Claim 72690 Q-TWL Suffolk 42.2 A&B Dear Maida: The claimant's August 15, 1989 Notice of Motion constitutes a frivolity, in my opinion. The first grounds of the Motion have already been argued and decided. Further, I believe it is the Town Planning Board (not the Tcwn Board) of the Town of Southold who is empowered to pass on clustered (Article 281 of Town Law) subdivision. The second grounds of the Motion relative to alleged "perjury" (sic) by Orlowski, is mis-represented and erroneous in and of itself. Further, the witness was available for all manner of examination by claimant - at trial (a trial which was attended by J, Wickham and other "experts" and; a trial to which T. Samuels could have been called). Still further, if the issue of perjury is to be considered by the Court, would that be a matter for a separate hearing - first? The J. Lite Affirmation (unsigned) is replete with error and mis-representation: 1. - the representative (Orlowski) is from the Town of Southold (not Southampton.) - the Court decided the "facts" as to the amount of uplands and flooded lands. - notwithstanding the A-80 Residence zoning, the Town does permit density to be clustered (as further confirmed by the Court.) z. ~ i 2. - Exhibit A. - Mr. Wickham is not properly qualified as an expert in those areas which he takes issue with. He is not a land surveyor (instead he provides hearsay from the "surveyor Van Tuyl" - who may not be licensed.) He is not a botanist or biologist, and therefore now expert in identifying the limits of wetlands. He is not an attorney or experienced in real property law (otherwise he would know that the law - supported by case law - defines the location of the mean high water line.) The Richmond Shores subdivision was examined at trial. The "Samuels property" was purchased by D.E.C. (see attached deeds.) Wickham was a witness at trial. He gave no testimony as he now represents in the 8/11/89 letter. - Exhibit D. - It seems obvious that R. Van Tuyl answered a question put by J. Wickham - Is it feasible to construct a "duck-walk" (a wooden walkway) from Mill Road to the "upland" island? I note that all of Van Tuyl's 8/11/89 notice, relates to maps he prepared - not the subject taking map considered by the Court and perhaps maps not in evidence. - Exhibit E. - There was no "taking." The State purchased two separately-owned, fully-approved single family residential building lots that were created by virtue of a minor subdivision (circumstances not similar to subject.) - Exhibit F. - The representations are correct in the 8/8/89 letter. The matters addressed in the undated follow-up letter are also essentially true, but were not brought forth at trial, as the claimant's engineer presented the example of the Samuel's subdivision. 3. - This article is so poorly written as to be incomprehensible. Samuels cannot address cluster (even if he were to testify) because his property was not a cluster. The other subdivisions preferred by claimant were not all cluster subdivisions. Most of Lite's assertions were argued at trial. I cannot believe the Court would re-open the trial. The parties submitted their evidence, examined witnesses, argued their cause - and rested their case. The J. Wickham Affidavit is based on a review of trial testimony. This affidavit should have been submitted with claimant's post-trial brief. ~ 3. If you are to appear before the Court to orally oppose claimant's motion, I should like to be there. Thanks for the chance to provide comment and participate in a continuation of a losing cause (hopefully) for the claimant. Y. 1191 Re: Toumanoff and Sebastian's Cove Gentlemen: In regard to the minor subdivision of George and Jane Toumanoff at Mattituck as shown on map by Van Tuyl amended June 25, 1981, it has been pointed out by the Suffolk County Planning Commission that some clarification is necessary. In the first place, we were instructed to show this minor subdivision as Section I and the remainder of our previously presented major as Section II. It must be realized, however, that a major subdivision has many different aspects from a minor, and, so to avoid confusion, this minor was presented in the name of Mr. and Mrs. Toumanoff while retaining Sebas- tion's Cove as the name of the major subdivision. The resultant major without the four lots shown in the minor should probably be mapped wihtout section designation since the areas adjacent to salt water wetlands shown origin- ally as Sections II and III have been offered to the Depart- ment of Environmental Conservation under their wetlands ac- quisition program. They should no doubt be labeled "Area offered to New York State." The road rofile and drainage plan (Van Tuyl amended April 24, 1981 has been prepared upon the recommendation of Southold Town Highway Engineer, Jack Davis, and I believe it also meets all the Planning Board requirements as well as those of the County Planning Commission. Finally, as I have told you, I am not an owner of record but do have a legal interest in this part of this property. Dear Mr. Raynor: The staff has examined the referral of the above captioned subdivision and has found it to be incomplete. According to the Commission's definition of subdivision this proposed sub- division would be considered a major subdivision. While only four lots are shown on this map a road is required to provide access, drainage structures will be re- quired to handle the stormwater runoff, and the subdivision is only part of the tract. Road and drainage plans should have been included with the referral. A note on the map states, "Lot dimensions approximate only." The Commission does not accept a map that does not have bearings and exact dimensions for all lot lines except in the case where one to three lots are being cut out of a large tract. In that case it will accept approximate information on the boundaries of the remnant of the tract. It is suggested that the map of this subdivision be prepared in accordance with the requirements of the County Clerk and referred to the Commission in accordance with the requirements given in Information Bulletin No. 8.
