Please let this confirm the following action taken by the
Southold Town Planning Board, Monday, September 14, 1987.
RESOLVED that whereas, a formal application for the approval
of a subdivision plat entitled "Stanley Simchick" located at
Southold was submitted to the Planning Board on May 20, 1986,
and a filing fee was paid, and
WHEREAS,

a public hearing was held on said subdivision application
at the Southold Town Hall, Southold New York, on August

WHEREAS, the requirements of the Shbdivision Regulations of the
Town of Southold have been met by said subdivision plat and ._

Rod VanTuyl on April 3, 1987, be approved and the Chairman be
authorized to endorse approval on said subdivision plat, subject to:

DECLARATION made this ;0~ day of November, 1987, by STANLEY
IMCHICK and HELEN SIMCHICK, residing at (no #) Alvah's Lane,
Sutchogue, New York, hereinafter called the "Owner";
WHEREAS, the Owner has title to certain lands situate, lying
End being at Cutchogue, in the Town of Southold, County of
Suffolk and State of New York, said lands hereinafter being more
)articularly described in Schedule A attached hereto; and
WHEREAS, the Planning Board of the Town of Southold did on
~eptember 14, 1987 approve the subdivision of the parcel of land
described in Schedule A into a minor subdivision of four lots to
be known as "Map of Stanley Simchick, at Cutchogue, Town of
Southold, N.Y."
WHEREAS, the Planning Board of the Town of Southold resolved
on September 14, 1987, there should be placed on the subdivision
the following Covenants and Restrictions.
NOW, THEREFORE, the premises described in Schedule A shall be
subject to the following covenants and restrictions:
1. The access driveway to Lot 3 shall only be from Alvah's
Lane, and shall be located at least 150 feet northerly of the
point where Alvah's Lane meets County Route 48.
2. The access driveways for Lots 2, 3, and 4 shall be a
T-shape design so as to prevent the need to back vehicles out of
the driveway. For traffic safety, circular driveways with two
access points to public streets are prohibited.

ubdivision with the approval of the Southold Town Planning Board.
DECLARANTS do hereby further warrant, covenant and represent

THIS DECLARATION made this 27th day of May, 1987, by STANLEY
SIMCHICK and HELEN SIMCHICK, his wife, residing at (no ~) Alvah's

i!DECLARANTS, as the owners of the premises described in Schedule
'~annexed hereto (hereinafter referred to as the PREMISES) desire
restrict the use and enjoyment of said PREMISES and has for such
purposes determined to impose on said PREMISES covenants and
restrictions and does hereby declare that said PREMISES shall be
ilheld'and shall be conveyed subject to the following covenants and
!restrictions:
1. DECLARANTS have made application to the Suffolk County
Department of Health Services (hereinafter referred to as the
DEPARTMENT) for a permit to construct, approval of plans or
approval of a subdivision or development on the PREMISES.
2. WHEREAS, the test well sampled for the PREMISES indicated
a groundwater supply that had contamination in excess of the
minimum drinking water standard and/or guidelines of the State of
New York, to wit: 13 parts per billion aldicarb; and
WHEREAS, the County of Suffolk Department of Health
Services has agreed to issue a permit only if there be a record
covenant that the necessary water conditioning equipment be
installed so as to meet the quality standards for drinking water;
it is
DECLARED and COVENANTED by DECLARANTS, their heirs or
~successors and assigns forever, that no residence upon the above-
!described PREMISES will be occupied prior to the installation of
necessary water conditioning equipment so that the water, when
conditioned, meets the said minimum quality standards for drinking
water of the State of New York and evidence of the same is
furnished to the Suffolk County Department of Health Services
for their written approval.
3. The DECLARANTS, their successors and/or assigns shall set
forth these covenants, agreements and declarations in any and all
leases to occupants, tenants and/or lessees of the above-
described property and shall, by their terms, subject same to the
covenants and restrictions contained herein. Failure of the
DECLARANTS, their successors and/or assigns to so condition the
leases shall not invalidate
covenants and restrictions.
4. All of the covenants

7. The aforementioned Restrictive Covenants shall be
enforceable by the County of Suffolk or any agency designated by~

the County of Suffolk, State of New York,~ by injunctive relief or
by any other remedy in equity or at law. The failure of said
agencies or the County of Suffolk to enforce the same shall, not be
deemed to affect the validity of this Covenant nor impose any
liability whatsoever upon the County of Suffolk or any officer or
employee thereof.
8. These covenants and restrictions shall run with the land
and shall be binding upon the DECLARANTS, their successors and
assigns, and upon all persons or entities claiming under them,
and may be terminated, revoked or amended by the Owners of the
PREMISE~ only with the written consent of the DEPARTMENT.
9. If any section, subsection, paragraph, clause, phrase or
provision of these covenants and restrictions shall, by a Court
of competent jurisdiction, be adjudged illegal, unlawful, invalid
or held to be unconstitutional, the same shall not affect the
validity of these covenants as a whole, or any other part or
)rovision hereof other than the part so adjudged to be illegal,
unlawful, invalid or unconstitutional.
10. Local Law #32-1980 - The DECLARANTS represent and warrant
that they have not offered or given any gratuity to any official,
employee, or agent of Suffolk County, New York State, or of any
)olitical party, with the purpose or intent of securing favorable
~reatment with respect to the performance of an agreement, and
that such person has read and is familiar with the provisions of
Lbcal Law #32-1980.

Minor subdivision of Stanley Simchick
N/E/C County Road 48 and Alvah's Lane, Cutchogue, New York
PROPOSAL: To subdivide a 20.312 acre parcel into 4 lots. Three
of the lots will be 80,000 square feet a piece.
The fourth lot will be 14.8 acres in size.
REVIEW: The final map meets with the Planning Board's requirements.
The Suffolk County Department of Health required
the recording of a Declaration of Covenants and
Restrictiosn wehreby filtration equipment to remove
excess aldicarb from the groundwater must be provided
for all four lots.
The Suffolk County Planning Commission has denied
this ap. See attached copy of their comments.
RECOMMENDATION:
The Planning Board should take the comments
of the Planning Commission into account
when reviewing future subdivision ~pplications.
If the Board does not override the County
Planning Commission the applicant should
be instructed to submit a cluster map.
If the Board decides to override the County
Planning Commission, the following conditions
should be considered:

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on September 2,
1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Stanley
Simchick" referred to it pursuant to Section A14-24, Article XIV of the Suffolk
County Administrative Code. After due study and deliberation it resolved to
disapprove said map for the following reasons:
1. Minor subdivisions should be limited to those tracts that ~ave no potential
for future subdivision. Piecemeal subdivision of a la~ge tract through the
minor subdivision process without a tentative overall plan for the
subdivision of the tract can often lead to unplanned and uncoordinated
growth which can only be detrimental to the community.
2o
The tract contains prime agricultural soils. Every effort should be
made to preserve these soils due to their economic and natural
resource importance. The proposed layout should have taken these
soils into consideration. The creation of a cluster layout plan
where the lots are concentrated in those areas with less valuable
soils can achieve this objective.
3o
The layout creates a lot that will utilize Middle Road, a county
road, for ingress and egress. Each point of access that is created
along a county road can result in a reduction of the carrying
capacity of the road and an increase in traffic safety problems. Any
subdivision that is designed for this tract should utilize Alvah's
Lane for access.

Comments: The Health Department's primary environmental concern
pertaining to development is that the applicant comply with the
requirements of the Suffolk County Sanitary Code especially
Articles V and VI, and relevant construction standards for water
supply and sanitary sewage disposal. These considerations are to
be reviewed completely at the time of application. Full considera-
tion in placement of water supply wells and disposal systems is
given to State and Town wetland requirements. The Health Depart-'
ment maintains jurisdiction over final location of disposal and
well systems and the applicant should not undertake to construct
any water supply or disposal system without Health Department
approval.
