approving the use of stone curbing (Belgin Block) lieu

The following action was taken by the Southold Town
Planning Board on Monday, February 27, 1989.
RESOLVED that whereas, a formal application for approval of
subdivision plat entitled The Woods at Cutchooue located at
Cutchogue was submitted to the Planning Board August 19, 1987
and,
WHEREAS, a final public hearing was held on said
subdivision application and plat at the Town Hall, Southold, New
York, on January 23, 1989 at 7:30 p.m., and,
~EREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
NOW, therefore, be it RESOLVED that the application of F &
F Depot Lane Development Corp. for approval of said subdivision
prepared by Roderick Van Tuyl, P.C. dated September 19, 1988, be
approved subjet to the following conditions within six (6)
months of the date of resolution:
The adoption by the Town Board ~f the Local Law to

We have been advised that you would prefer not to give conditional
final approval on this project. We are attempting to work out the dedica-
tion of the open space with the applicant's attorney. There are two possible
ways to make the dedication, Bear in mind that the applicant does not want
to make an offer of dedication without final approval.
What we propose to do is have a conditional offer of dedication for the
open space, conditioned upon final approval from the Planning Board. The
alternative would be to have an outright offer of dedication to be held in
escrow until final approval. This latter alternative is the less preferred
because it involves much more paperwork on everybody's part,
Please advise if you have any problems with the conditional offer of
dedication.

During preliminary clearing of the roadway for the
above referenced subdivision,we discovered that a 32"
caliper oak tree was growing on the centerline of the
roadway just at the entrance to the subdivision at
station 6+20.
We have left this tree standing and had Roderick
Van Tuyl prepare the attached revision to the subdivision
to include an island to save the tree from removal.
We therefore request that the Planning Board review
and approve this revision to our preliminary subdivision.

after referred to as the "Corporation" ,
WHEREAS, the Corporation is the owner of the premises
described on Schedule A annexed hereto and made a part hereof (the
"Premises"); and
WHEREAS, the Corporation wishes to establish
scheme of Covenants and Restrictions for the purpose
and attractive development of the Premises;

NOW THEREFORE, the Corporation, for itself, its su~~
cessors and assigns, declares, publishes and makes known that the
Premises is and shall be held, transferred, sold, conveyed and
occupied subject to the covenants and restrictions, hereinafter
set forth which shall be considered to be real covenants running
with the land and binding upon all purchasers, owners, mortgagees,
lienors and any other persons acquiring an interest in any portion

1. Definitions:
A. The "Map" is the subdivision map entitled "The
Woods at Cutchogue", which map was filed in the Office of the
Clerk of the County of Suffolk on , 1988 as Map
B. A "Lot" is such parcel as is separately numbered
as a lot on the Map.
2. No dwelling shall be erected having less than 1,700
square feet of interior living area, and there shall be no less
than 1,000 square feet of interior living area on the first floor
of a two story house. The unfinished space in a second floor area
may be included in calculating the minimum square footage only if
windows or dormers have been installed on the second floor.
3. Each dwelling shall have an attached double garage,
the entrance to which shall not face Evergreen Drive, except that
the entrance to the garage for Lot #1 may face Evergreen Drive.

4. No building, fence, wall or other structure shall be
commenced, erected, or maintained upon any Lot, nor shall any
exterior addition to or change or alteration be made until the
plans and specifications showing the proposed improvement,
including the height and location, materials and colors, and
grading plan shall have been submitted to and approved in writing
by the Corporation. In no event shall there be any installation
of a "mobile-type" or "modular" home on any Lot. All construction
shall be done in a professional and workmanlike manner.
5. No above-ground swimming pools shall be erected or
maintained on any of the said Lots.
6. No boats, boat trailers, travel trailers, mobile
homes, trailers, trucks, equipment, materials, commercial
vehicles, unlicensed or derelict vehicles, or any other similar
property, shall be parked or stored on any part of the Premises
unless parked or stored inside a garage.
7. No animals, livestock or poultry of any kind shall be
raised, bred or kept on any lot, except that dogs, cats or other
household pets may be kept, provided that they are not kept, bred
or maintained for any commercial purpose. ~
8. No fences shall be erected or maintained in excess of
four (4) feet in height unless additional height is required by a
municipality.
9. No fences, hedges or other screening shall be erected
or grown in that area of the front yard of a Lot forward of a line
established by extending the front line of each house to the side
lines of the Lot. A corner Lot shall for these purposes be
considered to have a front yard on each street.
10. No title in and to the bed of the roads is to be
conveyed to the Lot purchasers. The grantor retains the said
title and the right to dedicate and convey the said title to the
Town of Southold, as the Corporation at its sole discretion shall
determine.
11. No signs or advertisements shall be displayed on any
Lot or on any part of the Premises. This restriction shall not
apply to the Corporation prior to the sale of all Lots by the
Corporation.
12. No sand, earth or sod shall be removed from the Lots,
or excavation be allowed to remain open thereon, except as may be
necessary during building construction periods. After construc-
tion, lawn and landscaping shall be installed on the Lots and
maintained thereafter in an attractive manner.
SCHEDULE B
13. Lots in this subdivision shall be residential Lots,
and each Lot shall contain only one single family residence
together with lawful accessory structures. No trade or business
shall be conducted on any Lot.
14. Ail garbage cans, equipment, and coolers maintained
on a Lot shall be walled in to conceal them from view of
neighboring Lots, roads or streets. Clothes lines shall not be
visible from the streets or neighboring Lots.
15. Unless the Corporation's prior written consent shall
be granted, there shall be no removal of any tree which has a
diameter of four inches or greater (measured twelve inches above
natural grade), unless located within actual construction areas of
a Lot, to the end that all large trees not located within construc-
tion area of the various Lots remain intact throughout the
Premises.
16. No satellite dishes or antennas or aerials shall be
placed, erected, or located on any Lot or on the structures
erected on any Lot unless'the location, screening, construction,
height, and aesthetics are approved in writing by the Corporation.
17. There shall be no lighting of any tennis court
constructed anywhere on the Premises.
18. No Lot shall be subdivided, sold or conveyed except
as a whole without the written consent of the Corporation.
19. No noxious or offensive activity shall be carried
upon any Lot, nor shall anything be done thereon which may be or
may become an annoyance or nuisance to the neighborhood.
20. The Corporation, its successors and assigns, whether
or not owning any part of the aforesaid land, shall have the right
to alter, modify, or annul any of the covenants, restrictions and
conditions of this Declaration and shall also have the power to
assign such right (with or without conveyance of title to any part
of the aforesaid land) by an instrument in recordable form.
Should the Corporation at any time assign such right, the assignee
thereof shall succeed to all of the rights and powers of the
Corporation hereunder, whether or not such assignee has title to
any part of the aforesaid land.
21. This declaration shall be binding, inure to the
benefit of, and be enforceable by the Corporation and any of the
Lot owners of the Premises. Furthermore, any costs occasioned by
the enforcement of the above covenants or restrictions shall be
charged to the Lot owner in violation thereof. Enforcement shall
be by proceedings at law or equity against any person or persons

violating or attempting to violate any covenant and may be to
restrain violation and/or to recover damages. The foregoing
covenants and restrictions shall in no manner be construed to hold
the Corporation legally responsible or liable for the enforcement
or non-enforcement of any provisions of the covenants and

Corporation to act under the covenants and restrictions herein, is
deemed to do so as a completely independent agent and the
Corporation shall not be liable or responsible for the performance
of that party in connection with the enforcement of any provision
of the covenants and restrictions.
22. Invalidation of any one of these covenants by
judgment or court order shall in no way affect any of the other
provisions which shall remain in full force and effect.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chpater 44 of the Code of the Town
of Southold, notice is hereby give that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant efefct on the
envornment.
DESCRIPTION OF ACTION
The major subdivision of Steve Fuchs to be known as "The
Woods" is for 13 lots on 29 acres in the cluster concpet
located at Depot Lane, Cutchogue. Tax map no.1000-102-1-4.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the environment
were likely to occur should the project be implemented as
planned.
There have no comments from the NYS Department of Envirionmental
Conservation in the alotted time, therefore, it is assumed
that there are no comments or objections from that agency.
The Suffolk County Deprtment of Health Services has no objection
to our designation of lead agency status. The Department
has received an application andit is being reviewed. It
appears that th eproject can be served by Subsurface Sewage
Disposal System and Individual Water Supply System. Before
approval is obtained the final map must show test hole locations
and details, test well locations and detail, details and
loction of a sewage disposal system for a typical lot and
have the signature and seal of a P.E. or L.S.
The project will meet all the requirement of the Code of
the Town of Southold Subdivision of Land Regulations.

Enclosed for your review is our map of "The Woods at Cutchogue'
As you will see, since our origional preliminary submission in
July of last year, major revisions have been made. Basically,
they fall into three areas.
First, at the request of Mr. Bob Vllla and the Water Resorses
Board, we have moved the area of development to the southerly
most portion of the property. We have held to 150 foot lot
frontages which we believe to be the mlninum consistent with a
quality subdivision and the Town of Southhold 1 acre frontage
requirment. This allows the northerly portion of the property to
be reserved as open space suitable for a future water
distribution location. Mr. Villa had reviewed this lay out and
supports it.
Secondly, at your suggestion and the suggestion of Valerie
Scopaz, drainage for this project is now being provided for with
a natural seepage area located to the rear of lots t8 and #9.
This aesthetic approach, in addition to saving natural vegitation
will also provide ample positive drainage for the project.
Lastly, we have added a tap street to the Bldwell property as
requested. While recognizing the requirement for this we can
not help but feel that this road will not be used by anyone for
the forseeable future. Further, its construction at this time
will result in the unnecessary dlstructlon of trees and
vegl~tation and will in fact create a maintenance and vandalism
problem for everyone. We therefore request that while provided
for, this road bed be left in its natural state until such time, if
ever, it is needed.
We are delighted with the results of our negotiations and hope
that you are as well and now respectfully request scheduling for
preliminary approval at the earliest possible date.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chpater 44 of the Code of the Town
of Southold, notice is hereby give that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant efefct on the
envornment.
DESCRIPTION OF ACTION
The major subdivision of Steve Fuchs to be known as "The
woods" is for 13 lots on 29 acres in the cluster concpet
located at Depot Lane, Cutchogue. Tax map no.1000-102-1-4.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the environment
were likely to occur should the project be implemented as
planned.
There have no comments from the NYS Department of Envirionmental
Conservation in the alotted time, therefore, it is assumed
that there are no coraments or objections from that agency.
The Suffolk County Deprtment of Health Services has no objection
to our designation of lead agency status. The Department
has received an application andit is being reviewed. It
appears that th eproject can be served by Subsurface Sewage
Disposal System and Individual Water Supply System. Before
approval is obtained the final map must show test hole locations
and details, test well locations and detail, details and
loction of a sewage disposal system for a typical lot and
have the signature and seal of a P.E. or L.S.
The project will meet all the requirement of the Code of
the Town of Southold Subdivision of Land Regulations.

Gentlemen:
We have reviewed at your direction the various alternatives of the
drainage design on the above referenced project. This was done in an
attempt to minimize the need for a recharge basin, and thus reduce the
amount of tree clearing that would have to be done.
The main tributary area for which drainage would have to be
provided is approximately 9 acres. Also, the majority of construction
takes place within this area (roads, driveways, houses, etc.), which
increases the volume of runoff and the importance of an adequate method
of storing the runoff. Another important consideration is that this
area is at the beginning of a natural swale which heads in a southerly
direction, and the additional runoff should be contained on the site,
and not be permitted to flow onto adjoining property.
Following, are descriptions of the various alternatives which exist for
designing the storm drainage system.
The Current plan, as submitted.
Under this plan, approximately 0.72 of an acre of land is used by
the recharge basin, which is entirely within the wooded, open
space area. Also, although specific details are lacking on the
plan (proposed grades, drainage calculations, etc.), our interpre-
tation of the plan indicates that the designer was reasonable
accurate when sizing the proposed recharge basin, and utilizing as
little space as possibe. The storage capacity of the recharge
basin appears to be sufficient to handle the runoff from a 6"
storm, which is the requirement in the subdivision regulations.

Leaching Pools, in Lieu of a Recharge Basin
~[~ order to store the same volume o~- water as noted in
alternative (1), 35 leaching pools would have to be used.
But leaching pools require more maintenance than a recharge
basin, this burden would be placed upon the Town's Highway
Department. The number of leaching pools could be reduced
providing that sub-soil conditions are favorable, and would
permit a rapid rate of percolation into the ground.
Combination of Swales & Leaching Pools
Providing soil conditions are favorable, this method could
also reduce the number of leaching pools, however, to keep
tree clearing to a minimum, the swales would have to be
adjacent to the road, and they would not function properly in
the winter if the ground is frozen.
Utilization of Kettle Hole between Lots 8 & 9
This is a natural drainage area, a minimum of excavation,
grading and clearing would have to be done. However, several
lots would have to be shifted to make up for the lost area,
and the residential area may have to be pushed slightly into
the open space to replace the area lost between lots 8 & 9.
Combination of a smaller recharge basin & Leaching Pools
( Sketch Included) A small recharge basin (storage for a 4"
storm) would be placed in the southwestern corner of lot 10,
with approximately 10 leaching pools making up the difference
in storage capacity. Lots 10, 11 and 12 would have to
shifted counter clockwise slightly and the area of lot 13
reduced by 10,000 s.f.. The overall southern boundary of the
lot lines will have to be moved 20 ft. to the south, but the
recharge basin would be above this line, thus reducing the
amount of tree clearing by perhaps .40 of an acre.
We recommend that alternatives 4 & 5 be considered, as the
disturbance to the open space would be minimal, and the
drainage systems would be less costly to maintain.
Also, for subsequent submissions in accordance with the
subdivision regulations, the following informations should be
provided, but not limited to:
A. Test hole informaton- in the vicinity of the
recharge basin.
B. Contour interval at 2 ft.
C. Proposed grades- road & recharge basin

Comments: The Health Department's primary environmental concern
pertaining to development is that the applicant comply with the
requirements of the Suffolk County Sanitary Code especially
Articles V and VI, and relevant construction standards for water
supply and sanitary sewage disposal. These considerations are to
be reviewed completely at the time of application. Full considera-
tion in placement of water supply wells and disposal systems is
given to State and Town wetland requirements. The Health Depart-
ment maintains jurisdiction over final location of disposal and
well systems and the applicant should not undertake to construct
any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Articles VII and XII. The Lead
Agency is requested to forward a copy of this form to the applicant
with its findings.
Our department has received an application for the proposed sub-
division and it is in the process of being reviewed. Before
approval is obtained the final map must show test hole locations
and details, test well locations and detail, details and
location of a sewage disposal system for a typical lot and have
the signature and seal of a P.E. or L.S.

6. "CLOSING" means the.[settlemet~l~f the obligations of sELLER and_.PURCI-I~ER to each other tinder [hi:
contract, including the paint of I~urchase price to SELLER, and~ delixi~to PURCHASER of a
bargain and sale witJ~covena~' ts deed in ~roper statutory forrit~or recording so as to transfe
full ownership (fee simple tide) to the PREMISES, free of all encumbrances except as herein stated. The deed
contain a covenant by SF. Lt.eR as required by Section 15 of the Lien Law.
If SEt J.gR is a corporation, it will deliver to PURCHASER at the time of CLOSING (a) a resolution of its Board o
Directors authorizing the sale and delivery of the deed, and (b) a certificate by the Secretary or Assistant Secretary c
the corporation certifying such resolution and setting forth facts showing that the transfer is in conformity with th,
requirements of Section 909 of the Business Corporation Law. The deed in such case shall contain a recital sufficient

11. a. SELLER will comply with all notes or notices of violations of law or municipal ordinances, orders or
requirements noted in or issued by any governmental department having authority as to lands, housing, buildings,
fire, health and labor conditions affecting the PREMISES at the date hereof. The PREMISES shall be transferred free
of them at CLOSING and this provision shall survive CLOSING, SELLER shall furnish PURCHASER with any
mthorizations necessary to make the searches that could dlsdose these matters.
b. All obligations allr'ecdng the PREMISES, incurred pursuant to the Administrative Code of the City of Nev~
York prior !osCLO$ING and payable in money shall be discharged by SELLER at CLOSING. This provision shall
survive CLOSING.
12. If at the time of CLOSING the PREMISES are affected by an .assessmeni which is or may become payable in

21. PURCHASER has inspected the buildings on the PREMISES and the.personal property included in this sale
and is thoroughly acquainted with their condition. PURCHASER agrees to purchase them "as is" and in their present
condition subject to reasonable use, wear, tear,'and natural deterioration between now and CLOSING.PURCHASER
shall have the right after i'casrnable'notice to SELLER, to inspect them before CLOSING.
22. "All prior understandings and agreements between SELLER and PURCHASER are merged in this contract. It
completely expresses their full agre, ement. It has been entered into after full investigation, neither party relying upon
any statements made by anyone else that are not set forth in this contract.
2:8. This contraci n~ty not be changed or cancelled except in writing. The contract shall also apply to and bind the
distributees, .heirs, executors, administrators, successors and assigns of the respective parties. Each of the parties
hereby authorize thetr attorneys to agree in writing to any changes in dates and time periods provided for in this
