PUBLIC HEARING: Appeal No. 1313 - 7:30'P.M.' (E~S~T~')~ upon
application of Eva Maine Peconic Bay Blvd.~ Mattituck, New Yorka
for a variance in accordance with the Zoning Ordinance, Article
III~ Section 303a and Article'X~ Section 1000A~ for permission
to divide lots with reduced area, Location of property: east
side of Goldin Lane~ Southold, New York~ bounded north by Sound-

The Chairman opened the hearing by reading the application for
a variances legal notice of hearing~ affi4avit~attesting to its
publication in the official newspapera and notice to the applicant.
THE CHAIRMAN: Is there anyone present Who wishes to speak for
this application? ~

Mattituck, I believe the 1959 variance was requested because at that
t/me the petitioner wanted to shift the two cottages back and put in
duplexes. That~ as explained in the petition has now been abandoned.
The two cottages are immediately for saleandthe duplex is under an
option. We felt that by this shift it would present an equitable
area or comparable area to all the plots.
THE CHAIRMAN: The two cottages in the middle are now for sale
and the one on Middle Road is occupied~
WMj WICKHAM.,ESQ.~: The Cottage fronting on Middle Road is presently
occupied by Teevesw under rentala and he has an option to buy. The two
cottages in the center are rented out for residential use.
THE CHAIRMAN: What about the duplex on Soundview Avenue~ what
becomes of that?
~M.~ WICKHAM, ESQ.': The duplex on Soundview Avenue is going to be
retained by Fir. & ~irs. Main' It is rented at the present time,~ but
theyhave no intention of disposing of it at the present, Although
they do want an adequate rear' area.
THE CHAIRMAN: Rear area? What do you mean~ on Soundview Avenue?
WMj WICKHAM, ESQj: A rear yard area on .the south side of the duplex.
THE CHAIRMAN:~ This would not in any way change the location of
the buildings?
WM~ WICKHAM~,'Ea~Q%~: No~ it w~uld not,
THE CHAIRMAN: How long has Eva Main owned'the prQperty? Wasn't
there a prevmous owner?
~MR~ Fa%IN: My name is Fir. Main~ I am Evans husband. Joe AvitO
was the preceding owner.

MR.' MAIN: It was before that.
MR.~ GRIGONIS: What about the original application? Wasn't
that in 19597
WM. WICEHAM,i ESQ.: 1959 was the second application. There '.was
a previous application made in 1958. The prop~mty was purchased either
in 1957 or 1958.
H~ARD TERRY~' BUTT,~ING INSPECTOR: I think he bought it right after
the Ordinance went into effectl
THE CHAIRMAN: Are there any further questions?

· THE CHAIRMAN: Is there anyone present who wishes to-speak against
application?
(There was ne.response.)
After investigation and inspection the Board finds that the
applicant requests permission to divide Tots with reduced area.
The cottage on Lot % 10 is now within four (4) feet of the side
line. The applicant wishes to shift the Side lines on all lots
10 feet to the south so that all lots will conform to the Ordinance
in, regard to frontage and sideyardso The Boardis in agreement
with the reasoning of the applicant. This variancewill not
change the surface or the location of the buildings. The granting
of this variance,will improve the area rather than depreciate it.
The Boardfinds that strict application of the Ordinance
would produce practical difficulties or unRecessary hardship;
hardship created is unique and would not be shared by all properties
alike in the immediate vicinity of this property and in the same
use district; and the variance will not change thecharacter of the
neighborhood~ and will observe the spirit of the Ordinance..

An informal discussion was held by the Board in regard to recent
zoning decisions on area variances.
~Decision on Appeal No. 1309, Jas. Treuchtlinger,. was reserved
until the next meeting.
On motion by Mr. Gillispie, seconded by Mr. Grigonis, it was
RESOLVED that the minutes of the Southold Town Board of Appeals
dated January 8:,~ 1970, be approved as submitted.

On motion by Mr. Bergen, seconded by Mr. Hulse, it was
RESOLVED that the next regular meeting of the Southold Town
