Dear Mr. Moore:
The following actions were taken by the Southold Town Planning
Board, Monday, August 26, 1985.
RESOLVED that the Southold Town Planning Board declare itself
lead agency for the set-off of "Manor Hill Vineyards" located at
Mattituck under the State Environmental Quality Review Act. An
initial determination of non-significance has been made.
RESOLVED that the Southold Town Planning Board approve the
set-off of 80,000 square feet from 117.4945 acres at County Route
48, Mattituck to be known as "Manor Hill Vineyards". Map dated
March 8, 1985 made for L and R Vineyards Associates. This approval
is subject to the review of the Suffolk County Planning Commission.

Fifth Avenue, New York, New York, hereinafter called the
Declarant.
WHEREAS, the Declarant is the o~ner in fee simple of a certain
parcel of land situate at Mattituck,~Town of Southold, Suffolk
County, New York and designated on the Suffolk County Tax Map as
District 1000, Section 101, Block 1, Lot 5, containing approximately
two acres, being the same premises acquired by the Declarant by deed
dated January 19, 1986 and recorded in the Suffolk County Clerk's
Office on January 19, 1986 in Liber 9498 of deeds at page 182, and
referred to herein as the "premises".
WHEREAS, the Declarant intends to use said premises for
residential purposes and desires to subject said premises to certain
conditicns, covenants and restrictions in order to preserve the
maximum open space, natural scenic beauty, natural vegetation and
to prevent overcrowding and to conserve the ground water resources
of the Town of Southold, and
WHEREAS, the Declarant has applied to the Planning Board of
the Town of Southold for approval of the set off of the premises,
NOW THEREFORE, the Declarant does hereby declare that the
aforesaid premises and every portion thereof is hereby held and
shall be conveyed subject to the conditions, covenants and
restrictLons hereinafter set forth, and that every purchaser of
said premises, or any portion thereof, by the acceptance of a deed
thereto, covenants and agrees that the premises so purchased shall
be held s~ubject to the covenants, conditions and restrictions
hereinafter set forth.
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the Town of
Southold Planning Board.
2. Due to the minimum lot area requirement of the zoning
classification of this property being considerably less than the area
of Lot 2, the lot shall be made subject to a restriction than will
prohibit future subdivision.

3. Ail new driveways on Middle Road shall make an angle of
70° and preferable 90° with the county road.
4. All new driveways on Middle Road shall have a turnaround
provision, such as a T-shaped shunt, so that a vehicle leaving a
lot will not have to back out into the traffic stream on the road.
5. No driveway or entrance road on Middle Road and Elijah's Lan~
shall be located within fifty (50) feet of the ends of the shore
radius curve connecting the northerly side of the right-of-way of
Middle Road with the easterly side of the right-of-way of Elijah's
Lane.
6. Ail stormwater runoff resulting from the development
and improvement of this subdivision or any of its lots shall be
retained on the sire by adequate drainage structures so that it will
not flow out onto the right-of-way of Middle Road.
7. That all of the covenants, conditions and restrictions
contained herein be construed as real covenants running with the land
and shall continue and remain in full force and effect at all times
as against the owner of the premises or any portion thereof in
perpetuity. Said covenants, conditions and restrictions shall be
binding upon, inure to the benefit of and be enforceable by the
Declarant, their heirs, successors and assigns; any owner of any
portion of the aforesaid premises, their heirs, successors and
assigns, and the Town of Southold, and its successors and assigns,
and the failure of any of the foregoing to enforce any of such
covenants, conditions and restrictions shall in no event be deemed
a waiver of the right to do so thereafter.

The Suffolk County Planning Commission at its regular meeting on January 8,
1986,reviewed the proposed subdivision plat entitled, "Minor Subdivision -
L.&.R. Vineyards Associates" referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to approve
said map subject to the following eight conditions deemed necessary to help
preserve the traffic safety and carrying capacity of Middle Road, a county road.
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold Planning
Board.

Conditions 1-6, inclusive, shall be filed as covenants and
restrictions in the office of the County Clerk on or prior to the
granting of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority plus
one of the Town Board of the Town of Southold after a public hearing.
Adjoining property owners shall be entitled to notice of such public
hearing but their consent to such modification shall not be required.
The final map shall bear the following note: A Declaration of
Covenants and Restrictions has been filed in the Suffolk County
Clerk's office which affects lots in this subdivision.
The Commission also offers the following con~nents on the map for your
use and consideration:
It is suggested that before approval is granted to this subdivision
that the subdividers be required to submit this proposal to the
Suffolk County Department of Health Services for review to insure that
the proposed subdivision will meet the requirements and standards of
that agency.
It has been noted that all the buildings on the tract are not
indentified on the map. It would be helpful in our review if the
proposed subdivision map would be complete in the information that it
contains.

The map of this minor subdivision should be filed in the office of the
County Clerk. This is to insure the validity of the subdivision map
and that the subdivision map will be available to the general public
in a central office of official records.

Enclosed is correspondence received from the Suffolk County
Department of Health Services and the Suffolk Couny Planning
Commission.
Pursuant to our discussion, the Health Department is
not requiring an application to be made under Article 6 since
one of the parcels is larger than 5 acres and the set-off
is actually a lot-line change.
The Suffolk County Planning Commission, however, does
have to make a review of this action since it abuts a County
Road. In review of the file, the Planning Commission has
requested more clarification regarding the set-off. Would you
plase submit the information which they are requiring so that
we may refer it back to them.

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article ¥ and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also applY to
conmmrcial development such as Article XII. The Lead Agency is requested

NEGATIVE DECLARATION
September 12, 1985
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section'
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of "L and R Vineyards Asociates" is
for the creation of one two-acre lot from 117.9 acres at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Becuase there has been no correspondence from the Department
of Environmental Conservation, it is assumed that there is
no objection or comments from that agency.
Because there has been no correspondence from the Suffolk
County Department of Health Services in the alotted time,
it is assumed that there is no objection or comments from
that agenccy.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.
