Gentlemen:
This is in reply to your letter dated August 25, 1983
requesting clarification of the certification dated July 25,
1983 for the above.
The certification was made after a review of the site
plan dated June 8, 1983 under Zoning regulations.
The purpose of mentioning the appeals was to make your
Board aware that the Special Exception was approved as required
and that conditions were imposed.
Off-street parking requirements are required on the same lot
under Art. XI, Sec. 100-112 H. Lot #22, with proposed addition,
does not allow room for off-street parking, therefore, a variance
was necessary to use lot #23 A & 23B as shown on site plan. Here
again, this was mentioned to make the Board aware of the require-
ment and that a variance was granted.
The proposed addition further reduces front and side yard
setbacks. A variance will be required for this reduction.
Through conversations I have had with Mr. William Peters
in this office, the Cutchogue Library plans to acquire property
to the rear of their lot; this will be needed to allow expansion
of building to the rear of the present building. Since there
is no indication of how much property will be acquired it is
difficult to make a comment on lot area. The Bulk Schedule for
B-1 Zoned property requires a minimum area of 30,000 sq.ft.
The lot width requirement of 150'-0 would be difficult to meet
however.

Dear Mr. Peters:
At a meeting held by the Planning Board, Monday, Sept-
ember 12, 1983, we reviewed and discussed correspondence
from the Building Inspector's Office regarding clarification
of the certification dated July 25, 1983.
It was the concensus of the Board that this site plan
be held in abeyance until the approvals necessary for this
site plan are granted by the Zoning Board of Appeals. It
was also noted the proposed plan encompasses property not
presently acquired by the Cutchogue Library, and Gary Flanner
Olsen had contacted the Planning Board Office regarding the
filing of an application for a set-off in the near future.

Gentlemen:
Subject premises is located in the B-1 Light Business
District and proposed use is permitted by Special Exception
by the Board of Appeals (Art. VII, Sec. 100-70 B (1)(a)).
The lot is existing and is non-conforming in area and
width. The existing building does not meet code requirements
for front, side and rear yard setbacks, Art. VII, Sec. 100-71,
Bulk Schedule.
The proposed addition will reduce front yard and side
yard setbacks further than now exists with the covered walk
and vestibule as shown.
Board of Appeals action No. 3111, dated July 8, 1983
approved the use of this premises under the Special Exception
requirement. The conditions under this appeal did not allow
any further side yard reductions and that entrance/exit
shall not be located on the east side of the existing building.
Off-street parking requirements are to be determined by
the Planning Board per Art. XI, See. 100-112 and shall com-
ply to sub-sections B, C, D, E, and B. Under sub-section H
of this section the Board of Appeals granted a variance under
Appeal No. 3112, dated July 8, 1983 to permit accessory off-
street parking on lots "23A" & "23B" as shown on the site
plan dated June 8, 1983, to increase area for library use.
This certification is made in accordance with Art. XIII,
Sec. 100-113 C relative to zoning regulations.

The original purpose of this meeting was to clarify questions

The public hearing on this application was held on August 31, 1983,
at which time the hearing was declared closed pending deliberations.
Upon application of CUTCHOGUE FREE LIBRARY, Box 935, Cutchogue,
NY for a Special Exception to the Zoning Ordinance, Article VII, Sec-
tion 100-70(B) [1] (a) for permission to use proposed addition for
library use at premises known as 28735 Main Road, Cutchogue, NY;
County Tax Map Parcel No. 1000-102-05-22 and part of 23.
The board made the following findings and determination:
This is an application for a Special Exception pursuant .to
Article VII, Section 100-70(B) [1] (a) of the Zoning Code of the Town
of Southold to establish library use of proposed additions at the
rear and easterly side of the existing brick, one-story structure.
Libraries are conditionally permitted by Special Exception approval
in the following zoning districts: "A-Residential and Agricultural,"
"M-Light Multiple-Residence," "M-1 General Multiple-Residence,"
"B-Light Business," "B-1 General Business," "C-Light Industrial"
and C-1 General Industrial." The parcels in question are located
in the "B-1 General Business" District.
The premises as exists contains an area of approximately
5,000 square feet, 50' frontage along the North Side of Main
(S.R. 25) Road and has an existing open sideyard area on the
east of approximately 7.8 feet and on the west 4.7 feet, along
a concrete sidewalk. The easterly side of the subject premises
is used for access to the rear blacktop parking area for both
the subject parcel and the parcel adjoining same on the east
(now of R. Lark), w~ich is improved with a one-story frame
building which is set back approximately 19' from the
present westerly side line, inclusive of the ll-foot wide black-
top driveway area and eight-foot sideyard area open between the
driveway and the "Lark" building.
Applicant has simultaneously with this application filed
an application for a variance for permission to construct the
above-noted additions with reductions in side and front yard
setbacks, respectively 1.8' and 15.3'. The reduction along the

a covered walk and vestibule, with guardrail, fencing or other
physical barrier separating the pedestrian area from the vehicles
passing through the adjoining driveway. At the rear of the
existing library building is proposed a 47' by 42.5' wide addi-
tion, which encroaches over the rear property line of this par-
cel as exists at the present time, (see Site Plan of June 8, 1983).
On September 16, 1983 applicant filed an application to
the Southold Town Planning Board for consideration of a two-lot
division, which would increase the size of the library parcel
from 5,000 to approximately 15,117 square feet, and decrease
the size of the adjoining parcel on the east, presently owned by
Richard F. Lark, Esq., from approximately 36,430 to 26,309 square
feet. The subdivision as proposed would deepen the library parcel
from 100 to 300.37 feet; however, the width would be unchanged
except for the triangular-driveway easement of 345 sq. ft. at the
southeasterly side. To date, an area variance pertaining to the
lot area in this proposed division has not been filed. The status
of the subdivision application of the library and Mr. Lark before
the Planning Board as of this date, to the best of our understand-
ing, is that same is being held in abeyance pending Zoning Board
of Appeals' decisions on the within Special Exception and variance
for the proposed additions.
Pursuant to Sections 1323, et seq. of the Suffolk County
Charter, this matter was referred to the Suffolk County Planning
Commission, which recommended that "the west side of the build-
ing should be considered for library access with an unimpeded
two (2)-lane driveway to the rearyard parking area .... "
It is the opinion of this board that the use as may be
conditionally permitted by Special Exception pursuant to the
zoning code should be denied without prejudice pending a deter-
mination on any and all pending or proposed variance applications
directly related to this application, since allowing this Special
Exception as applied would not be in compliance with the standards
provided in the zoning ordinance, which is necessary in view of
this application.
It is also the opinion of this board that the special
exception permit be denied without prejudice since the proposed
Main Side Entrance along the one-lane driveway (for two established
businesses) in this ~om~ercial district may endanger public safety;
that is, individuals in passing from the parking area to the front
areas of any of the businesses in this district, whether it be the
library, or the adjoining premises, or the Fruit Farm across the
highway, may perhaps decide not to go through the covered entrance
of the library, thereby using the one-lane driveway area. The
board upon personally visiting the site did find upon entering the
driveway a "blind spot" in the driveway area when proceeding to
the rear of the building. Also, for the record it is noted that
these premises are located within 500 feet of a public school,
playground, and busy commercial dis%rict.-' ' ~
In passing on this application, the board has considered
items (a) through (1) of Article XII, Section 100-121(C) [2] of
the Zoning Code. ~'
Now, therefore, on motion by Mr. Grigonis, seconded by Mr.
Goehringer, it was
RESOLVED, that Appeal No. 3109, the application of the
CUTCHOGUE FREE LIBRARY for a Special Exception, be and hereby
IS DENIED WITHOUT PREJUDICE.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

have fee title to the required parking under the ordinance;
b) proceed with the Zoning Board of Appeals for a variance
under Section 100-121 (B).
With regard to your third paragraph on expansion, we
would need definite metes and bounds description of title
to pass for this parking lot so that the Building Inspector's
Office and this Board would be in a position to certify your
proposal.

Southold Town C~od~, there does not appear to be any specific
requirement for a structure which is identified as a separate
law office. In Section 100-112, the two closest references
are ~) accessory professional office, r~quiring three spaces,
and.'b) professional office of physician or dentist requiring
five spaces for each hysician or dentist. After subdivision
of Mr Larks property, he will have parking for 20 cars.
The Cutchogue library, when complete~, will occupy approx-
imately 3300 square feet and will have seating for 20 adults,
12 chidren, and 3 staff. At a ratio of 1 parking space for each
5 seats, 7 spaces will be required. Actual parking available
will be for l'3'~ar~.
Prior to the rearward expansion of the ~ormerJcourthouse
building, Mr. Larks property will be subdivided and we will have
title to our. portion of the parking lot.
Deed restrictions will allow for common use of the driveway

In September, 1981 the Cutchogue Free Library
purchased the former Southold Town Com~thouse on Maim. Road
in, Cutchogue for the purpose of relocating the. Cutchogue Free
Library after appropriate modification and expansion.
Simultaneously, agreement was reached with Mr. Lark for the
purchase ef part~ of his property adjoining for expansion, and
off-street parkingaa well as widening an existing driveway.
Thi~ purchase agreement was later modified to a five year
lease with an option to bu~, pending approvals by the Planning
Board, the Board of Appeals, and the Building Department..
