No. 5404—William and Mary DeBruin ' Property Location: 2570 Pine Tree Road, Cutchogue, CTM #104-2-13. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's parcel consists of 21,418 sq. ft. and is shown on the Map of Nassau Farms as Lot #38 and the southeasterly portion of Lot #37. The property is improved by a 1 Y2 story frame home 84+- feet from Pine Tree Road, 30+- feet from the northerly side property line, and 12 feet from the south side property line, as shown on the August 24, 1971 survey prepared by Van Tuyl & Son, L.S. BASIS OF APPLICATION: Building Department's May 19, 2003 Notice of Disapproval, amended June 30, 2003, citing Section 100-242A (ref. 100-244B), in its denial of a building permit to construct additions/alterations to the existing single family dwelling with a single side yard setback at less than 15 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 23, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to add a second-story addition over the footprint of the existing single-family dwelling as shown on the plot plan prepared by Donald G. Feiler, R.A. dated 10/2/02, revised 7/7/03. The setbacks are requesting at 13+- feet from the southerly side property line, which is a greater setback than the 12 ft. existing for the lower floor of the dwelling. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The applicant has proposed adding several dormer windows to the second floor of this existing single-family residence, with a non-conforming side yard setback, in Cutchogue. The granting of this variance will not produce an undesirable change in the Page 2—October 23,2003 Appl. No.5404—W. DeBruin CTM 104-2-13 character of the neighborhood, or be a detriment to nearby properties because the alterations to the building are minor without negative effects on this property or on the surrounding neighborhood properties. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance, because this building is constrained by a pre-existing, non-conforming, side yard setback of+-12 feet. 3. The requested variance is not substantial because the proposed dormers will be recessed one to two feet back from the existing building footprint. The existing combined side yard setback of +40 feet will not be changed. The total lot coverage after new construction will remain conforming at less than 20 percent. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because the existing single side yard setback of +-12 feet will remain in tact, and the proposed setback of new construction for the dormer will be approximately 13 feet. There are no identified environmentally sensitive areas on this property. 5. The difficulty for the applicant is not self-created because this structure already has an existing 12+-ft. side yard setback, and this will not change. 6. The relief granted is the minimum determined necessary for this applicant to enjoy the benefit of second-story dormers, while at the same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the plot plan prepared by Donald G. Feiler, R.A. dated 10/2/02, revised 7/7/03.
