shaH be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shaH be set back not more than ten
(10) feet from the property line. The sign shaH be
displayed for a period of not less than seven (7) days
immediately p~ing the date of the public hearing.
