THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON APRIL 24, 1990:
RESOLVED that the Town Board of the Town of Southold hereby
authorizes a refund of $8,200.00 to McNulty-Spiess, attorney for the
applicant for proposed major subdivisions of the Kaloski Farm, which sum
represents the filing fee of $4,900.00 for major subdivision no. 25, and
$3,300.00 for major subdivision no. 26, whereas the applicant has
withdra~vn both applications and the Planning Board advises that their
office has only expended approximately 3-4 hours on initial review and
design layout of the aforementioned proposed subdivisions.

Dear Mrs. Terry,
The Planning Board reviewed your correspondence dated March
29, 1990 in reference to the reimbursement of the filing fees
for the above mentioned subdivision.
The Planning Board and staff worked approximately 3-4 hours
on initial review and design layout for the aboVe mentioned
subdivision. A request was made for a revised layout, which
involved the above mentioned parcels and a third adjacent
parcel, owned by a separate party. Their only response to the
Planning Board's request has been the request for the
reimbursement of the filing fees.

The Planning Board has received notice that the applicant
for the above mentioned subdivisions wishes to withdraw both
applications.
Please schedule the reimbursement of filing fees in the
amount of $8,200.00 for the next Town Board meeting. The filing
fees were processed on March 21, 1989. There are two separate
parcels involved, thus two separate application fees were
submitted. One was major subdivision No. 25 which was for
$4,900.00 dollars, and the other was major subdivision No. 26
which was for $3,300.00 dollars.

Frances Zelinski wo~_il_d like to withdraw the aforementioned subdivision applica-
tion and wo~_~_~_d like her.filing fee in the sum of $$,200.00 returned to her.
The Planning Board and Melissa Spirro (hereinafter referred to as "the Board")
have sucessfully diss~_~_oded the Kaloski Family from subdividing their property.
The Board received the reasonably proposed plan by the Kaloski Family to sub-
divide their property, reviewed it, and then completely disregarded it. The
Board proposed its own plan that effectively makes the project prohibitive for
the Kaioski Family.
The Knloski Family has resided on the North Fork for generations. They are a
family of farmers that have worked the land since the early 1800's. In fact.
Mike Kaloski and his son, Pq~!, still farm the land. As I am sure the Board
knows, farming is not a very profitable way to earn a living. Hence, the
K_a_!oski Family's decision to subdivide their property provided them with an
opportunity to earn money commensurate with the amount of sweat and tears the
family put forth over the last 150 years. This opportunity was snuffed by the

The Board flrst disregards the Kaloskt proposal by its request for a "buffe~'
~l_ong Alvah' s Lane. This buffer wo. lri cost the Ko_lnski Family well over
$100,000.00 in road work before even one lot co. lrl be sold. As you know, the
Kal_oski Family is not a poweofd investment group from New York City, but are
poor fa~ners Just trying to sell their property. They are not sophisticated
financiers nor do they have the education or experience to finance the project
as proposed by the board. They simply want to make a profit as others have in
this Town. There are many subdivisions in Southold Town that are laid out just
as the Kaloski Family proposed. Why the Board has requested a buffer zone is
beyond comprehension.
The Board also disregards the location of the existing b~_~_!l_dtngs on the
property along with the location of lots and the grades of the property.
Also, the Board has requested 3/4 acre lots in an area designated as 2 acre
zoning. The Kaloski' s plan provided for 30 one acre saleable lots while
donating approximately 30 acres of"open space" to the Town. Again. why the
Board wants to decrease the proposed 1 acre per lot to a 3/4 acre per lot ts
beyond comprehension.
As stated earlier, the Kaloski' s are a poor family. The Board's actions with
respect to the above subdivisions have flnanctn_l_ly prohibited the Koloski
family from subdividing their land. Therefore, in all fairness, the Kaloski
Family requests the return of their J~e of $8,200.00.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project

The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
· Full EAF Components: The fuji EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an mpact is likely to be cOnsidered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

in the aforesaid agricultural lands owned by the Estate of Sophie Kaloski
comprising 55 acres, at a sale price of $9,075.00 per acre; said property
located at west side of Alvah's Lane, Peconlc, New York, SCTM No.
1000-102-0u,-006.1 and 109-01-0221t.1,; and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is
authorized and directed to give notice of such acceptance to the Estate

or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
