Dear Mr. Orlowski:
With reference to your letter in connection with the
matter in caption, dated December 18, 1984, following a field
inspection of the premises and the reported consensus of the
Planning Board to request of my client access through my client's
parcel to the 30 acres to the North, reportedly owned by Island
Vineyards, Inc., with whom my client has no privity or present
or former relationship, I have obtained from Young & Young new
surveys dated February 28, 1985 of my client's parcel, which
depict the permanent improvements on the site, which would make
impossible any installation of a road bed from my client's
parcel to the parcel to the North.
The Farmers Home Administration committed the mortgage.
purchase funds here prior to our application for the subdivision
waiver and is now concerned with the delay that has occurred.
Is there any way we can move this matter more quickly,
particularly in view of the absence of any improvements, the fact
that I am simply trying to cure prior land transfers that did not
obtain your approval, and the fact that there is no residential
subdivision involved in any aspect of this? The greenhouses
at the site have been operated for years as.a greenhouse complex,
and my client is attempting to continue to do that, but will be
unable to do so if there is so much delay that the commitment
of mortgage funds is withdrawn, as a result of which the premises
may end up as an abandoned and useless collection of improvements.
May I hear from you promptly so that I can advise all
concerned.

I represent Kurt l~eiss Florist, inc., which is in the
process of acquiring a parcel of 5.263 acres situate on ~le
North side of Oregon Road approximately 500.83 feet Westerly
of the intersection of Oregon Road and Elijah Lane. The property
is under sale after an auction conducted ]3y the U.S. Department
of Agriculture Farmers H~e Administration. Kurt l';eiss Florist,
Inc. was the high bidder and is attempting to close title at
the present time.
The fom~er owner of the property was Valentine Girards,
Inc., ~ich owned not only the 5.26'3 acres improved by greenhouses
and a frame residence, but also a vacant contiguous parcel to the
~or~ of 30.637 acres, %~ich in a separate mortgage foreclosure
by a different r~ortgagee was sold some time ago to a company
known as Island Vineyards.
I am concerned whether the prior sale, which in effect
is a subdivision of ~he overall property, received a waiver of
subdivision from the Town of Southold Planning Board. If not,
I am requesting pern~ission to apply for such a waiver of sub-
division, since my client does not own all of the land and wishes
to purchase the only remaining available portion.
If we are to file for a minor subdivision, I am rec~est-
lng pe~aission to use a Young & YoUng Burvey that ~hows the
entirety of the premises, including both parcels, which is
dated May 17, 1982 and is drawn on a scale of 1 inch equalling
200 feet. There ere no contours on the survey, and there is no
key map.
The reason that X am requesting that waiver is that
the map is accurate even today end,' as I said before, my
client does not own and does not wish to own all of the remaining

AS per our previous correspondence, I am enclosing
the following in connection with the matter in caption.
1. 12 copies of survey of Young and Young dated
February 1, 1978.
2. Application for approval of plat.
3. Environmental Assessment Form Part I fully
completed.
4. My check to your order for $50.00.
5. Legal description of property.
Please be advised that the nature of this application
is as follows. The subject premises consisting of 35+ acres
situate north of Oregon Road at Mattituck have been ~eretofore
owned by Valentine Girards Inc. an~ operated on the southern
extremity as a geranium hot house business. The business
failed in 1978, as a result of which the Farmers Home
Administration took a deed in lieu of foreclosure on account of
substantial outstanding and unpaid mortgage balances in November,
1979. Thereafter the Farmers Home Administration conveyed title
to Island Vineyards for the northerlymost 30.637 acres to be
utilized for the growing of grapes and is about to convey a
deed to Russell Weiss to the southerly 5.263 acres for a continua-
tion of the existing plan nursery operation. As far as I know,
there are no grading changes to be ~nticipated, there are no
new roads proposed, and there are no new drainage structures or
alteration of existing structures proposed.

The line shown as the division line on the survey
between the northerly and southerly portions is the exact sub-
division line. The Farmers Home Administration was not aware
at the time of the prior conveyance of the subdivision regulations
of the Town of Southold and was advised by me of these regulations
to the extent that I am representing both the Farmers Home
Administration and Russell Weiss in connection with clearing
the title on the property and obtaining the Planning Board
approval for the subject sale.
Could you please advise me the extent of the delay
that you anticipate on this matter so that I can advise the
Farmers Home Administration, who would like to close this file
and title promptly.
Please note that the survey does not include the
contours, key map or other items as per our prior conversation.
I need the board's cooperation if it is at all possible with
respect to a waiver of the additional items of information,
in view of the particular facts at hand.
For your assistance I am enclosing a copy of my
letter of September 13, 1984 to Bennett Orlowski, Jr.

Dear Mr. Orlowski:
I represent Kurt Weiss Florist, Inc., which is in the
process of acquiring a parcel of 5.263 acres situate on the
North side of Oregon Road approximately 500.88 feet Westerly
of the intersection of Oregon Road and Elijah Lane. The property
is under sale after an auction conducted by the U.S. Department
of Agriculture Farmers Home Administration. Kurt Weiss Florist,
Inc. was the high bidder and is attempting to close title at
the present time.
The former owner of the property was Valentine Girards,
Inc., which owned not only the 5.263 acres improved by greenhouses
and a frame residence, but also a vacant contiguous parcel to the
North of 30.637 acres, which in a separate mortgage foreclosure
by a different mortgagee was sold some time ago to a company
known as Island Vineyards.
I am concerned whether the prior sale, which in effect
is a subdivision of the overall property, received a waiver of
subdivision from the Town of Southold Planning Board. If not,
I am requesting permission to apply for such a waiver of sub-
division, since my client does not own all of the land and wishes
to purchase the only remaining available portion.
If we are to file for a minor subdivision, I am request-
ing permission to use a Young & Young survey that shows the
entirety of the premises, including both parcels, which is O~
dated May 17, 1982 and is drawn on a scale of 1 inch equalling
200 feet. There are no contours on the survey, and there is no
key map. "
The reason that I am requesting that waiver is that
the map is accurate even today and, as I said before, my
client does not own and does not wish to own all of the remaining

acreage and, therefore, should candidly be excused from the
obligation to pay for a survey of 30.637 acres which he does
own and never will own.
