Dear Mr. Reinhardt:
The following took place at a meeting of the Southold Town Planning Board on
Monday, May 24, 1999:
The final public hearing which was opened on December 14, 1998, and held
open until May 24, 1999, was closed. The following resolution was adopted:
WHEREAS, Richard Reinhardt is the owner of the property known and
designated as SCTM# 1000-102-4-5, located on Alvah's Lane in Cutchogue; and
WHEREAS, this minor subdivision, to be known as minor subdivision for Richard
Reinhardt, is for 3 lots on 20.3995 acres; and
WHEREAS, proposed lot #1 is for a total of 16.6060 acres, of which the
development rights have been sold to the Town on 14.6060 acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on November 16, 1998; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on May 24, 1999; and

WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold will have been met upon fulfillment of the following conditions; be it
therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated April 12, 1999, and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. All
conditions must be met within six (6) months of the date of this resolution:
The Declaration of Covenants and Restrictions must be revised in
accordance with condition Number 2 below, and must be recorded in the
County Clerk's office. A copy of the recorded document just be submitted
to this office.
The Cutchogue Fire District, in a letter dated November 15, 1998,
recommended that a fire well be installed for the subdivision. The location
of the fire well must be indicated on the final subdivision map. The fire
well must be installed by the developer, and conveyed to the Fire District,
prior to the issuance of any building permits for the lots within the
subdivision. The condition in regard to the issuance of building permits
must be included in the Declaration of Covenants and Restrictions.
The Park and Playground fee of $6,000.00 ($2,000.00 per vacant lot)
must be submitted.
Final maps (five paper copies and two mylars) must be submitted. All
maps must contain the liber and page number of the recorded Declaration
of Covenants and Restrictions and a valid stamp of Health Department
approval.

DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION, made the ~ day of July, 1999, by
RICHARD REINHARDT, residing at no# Main Road, P.O. Box 603,
Laurel, N.Y., referred to as the Declarant.
WHEREAS, the Declarant is the owner of certain real
property situate at Alvah's Lane, Cutchogue, Town of
Southold, County of Suffolk and State of New York, more
particularly bounded and described as set f~Yth in Schedule
"A" annexed hereto, and
WHEREAS, the Declarant has made application to the
Planning Board of the Town of Southold for approval to
subdivide the said real property into three (3) parcels in a
subdivision known as Subdivision Plat for Richard Reinhardt,
and
WHEREAS, for and in consideration of the 9ranting of
subdivision approval, the Plannin9 Board of the Town of
Southold has deemed it to be in the best interests of the
Town of Southold and the owner and prospective owners of
said parcels that the scenic vistas from Alvah's Lane be
maintained, and as a condition of said approval, the
Planning Board has required that the within Declaration be
recorded in the Suffolk County Clerk's Office, and
WHEREAS, the Declarant has considered the foregoing and
determined that the same will be for the best interest of
the Declarant and subsequent owners of said parcels.
NOW, THEREFORE, THIS DECLARATION WITNESSETM:
That the Declarant, for the purposes of carrying out
the intentions above expressed, does hereby make known,
admit, publish, covenant and agree that the said premises
herein described shall hereafter be subject to the following
covenant which shall run with the land and shall be binding
upon all purchasers and holders of said premises, their
heirs, executors, legal representatives, distributees,
successors and assigns, to wit:
1. DECLARANT agrees and consents that there shall be
no visual obstruction (including but not limited to a solid
fence, hedge or trees) erected along the Alvah's Lane
frontage described in the following course in Schedule A
attached hereto:

degrees 35 minutes 51 seconds West 730.24 feet to land now
or formerly of Best.
2. The owners of each building lot shall be
responsible for construction of driveway and apron from the
boundary line of the lot across the Town of Southold road
way (or right of way) to the paved road. The owners of Lots
2 and 3 shall construct and maintain driveways which do not
conduct runoff generated by new site improvements on such
lot onto the existing Town roadway, or shall install
drainage on such lot as necessary to prevent such runoff.
Installation of such driveways, aprons/or and drainage shall
not be the responsibility of the Town of Southold.
3. Prior to issuance of a building permit for
construction on Lot 2 or Lot 3, Declarant will install a
fire well on or near Bridle Lane as required by the Planning
Board, or obtain a waiver of same from the Planning Board or
the Commissioners of the Cutchogue Fire District.
4. These covenants and restrictions can be modified
only at the request of the then owner of Lot 1 with the
approval of a majority of the Planning Board of the Town
Southold after a public

FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant- The question of whether an action may be significant is not always easy to answer. Frequent-
[y, there are aspects of a project that are subjective or unmeasuraabie, it is also under~tood that those who determine
significance may have little or no formal knowledge of the environment or may not be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project
or action.
Full EAF Component~ The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic proiect
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potent!ally-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentia~ly-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

Gentlemen:
I would like to request/hat you waive the requirement for a fire well in connection
with the final approval of this subdivision. As you know, I have provided for a total of
three dwelling units on over 20 acres. The Cutchogue Fire Department has asked that I
provide a fire well for only two of/hose dwellings, so that there will be a fire well in
place to service/he Highland Estates subdivision. There are approximately 21 lots in that
subdivision which are within/he 1500 foot radius of this project which my fire well
would benefit.
The Fire Department has advised me that it has imposed a moratorium on its
installation of fire wells until it is determined whether Suffolk County Water Authority
will be installing mains from which fire protection could be obtained. I have been
advised by Herman Miller,/he Deputy Operations Director of SCWA,/hat it has no plans
or intentions of extending public water to Highland Road. Therefore, in order to
properly service all the homes in/he subdivision, the Fire Department will have to install
a fire well or wells further South. If they located a well in/he central portion of/he
subdivision, it might well service all of/he homes in/he subdivision as well as a portion
of Crown Land Estates. A fire well on my property would only extend to the homes in
/he northern portion of Highland Estates, whereas a fire well in the middle could extend
/he full radius of 1500 feet in all directions. It seems unfair to require me to expend over
$1~,000 for my two homes when (1) it will benefit a great number of homes whose
developer was not required to provide fire wells; (2) the Fire Department's own criteria
for ending its moratorium has been met, and (3) a fire well in/he central portion of the
subdivision would benefit a great many more homes.
I further call to your attention that my property is bordered by the Kaloski and Long

Mr. Orlowski: Good evening. I'd like to call this meeting to order. The first
order of business, Board to set Monday, January 11, 1999 at 7:30 p.m. at
Southold Town Hall, Main Rd., Southold, as the time and place for the next
regular Planning Board meeting.

PUBLIC HEARINGS
Mr. Orlowski: 6:00 p.m Richard Reinhardt - This minor subdivision is for 3
lots on 20.:5995 acres. Proposed lot #I is for 16.6060 acres of which 14.6060
acres are pending the sale of the development rights. The proposed

subdivision is located on the northeast side of Alvah's Lane, 287:5 feet north
of Main Rd. in Cutchogue. $CTM# 1000-102-4-5. I'll ask if there are any
comments on this minor subdivision?
Dorothy Carlson: I live on a contiguous proper~y. I'm looking on the
subdivision map which I was able to pick up from the Planning Board. I just
wanted to be sure that there was no road intention of going across from
Alvah's Lane over to Bridle Lane.
Mr. Orlowski: No, that will just be to access those two lots off of that cul-de-
sac.
Ms. Carlson: Is the cul-de-sac to remain? Because the original map, there
was in intention to eventually I would regain my property from my cul-de-
sac. But now it doesn't look like it, yet I'm still paying taxes on that piece,
and what can I do with it? Nothing.
Mr. Orlowski: Yeah, the access from the cul-de-sac will just be that, an access
for the two lots. The cul-de-sac itself, I don't know how that could be
changed.
Ms. Carlson: There are plenty of dead-end streets that are (inaudible) dead-
end streets, rmjust concerned...what's happened already is that people
that are using that farm road keep cutting my corner closer and closer and
closer and I'm afraid if that cul-de-sac stays the way it is, they'll continue to
do that. I'm not real crazy about it because we have small children in that
area and there are at least 15 small children in that area and they come
shooting out and you really can't see. If they were made to go a little slower
because it's not so wide open, it would slow them down and I Just think it
would be a little safer.
Mr. Orlowski: Well, this should pretty much end the thought of ever
connecting to Alvah's Lane and as far as the cul-de-sac goes, I'm not sure
how that works out legally. I see you have the lot to the south or to the
north?
Ms. Carlson: Number 19.
Mr. Orlowski: t97 Well, your lot line runs through the cul-de-sac there
somehow, so maybe you can talk to Ray Jacobs and see what he says about
it, because rm sure they don't want to maintain all that cul-de-sac either, so
maybe he can work out something with you.

Ms. Carlson: Well, it never gets plowed. It's really kind of a dead space there.
Mr. Orlowski: That would be for the Highway Superintendent to discuss it
with him and see what they would allow. I know they might not fix it
themselves but might allow you to cut it off.
Ms. Carlson: OK, thank you.
Mr. Orlowski: Any other comments on this subdivision?
Gall Wickham: Abigail Wickham for Mr. Reinhardt. I just wanted to review a
few things that the Board had asked. I submit the affidavit of posting and
mailing, that I'd like to submit for the record, together with a copy of the
Declaration of Covenants and Restrictions that address first the restriction of
planting along Alvah's Lane, or hedges or fences, and secondly the concern
that Mr. Richter had about the driveways from lots 2 and $ not generating
any road runoff into the Town road and that the driveway aprons not be the
responsibility of the Town of Southold. And those covenants, I think, satisfy
that.
I also would like to submit to the Health Department notice that indicates
the only items remaining in order for them to sign the map are the
submission of a covenant asking for the...since the water passed, just a
standard private well covenant and filing of the map. All the other items
have been completed. So that is going to be addressed immediately.
Mr. Orlowski: How long before you have these two items?
Ms. Wickham: We havejust been advised as to the covenants. They will be
delivered to the Health Department. They have to be signed by Mr. Blakie
because he is technically the owner, and delivered to the Health Department
for County review. In terms of actually getting the signed map, I'm not
going to venture a guess as to when the Health Department will do it. I
would guess two to three weeks, optimistically, to be honest with you.
Mr. Orlowski: If need be, we can hold a special meeting or do it at one of our
work sessions since it's a public meeting.
Ms. Wickham: I appreciate the Board's accommodations here. We're under a
very heavy time...in fact we have to have it done by January 1 and we're
going to have to submit a request for a further extension from these people
to get all this done. Realistically, knowing the Health Departments schedule
over the holidays, I tell you it's going to be...

Mr. Orlowski: There's nobody there now. They left already. Well, we'll hold
the hearing open.
Ms. Wickham: OK, subject to getting the signed maps from Health. The
other thing I wanted to mention was on the firewell, Mr. Reinhardt has
spoken to the fire commissioners and if they can come with some other
better alternative, they will waive a firewell, but at this point it does seem to
be a requirement until we can find some other way (inaudible)
Mr. Orlowskh Are there any wells on AIvah's Lane?
Richard Reinhardt: There's a well on Alvah's Lane. They meet tomorrow
night and one of the things we're going to talk about is access from Alvah's
to the two lots, for fire. Also and eight inch agricultural well on the property
that I'm going to fix up and put a new motor on, that I told them they can
have use of any time, so between those...
Mr. Orlowski: Well, I don't see them getting access off of Atvah's Lane for
those two lots. I would come off of Bridle Lane and everything is much
easier.
Mr. Reinhardt: Unfortunately, Crown Landing and Highland, that whole
subdivision, is only serviced by one firewell, so I think I'm going to be
supplying the other.
Mr. OrlowskJ: Well, I think you could probably make a good pitch in the fact
that you're preserving 14 acres there or 16, whatever it is, and you're only
adding two lots and you said you have a well there, so you might want to try
that.
Mr. Reinhardt: Thanks.
Mr. Orlowski: Good luck. Anyone else, any comments? Hearing none, any
questions from the Board? I think we probably should hold It open until we
get everything else.

that due to the property access and the location of other nearby wells, it will be necessary
to install a Fire Well for the subdivision. Attached herein is a copy of our well
requirements for the developer.
The Board also suggests that the developer contact the Suffolk County Water
Authority to discuss any plans they may have for public water supply in that area. If a
hydrant were located in the subdivision, it would satisfy our requirements.

Specifications for Fire Wells in the Cutchogue Fire District
The well is to be the gravel filter type by developing the
natural formation surrounding the well screen. The well shall
have a casing of not less than 8" inside diameter, full weight
wrought steel drive pipe. The well screen shsll be stainless
steel and shall have an open ~lot length of not less than 28'
Upon completion of setting of screen the well is to be developed
until no further sand enters the screen and until gravel-filter
wall surrounding the screen is stabilized at the ultimate
pumping capacity of the well.
The well is to be figured at a length so as to have 20' of
Water above the well screen. The quality and the quantity of the
discharge shall be approved by the Board of Fire Commissioners.
If more depth is required, state additional cost per foot. If
the location is required to be changed, the time lnvQived
installing the original casing and the recovery thereof shall ~e
paid by the Cutchogue Fire District and shall be stated at the
rate per hour. If additional screen is required, th~ additional
cost is to be stated per foot.
All electrical wires are to be terminated above .ground into a
District approved electric receptacle. Electrical outlet box to
be pipe nippled to well casing, and be supported by steel bracket
welded to well casing. Outlet box to be fastened to bracket with
stainless steel screws so that it does not swivel on conduit.
The well is to be painted red and white as directed by the
Fire District.
Fire Well A is to be equipped with:
20 H.P., 3 Phase, Submersible Pump capable to deliver
4.00 G.P.M. at 10 P.S.I. discharge at center of tee at
top of well. Pump shall be of the submersible turbine
type, equipped with grease-packed bearings in bowl
assemblies. The bowls shall be of a smooth finish
design to guide the water from one stage to the next
with a minimum of turbulence.
Top of the well is to be finished off with an 8" x 4"
well seal, 4" galvanized tee and plug, and 4" x 4}#
solid brass ferrule and cap. The hose threads and
hydrant wrench nut shall conform to the standards of
the Cutchogue Fire District.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned. The proposed project is a three lot subdivision, which is significantly
less than that allowed under the current zoning. The project minimizes the
potential impact of development of the property and preserves a significant
amount of agricultural land/open space.
The Planning Board has received correspondence from the Suffolk County
Department of Health Services (SCDHS). The SCDHS has no objection to the
Planning Board's designation as lead agency. The SCDHS noted that the
applicant must comply with the requirements of the Suffolk County Sanitary
Code and relevant construction standards for water supply and sewage disposal.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections

3. Environmental and Planning Considerations
The parcel has been inspected and environmental references concerning the site and area have
been consulted. The site consists of 20.3995 acres of agricultural land in the hamlet of Cutchogue
in the Town of Southold. The subject site is located on the east side of Alvah's Lane, 2,873 feet
north of Main Road (NYS Rte 25). The site has approximately 760 feet of frontage along
Alvah's Lane and Bridle Lane ends at the northeastern property boundary. The site can be more
particularly described as SCTM number 1000-102-4-5. Them is a frame ham on the site, and the
project sponsor wishes to subdivide the parcel into 2 approximately 2 acm lots, with a third lot
having an area of 16.61 acres, to build 3 single family homes.
The site is zoned Agricultural Conservation (A-C), which would require lot sizes of at least
80,000 s.f., or just slightly less than 2 acres each. This would permit construction of up to 10
homes on the property. The applicant is seeking to subdivide the parcel into two approximately 2
acm lots with a third lot having an area of 16.61 acres. Access for the large lot will be from
Alvah's Lane and from Bridle Lane for the remaining two proposed lots. The houses are
expected to be large, but not to exceed 80 feet by 40 feet based on the Long EAF, Part 3. The

applicant has indicated that the project will only disturb approximately 6 acres of land, with the
remaining 14.3995 acres preserved under the Non-Development Area.
The land use in the vicinity of the site is predominantly residential to the east, with agricultural
land to the north, south and west. Low density Residential A (R-80) zoning is found to the south
and east of the site, with HD residential fmther to the east. The surrounding properties are zoned
Agricultural Conservation (A-C). The parcel is presently used for agriculture, with corn grown
on the majority of the southwestern portion oftbe overall site.
The subject site is relatively flat, with approximately five percent of the parcel with slopes of
between 10-15%. The property does not contain any other significant landforms. Throe types of
soils are present on the site; Plymouth gravelly loamy sand (ProC3); 8-15% slopes, eroded,
Haven Loam (HaA); 0-2% slopes, and Riverhead sandy loam (RdB); 3-8% slopes. ProC3 is
found on a small area in the southwestern portion of the site, with central portions made up of
RdB, and the remainder consists of HaA. Plymouth gravelly loamy sand is described within the
Suffolk County Soil Survey as land which is moderately sloping and is generally along drainage
channels that have been cleared for cultivation, much of which is severely damaged from erosion.
The Haven Loam series is suitable for development, with good leaching potential. Although
Haven soils with shallow slopes (0-2%) are not classified within groups 14 of the NYS
Agriculture Land Classification System, they am fertile agricultural soils. Riverhead sandy loam
generally contains moderately short slopes, and also contains a slightly larger amount of gravel.
The main concern of management of this soil is controlling runoff and erosion. The parcel is
located within a designated agricultural district.
Water will be supplied to the property by individual wells. The Water Budget Area as mapped
by the Suffolk County North Fork Water Supply Plan includes locations where the potential for
large public water supply wells exists. The subject site is located within the Water Budget Area,
but it is also noted that it is not economically feasible to provide public water supply systems to
this area. The subject site is located within SCDHS Groundwater Management Zone IV, and
according to the North Fork Water Supply Plan (ERM-Northeast, Camp Dresser & McKee,
1983), the area has been significantly impacted by nitrate (concentrations over 8 mg/l), and by
dichloropropane (Bureau of Water Resources, Baler & Robbings, 1982), probably due to
agricultural activity.
The elevation of groundwater beneath the subject site is roughly 5 feet above mean sea level
(msl) according to the 1997 SCDHS water table map. The topographic elevation on site ranges
from approximately 24 to 44 feet above msl. Therefore, the minimum depth to groundwater is
approximately 19 feet. The depth to groundwater on site is not expected to have constraints on
the location of septic systems on the parcel. A standard, three pool septic system typically
requires a minimum depth to groundwater of approximately 9 feet to allow adequate depth for
leaching. A septic system with five shallow pools would require only about 5.5 feet to
groundwater, but these systems generally present a greater risk of groundwater contamination and
would require a variance from the Suffolk County Department of Health Services (SCDHS). pool
system. Soil borings on site have been analyzed and contain clayey loam to a depth of 2 feet,
loamy sand with 10% gravel to a depth of 3 feet, and medium to course sand to a depth of
between 3-17 feet. As indicated by the soil boring, ground water does not occur on site to a depth
of at least 17 feet. Therefore, constraints on development should be minimal.
The majority of the parcel is currently in use as agricultural land with a portion characterized by
pioneer vegetation. The dominant agricultural crop is corn with species such as ragweed,
mugwort, pokeweed, common mullein, clover, purple top, crab, rye and timothy grass also

present. Hardwood species are present along the neighboring property boundaries, specifically
along the easternmost boundaries and to the southeast. These include hickory, black locust, pin
oak, black cherry and cedar. Many avian species were observed on site. These included the
cardinal, crow, house sparrow, American robin, northern mockingbird, blackbirds, and a song
sparrow. It is also expected that many other types of avian and mammalian species use this site.
Raccoon scat was observed on the property, with deer tracks also abundant. There are no
wetlands, ponds or streams on or in the near vicinity of the subject site.
As was mentioned above, the Applicant has indicated that only 6 acres of the site will be cleared.
This cleared area would include approximately two acres per lot, with driveways comprising the
only paved surfaces. The Town code does not indicate any limits on clearing within R-80
residential zoning and thus it is difficult to insure such restrictions on residences. However, the
applicant has placed a restriction on approximately 14 acres that are to remain as a non-
development area and has indicated that no solid fences or hedges be erected along Alvah's Lane,
with the exception of the 30 foot frontage at the western most corner. Native or near-native
landscaping should be used to make the area more attractive for local wildlife.
The construction of the three homes will cause a minor change in the visual character on the
project site. However, the density of the proposed subdivision is much less than would be
allowed under zoning, which will offset these impacts and allow preservation of significant open
space. The Planning Board should require a Declaration of Covenants and Restrictions that there
shall be no visual obstruction along the Alvah's Land road frontage.

In summary, the proposed project is a three lot subdivision, which is significantly less than the 10
lots which would be allowed under zoning. The project sponsor has chosen to subdivide the
property as follows: lot 1- 16.61 acres, lot 2- 81,408 s.f., and lot 3- 83,837 s.f. with the
preservation of approximately 14 acres of a non-development area within lot 1. Although there
will be some impacts on local environmental resoumes, the project does minimize the potential
impact of development of the property and will preserve a significant amount of open space.
However, the primary concern is the loss of agricultural land to residential development. Impacts
of the proposed project include conversion of prime agricultural land to residential use, loss of
locally important open space, and the potential for visual impacts. These impacts will be reduced
through restrictive covenants, and would be significantly greater if the full yield of 10 homes
were constructed, even with a clustered design. The proposed project is not expected to result in
significant environmental impacts.

As per your request, I have conducted a evaluation of the above referenced
project and I have reviewed it with Mr. Jacobs. The proposed subdivision indicates
access to all three lots by way of existing Town roads.
Road improvement requirements should consist of all new apron construction
within the existing Town Right-of-Ways that may be required for access to individual
or common driveways within this proposed subdivision. The entrance for lot #'s 2 & 3
will also require drainage that is designed to prevent site runoff generated by new site
improvements from entering the existing Town roadway.

The Suffolk County Department of Health Services (SCDHS; "Department") has received
your letter dated October 6, 1998 concerning the above-referenced project. The Department has
no objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. However, the Department wishes to reserve its right to provide more detailed
information within the comment period(s) established for this action. These comments should
not be construed as an implicit SCDHS approval or rejection of the project. All applications are
reviewed thoroughly with respect to Suffolk County Sanitary Code concerns by appropriate
departmental personnel when SCDHS applications are completed.
Article VI Application Status:
Our agency has received an application for the above referenced project as required by
Article VI of the Suffolk County Sanitary Code. The application is incomplete pending the
submission of additional information including test hole data, the location of neighboring water
supply wells and septic systems within 150' of all property lines and the submission of covenants
and restrictions for private wells. The applicants were also requested to clarify the area described
as "non-development".
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow
specifications, subsurface soil conditions, and complete site plan details are essential to the
review of this project. These considerations are reviewed completely at the time of SCDHS
application.
SCDHS maintains jurisdiction over the final location of sewage dispos~ 1 and water supply
systems. The applicant, therefore, should not undertake the construction of eib-her system without
Health Department approval.

located on the northeast side of Alvah's Lane, 2,873 feet north of Main Rd. in

Richard Reinhardt: I'm Richard Reinhardt and I have three maps. Do you
want these now?
Ms. Spiro: OK.
Mr. Reinhardt: We were asked to make a couple of changes to the map since
the work session, pretty much from Bick Ryan and the Land Preservation
Committee to allow us agricultural access along the westerly part of lots 2
and 3, just for farm vehicles. So we've adjusted to allow that, and also we
put in a letter to the Planning Board...another question Mr. Ryan, his concern
is the vistas to the east and he's asked us if we wouldn't plant any
vegetation or erect any trees that would block that vista, and we completely
agree with that.
Mr. Orlowski: OK, does the Board have any questions? I'll entertain a motion.
Mr. Ward: Mr. Chairman, I'd like to offer the following resolution.

Sketch plan approval is conditional upon submission of final maps within six
months of the date of sketch approval, unless an extension of time is requested
by the applicant, and granted by the Planning Board. The final maps, six (6)
paper prints and two (2) mylars must contain a current stamp of Health
Department approval, and must be submitted before a final public hearing will be
set.
The sketch plans also have been referred to the Cutchogue Fire Department for
their recommendation as to whether a firewell is necessary for fire protection.
The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A106-38(e) of the Town Code. The amount to be deposited with the
Town Board shall be $6000 (two thousand dollars per vacant lot in the
subdivision). Payment is required prior to any final endorsement of the
subdivision.

I am also willing to offer a restriction that there
will be no solid fences or hedges erected along the Alvah's
Lane frontage, in order to preserve the scenic vistas from
the road eastward. This restriction would not apply to the
30 foot frontage at the northwesterly corner of the
property.
I have instructed the surveyor to modify the map to
provide for a strip between the southwesterly side of Lots 2
and 3 and the northeasterly boundary of land now or formerly

I have been informed that the development rights on 14 acres or so acres of Ihs 20 acre parcel
direclly 1o the West and abutting our farm on AIvah's Lane are being offered by Richard Reinhardt,
This presents a great opportunity (and probably, the last chance) for the Town of Southold to secure
this land lot a farm future, As you are no doubt aware, a full nine house sub on it is merely
awaiting water approval. In my opinion, the existence of a full subdivision on this property would be
the cancer to ruin the rural quality of AIvah's Lane, one of the last real country lanes left on the
North Fork. Addilionally, it may put unacceptable pressure on our vineyard as well. We have co-
existed reasonably well wilh the subdivisions Io the South and East mostly because of the wooded
barrier, There are no woods to the East. I would have to plant them and hope I live 200 years.
Having been a prior member of the Farm Preservation Committee, I know our committee looked for
frontage, contiguity to other protected parcels and stralegic value which I am sure is also on your
agenda, This 14 acre piece meets all the tests I can think Of. There is a preserved parcel of eight or
so acres, immediately to the wesl of our vineyard on which The Suffolk County Water Authority
may have relained certain rights. I am happy to report that lhere are two pairs of red-tailed hawks
thai still call this home. We sold the development rights to 60 or so acres, preserving vislas from
Route 48 and from Alvah's Lane. The other parcel to Alvah's Lane would complete the block.
Addilional good news is lhal the Benkoski farm, directly across Alvah's Lane has been purchased by
a chef who intends to farm il for his kitchen and did so quite successfully last year.
I know this land well as our neighbors, Mike and Paul Kaloski, farmed it to potatoes and cauliflower
for many years. The primary area to be preserved is a broad, long slope, tilting toward Ihs sun,
well-drained and also quite suitable for grapes as a result.
I urge you Io include this small but important parcel in your program. For an modest additional
investment, you vastly enhance the future farmability of contiguous areas and in the process creale
a significanl block that stretches to all abutling roads for everyone to enjoy.
