The Planning Board and Melissa Spirro (hereinafter referred to as "the Board") have sucessfully diss~_~_oded the Kaloski Family from subdividing their property. The Board received the reasonably proposed plan by the Kaloski Family to sub- divide their property, reviewed it, and then completely disregarded it. The Board proposed its own plan that effectively makes the project prohibitive for the Kaioski Family. The Knloski Family has resided on the North Fork for generations. They are a family of farmers that have worked the land since the early 1800's. In fact. Mike Kaloski and his son, Pq~!, still farm the land. As I am sure the Board knows, farming is not a very profitable way to earn a living. Hence, the K_a_!oski Family's decision to subdivide their property provided them with an opportunity to earn money commensurate with the amount of sweat and tears the family put forth over the last 150 years. This opportunity was snuffed by the stroke of a per~ HcNULTY - SPIESS March 13, 1990 The Board flrst disregards the Kaloskt proposal by its request for a "buffe~' ~l_ong Alvah' s Lane. This buffer wo. lri cost the Ko_lnski Family well over $100,000.00 in road work before even one lot co. lrl be sold. As you know, the Kal_oski Family is not a poweofd investment group from New York City, but are poor fa~ners Just trying to sell their property. They are not sophisticated financiers nor do they have the education or experience to finance the project as proposed by the board. They simply want to make a profit as others have in this Town. There are many subdivisions in Southold Town that are laid out just as the Kaloski Family proposed. Why the Board has requested a buffer zone is beyond comprehension. The Board also disregards the location of the existing b~_~_!l_dtngs on the property along with the location of lots and the grades of the property. Also, the Board has requested 3/4 acre lots in an area designated as 2 acre zoning. The Kaloski' s plan provided for 30 one acre saleable lots while donating approximately 30 acres of"open space" to the Town. Again. why the Board wants to decrease the proposed 1 acre per lot to a 3/4 acre per lot ts beyond comprehension. As stated earlier, the Kaloski' s are a poor family. The Board's actions with respect to the above subdivisions have flnanctn_l_ly prohibited the Koloski family from subdividing their land. Therefore, in all fairness, the Kaloski Family requests the return of their J~e of $8,200.00. Very.tru~ yours, . W/r.r.rAM C. I THE "SET OFF" APPLICATION FOR THE 7.789 ACRE PARCEL This application is to proceed as a minor subdivision, not as a set off. Upon receipt of a revised application and application fee, the Board will proceed with their review of the subdivision. A minor subdivision application is enclosed for your assistance. II PROPOSAL FOR SCTM# 1000-102-4-6 The yield map submitted is not in proper form. The map must be revised to include the dimensions of all lots, and also the land area for drainage purposes. o The Board is not in favor of the cluster map submitted. The Board requests a cluster layout, with lots reduced to 30,000 square feet in area, as shown on the enclosed sketch (note that the sketch is for concept purposes only, and is not drawn to scale.) As noted above, the yield map is not in proper form, thus the yield of the parcel has not been determined. The cluster layout must reflect the number of lots allowed by the yield map. The Board has reviewed the topography map for the site, and requests that the cluster layout be designed in order to avoid development in the drainage swale and the low areas. Lots numbered 1 and 2 are located off of Alvah's Lane on the enclosed sketch. However, since both pieces of property, SCTM# 1000-102-4-6 and SCTM# 1000-109-1-24.1, are under the same ownership, the Board requests that these two lots be located on SCTM# 1000-109-1-24.1, rather than on SCTM# 1000-102-4-6. In this manner, a buffer along Alvah's Lane will be established. III PROPOSAL FOR SCTM# 1000-109-1-24.1 The yield map submitted for this proposal is also not in proper form. The map must be revised to show the dimensions for all lots. e The Board is also not in favor of the cluster layout submitted. The Board requests a cluster layout, with lots clustered to 30,000 square feet in area, as shown on the enclosed sketch. The cluster layout must reflect the number of lots allowed by the yield map unless the two lots from SCTM# 1000-102-4-6 are to be included. It is unclear from the map as to your intentions for the existing farm buildings on the property. Please clarify; if they are to remain, a subdivision of the property encompassing the structures from the remaining larger parcel may be in order. Upon receipt of the items/revised maps as mentioned above, the Planning Board will proceed with their review. Please contact this office if you have any questions regarding the above, or would like to set up a meeting with Melissa Spiro to discuss the requested revisions. e/~e~y tr y u s Bennett Orlowski, Jr. ~ Chairman enc. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. · The full £AF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is id;ntified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. Verification I certify that the information provided above is true to the best of my knowledge. Signature ~-'~-~,,~/~:~p/g/) '~,~/~Z/~__~ · Title If the action is in the Coastal Area, and you are a state agency, complete the Coastal Assessment Form before proceeding with this assessment. 5 i~rt 2--PROJECT IMPACTS ANI~EIR MAGNITUDE ''' '' Responsibility of Lead Agency General Information (Read Carefully) · In completing the form the reviewer should be guided by the question: Have my responses and determinatio s been reasonable? The reviewer is not expected to be an expert environmental analyst. · Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant. Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simply asks that it be looked at further. · The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the thresh~old of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. · The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. · The number of examples per question does not indicate the importance of each question. · In identifying impacts, consider long term, short term and cumlative effects. /. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (column I or 2) to indicate the potential size of the impa.ct. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshold is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART 3. e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderate impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible. This must be explained in Part 3. IMPACT ON LAND 1. Will the proposed action result in a physical change to the project site? E]NO E3YES Examples that would apply to cbJumn 2 · Any construction on slopes of 15% or greater, (15 foot rise per 100 foot of length), or where the general slopes in the project area exceed 10%. · Construction on land where the depth to the water table is less than 3 feet. · Construction of paved parking area for 1,000 or more vehicles. · Construction on land where bedrock is exposed or generaUy within 3 feet of existing ground surface. · Construction that will continue for more than I year or involve more than one phase or stage. · Excavation for mining purposes that would remove more than 1,000 tons of natural material (i.e., rock or soil) per year. · Construction or expansion of a sanitary landfill. · Construction'in a designated floodway. · Other impacts 2.
