Ehlers last revised June 1, 2004 is beyond Article 25 (Tidal Wetlands Act)jurisdiction. Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no permit is required. Be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may rasult from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier, or hale bay berm. Please note that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from other agencies or local municipalities. Sincerely, V?. Orr) Property Location: 1300 Leeton Drive, Southold; CTM 56-2-1. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 16,227 sq. ft. is a vacant lot with 100 ft. frontage along the north side of Leeton Drive, 100.09 feet along the average high water mark of the Long Island Sound, 160.12 feet along the westerly lot line, and 164.42 feet along the easterly lot line. BASIS OF APPLICATION: Building Department's March 3, 2004, Notice of Disapproval, citing Code Section 100-244 in its denial of a building permit application concerning a proposed new dwelling at less than 35 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at Which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant's original application requested a new dwelling with an attached 4 ft. by 24 ft. front porch that would have created a 23 ft. front yard setback, at its closest point, as shown on the March 10, 2003 survey prepared by John C. Ehlers, L.S. ADDITIONAL INFORMATION:AMENDED RELIEF: During the May 20, 2004 public hearing, the applicant voluntarily offered to eliminate the front porch and move the dwelling back 6 feet, Which would increase the requested setback from 23 feet to 33 feet, a two-foot deviation from the 35 ft. code requirement. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to construct a new dwelling and this minor, two foot variance will not appear out-of-place with neighboring properties. . Page 2—June 3,2004 LSA No.5519—Paul Odick CTM 1000-58-2-1 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because . the applicant is restricted by environmental regulations from encroaching any closer to the sound-front rear yard area. Without a variance, the applicant will not be able to construct a new house. 3. The alternate variance granted herein is not substantial and represents a two-foot reduction in the code requirement. 4. The alleged difficulty was not self-created and is due to the environmental constraints pf the property. 5. No evidence has been submitted to suggest that the relief granted will have an adverse Ijnpact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to ena4le the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Tortora, seconded by Member Goehringer, and duly carried, to DENY the relief requested for a 23 ft. front yard setback, and to GRANT an alternative variance for a 33 ft, minimum setback, at its closest point to the front property line, as confirmed at the May 20, 2004 public hearing by the applicant. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Orlando, Goehringer, Tortora, and Dinizio. This Resolution was duly adopted (5-0).,- Ruth (D.
