Issuance of Certificate of Occupancy for
Residential Home for Dr. Herrera (sp?) in the Sunbeau
Associates subdivision which lies north of Oregon Road
in Mattituck.

This is to confirm our discussions of earlier today whereby
we agreed that the following steps would be completed before a
Certificate of Occupancy could be issued:
Mr. H. or the subdivision owners, who are represented by
Paul Stewart, must submit the following three items to the
Planning Board office:
1. A detailed, signed estimate for the work to be done by
the road construction contractor. The estimate should
specify the type and amount of materials, and the cost of
materials and the labor.
2. A certified check made out to The Town of Southold for
the amount of the contractor's estimate.
3. A notarized letter signed by the writer of the check,
stating that the Town of Southold may negotiate the check
if the road work is.not completed to the Town's
satisfaction by June 21, 1991.
Upon receipt of these three items,
will issue a Certificate of Occupancy.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON JULY 5, 1989:
RESOLVED that the Town Board of the Town of Southold hereby authorizes
the reduction of the bond estimate of Sunbeau Associates from $169,155.00
to $99,150.00, all in accordance with the recommendation of the Southold
Town Planning Board and Sidney B. Bowne & Son, Consulting Engineers;
and be it further
RESOLVED that the Town Board accepts the current Letter of Credit in
the amount of $169,155.00, as requested by the property owner, as a bond
for roads and improvements in the Sunbeau Associates subdivision.

proposed road and is also readjusting some of the casting elevations
at the catch basins.
CORRAZZINI is on site fime grading the subbase in prearation for the
installation of the 4" stone base.
The stone blend base has been scheduled to start arriving on site tomorrow
4/5/91. Art foster informs me that they intend to use a recycled
stone and crushed concrete material for the 4" Base.

4" Stone Base - A mixture of 50% stone blend and 50% recycled and crushed
concrete/masonry is being delivered to the site. Three 40 YD trailer
trucks are delivering this material to the site with a round trip that
takes approximately two (2) hours.
The incoming blended base material looks good and is considered satisfactory
as a substitute for stone blend.
The base course is approximately 80% completed. This base has been placed
in a satisfactory manner.

The. installation of the 4"stone/recycled concrete & masonry base has been
gompleted. This base has a uniform depth of 4" and has been fine graded
and rolled. This material has compacted well and is considered to be
a very stable base. Some areas still require compaction such as
around the catch basin castings. This will have to be done by hand prior
to placement of the asphalt base.
The 4" base course has been installed satisfactorily.

Corrazzini has been on site since yesturday installing the asphalt base course.
The asphalt base has a minimum thickness 2½" and has been installed in an
acceptable manner.

THE EXISTING DRAINAGE MATERIAL(AT STATION 3+00)THAT WAS ENCOUNTERED AT
APPROXIMATELY TEN FEET DOWN WAS CONSIDERED MARGINAL. A TEST HOLE WAS MADE
TO A CONSIDERABLY DEEPER DEPTH AT THIS LOCATION. THE TEST HOLE INFORMATION
SUGGESTED THAT ANY FURTHER OR OVER EXCAVATION AT THIS LOCATION WOULD NOT
INCREASE THE OVERALL PERMIABILITY OF THE BASINS. THE REMAINING BASIN
LOCATIONS ENCOUNTERED GOOD QUALITY DRAINAGE MATERIAL.
ALL OF THE 18" CORRIGATED METAL PIPE (CMP) HAS BEEN INSTALLED IN AN ACCEPTABLE
MANNER.
ALL METAL CASTINGS ARE ON SITE BUT HAVE NOT YET BEEN INSTALLED. - THE CONTRACTOR
HAS INFORMED ME THAT HE WILL INSTALL 1'-0" EXTENSIONS BELOW THE CASTINGS
BY THE END OF THE DAY TODAY.
THE CONTRACTOR WILL ALSO PROVIDE A PLASTIC COVER FOR THESE CASTINGS DURING THE
WINTER MONTHS. THESE PLASTIC COVERS WILL BE REMOVED IN THE SPRING WHEN THE
VEGITATION IN THE SWALE AREA HAS GROWN. THIS WILL BE DONE TO PREVENT
SILT BUILD-UP AT THE BOTTOM OF THE BASINS.
THE REGHADED SUBBASE IS DRAININO VERY WELL AT THIS TIME EVEN UNDER HEAVY RAIN.

attain good clean sand and is mixing this material within the 25 foot
R.O.W. to create a stable subbase for road construction.
Excessive amounts of topsoil has been previously removed from the approved
R.O.W. - The removal of this ammount of topsoil has made it difficult
as well as uneconomical to follow the designed road profile as originally
shown on the plans.
An on site discussion with Mr. Art Foster (contractor), Mr. Paul Stewart
(developer) & myself produced the following change:
~ @ station 3+00 (+/-) a iow point has been produced - 4-8'~x8'd.
Catch Basins shall be installed here.
_ @ station 6+00 (+/-) a high point has been produced - No drainage
required here.
_ The remaining drainage shall be as originally designed with the
the exception of one (1) additional 8'~x8'd. basin located at the
Cul-De-Sac.

Dear Howard:
This letter pertains to your Survey No. 85-67 for
Russell Weiss, showing a site plan of premises at Oregon Road
under SCTM No. 1000-100-02-005.
Russell Weiss wishes to acquire a 10 acre subdivided
lot immediately contiguous and to the north of the subject premi-
ses. That lot is Lot No. 4 on a subdivision map of Sunbeau
Associates prepared by Van Tuyl dated January 8, 1987, revised
through June 16, 1988 and approved by the Southold Planning Board
on July 27, 1988. As an incident of the acquisition of Lot No. 4
of Sunbeau, Russell Weiss and Sunbeau together intend to amend
the Sunbeau map so as to shorten a road running from Soundview
Drive on the North in a southerly direction through Lots Nos.
1, 2 and 3 of the Sunbeau map so that that road is shortened and
instead terminates at the Northerly end of Lot No. 3 instead of
as now drawn, at the northerly end of Lot No. 4. Understandably,
in order to provide access to Lot No. 4, Russell Weiss would have
to amend your site plan No. 85-67 and the prior set-off map pre-
pared by your office under No. 72-282, dated May 17, 1972, revised
through February 1, 1978, and approved by the Planning Board on
April 12, 1985 so as to establish a 280-A access along the Easterly
perimeter of the 5.263 acre greenhouse complex on your map No.
85-67. The location of the proposed 280-A access, twenty-five
(25) feet wide, if possible, or greater width, would be along the
Easterly side of your No. 85-67. When you see No. 85-67, you
will see that there are greenhouses to within 11.5 feet of the
Easterly side, and you should therefore draw the twenty-five (25)
foot wide access strip right through the greenhouses up to Lot
No. 4 of Sunbeau, leaving the cul de sac with a diameter of one-
hundred (100) feet, completely within the Southeasterly corner
of Lot NO. 4 of Sunbeau. I will then provide the Town with a
covenant which will restrict the use of Lot No. 4 to uses asso-
ciated with No. 85-67 and allow the Town to condition a

residential building permit on Lot No. 4 on a mini-site plan
review to control the construction of the 280-A access, if and
when Lot No. 4 is used for residential purposes.
I do not have a copy of the Sunbeau map, but I am
writing to Rod Van Tuyl to obtain a copy in order for you to have
a document to work from.
I will need sufficient copies of this map to file for a
subdivision modification before the Southold Planning Board and
for a 280-A variance before the Southold Zoning Board.
One concern that I have is that the present area of
Russell Weiss' Lot at 5.263 acres not be less than 5.000 acres as
a result of the addition of the 280-A access strip to Lot No. 4 on
Sunbeau. If this creates a problem, let me know.
This letter is a mouthful, and I will therefore be
pleased to answer any questions you may have.

I represent Russell Weiss who is purchasing Lot No. 4
of the Map of Sunbeau Associates drawn by your office between
January 8, 1987 through June 16, 1988 and approved as a subdivision
by the Southold Planning Board on JUly 27, 1988.
Howard Young drew a site plan in 1985 for Russell Weiss
with respect to a contiguous parcel immediately south of Lot No. 4
on Sunbeau and fronting on Oregon Road.
The plan is to acquire Lot No. 4 of Sunbeau for Use
with the southerly parcel on Oregon Road and to combine the par-
cels in terms of use as a greenhouse complex.
Could you, on behalf of Bonnie Bauman and Paul
of Sunbeau Associates at 1065 Hyatt Road, Southold, N.Y.,
an amendment of the Sunbeau Map as follows:

The Planning Board has again reviewed your request for
amendments to the approved map of Sunbeau Associates.
The following is a preliminary list of what will be
necessary to make the changes.
1. The current Kurt Weiss map, deed, etc., must be
amended to allow for access to the 10 acre lot which is to
be acquired from the Sunbeau subdivision. The 10 acre lot
must be shown as a flag lot with at least 25 feet of
frontage on Oregon Road. Kurt Weiss must go before the
Planning Board for an amended map. The map must show both
parcels involved, that is, the Weiss property and the 10
acre parcel from Sunbeau.
2. The previously approved Sunbeau map must be revised to
show the revised location of the road. This will also have
to go before the Planning Board for an amended map. The map
should also show the 10 acre parcel with access off of
Oregon Road.
3. A revised bond estimate will have to be drawn up for the
Sunbeau proposal.
4. A Declaration of Covenants and Restrictions prohibiting
further subdivision in ~erpetuity of the 10 acre parcel
will have to be reviewed by the Planning Board and, upon
their approval of the document, filed with the Suffolk
County Clerk. The amended map of Kurt Weiss must note
that the above m~ntioned declaration was filed.
Please note that the above is only a preliminary listing of
what must be done. A meeting with the Sunbeau Principals,
Kurt Weiss and the Planning staff should be held to go over
the process involved before any maps are revised. Please contact
the office to set up an appointment.

Re: Oregon Road Property "Sunbow Associates"
Gentlemen:
We wish to submit for your review an alternate use for the southerly ten acre
tract of the above minor subdivision. The current 30 acre property of Sunbow has
been subdivided into four lots; two of five acres and two of ten acres. One ten
acre parcel adjoins our current greenhouse operation on the northern border. The
parcel is virtually rectangular as is our parcel. The approximate dtmensionof
the questioned parcel is 500 feet east to west and 900 feet north to south.

We would like to expand our greenhouse operation per the enclosed sketch
and keep it isolated from any residential development. Additionally we would
put in a small recharge area to contain rain water run off on our property.
Access to the ten acre property would be via a right of way across our own
property.
We believe the greenhouse development which would take several years would
be neat and orderly and not detract from the surrounding area.
