Dear Mr. Raynor:
The following took place at a meeting of the Southold Town
Planning Board on Monday, January 10, 1994:
The final public hearing, which was held at 7:30 P.M. was closed.
The following resolution was adopted:
WHEREAS, William F. and Viola DeLuca are the owners of the
property known and designated as SCTM# 1000-99-2-18 located at
west side of Breakwater (Luthers) Road in Mattituck; and
WHEREAS, this minor subdivision to be known as the minor
subdivision for William F. and Viola DeLuca, is for 2 lots
2.468 acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself lead agency and issued a Negative Declaration on
September 30, 1991; and
WHEREAS, a variance was granted by the Zoning Board of Appeals
on June 7, 1991: and
WHEREAS, a final public hearing was closed on Aaid application
at Town Hall, Southold, New York, on January 10, 1994; and

WHEREAS, all the requirements of the Subdivision Regulations of
the Town of Southold have been met; and, be it therefore
RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated
November 5, 1993.
Enclosed please find a copy of the map which was endorsed by the
Chairman. The mylar maps, which were also endorsed by the
Chairman, must be picked up at this office and filed in the
office of the County Clerk. Any plat not so filed or recorded
within sixty (60) days of the date of final approval, shall
become null and void.
If you have any questions regarding the above, please do not
hesitate to contact this office.

the Southold Town Planning Board to order. The first order of business is
the setting of the next Planning Board meeting. Board to set Monday, Jan-
uary 31, 1994 at 7:30 P.M. at the Southold Town Hall, Main Road, Southold
as the time and place for the next regular Planning Board meeting.

Henry Raynor: Good evening Mr. Chairman and members of the Board. My
name is Henry Raynor, representing Bill and Viola DeLuca. As you are
all aware, this is a 2 lot minor subdivision in Mattituck and has already
received a Negative Declaration from your Board. In July of ]991 we were
granted sketch plan approval on what you Bave before you. And prior to
that, in June of ]99]., the ~oning Board of Appeals granted a variance on
this property. To date, I believe all the filing fees for the Town, as
well as Park and Playground fees, the Town is in receipt of. We received
the final approval from the Suffolk County Department of Health Services
last year in 1993. I believe the map you have before you is in conform--
ity with section 106 of the Town Code. If there are any questions I
would be happy to answer them, and I would request this final map be app-
roved by the Board. Thank you for your consideration.

WHEREAS, the Southold Town Planning Board, pursuant to the State Environ-
mental Quality Review Act, (Article 8), Part 617, declared itself lead
agency, and issued a Negative Declaration on September 30, 1991; and
WHEREAS, a variance was granted by the Zoning Board of Appeals on on June
7, ]99]; and
WHEREAS, a final public hearing was closed on said application at Town
Hal, Southold, New York, on January 10, 1994; and

Town Planning Board at a meeting held on Monday, July 15, 1991.
//~ BE IT RESOLVED that the Southold Town Planning Board start
e coordination process on this unlisted action.
BE IT RESOLVED that the Southold Town Planning Board grant
sketch approval on the map dated July 16, 1989 and submitted on
January 24, 1991.
Sketch plan approval is conditional upon submission of
final maps within six months of the date of sketch approval,
unless an extension of time is requested by the applicant, and
granted by the Planning Board.
Please note that five (5) paper prints and two (2) mylars
of the final map, containing a current stamp of Health
Department approval, must be submitted before a final public
hearing will be set.

ACTION OF THE BOARD OF APPEALS
Upon Application of WILLIAM AND VIOLA DELUCA. Variances
to the Zoning Ordinance, Article III, Section 100-32 for
approval of insufficient lot area, depth and width of two
parcels in this proposed division of land located along the west
side of Luthers (Breakwater) Road, Mattituck; County Tax Map
No. 1000-99-2-18.
WHEREAS, a public hearing was held on April 30, 1991, and
all those who desired to be heard were heard and their testimony
recorded; and
WHEREAS, the Board has carefully considered all testimony
and docUmentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its Present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. This is an application concerning a 2.468-acre parcel
situated in the R-80 Residence District, located along the
westerly side of Luther's Road in the Hamlet of Mattituck, Town
of Southold, and more particularly identified on the Suffolk
County Tax Maps as District 1000, Section 99, Block 2, Lot 18.
2. The subject premises is presently improved with a ~
single-family dwelling situated approximately 102 feet from the
front property line along Luther's Road, approximately 23 feet
from the proposed division line to the south, and 79+ feet from
the northerly (side) p~operty line. -
3. By this variance application, appellants are requesting
(a) for proposed Lot #1, with the dwelling structure,
an area of 53,758 sq. ft., lot depth of 342.83 feet and lot
width of 156+- feet; and

(b) for proposed Lot #2, an area of 53,768 sq. ft.,
lot depth of 337.17 feet and lot width of 142+- feet, all as
shown on the set-off map prepared by Roderick VanTuyl, P.C.
surveyed July 16, 1987.
4. Column iii of the Bulk Schedule, and Article III,
Section 100-32C of the zoning code regulations (as amended
January 9, 1989) requires a minimum lot area of 80,000 square
feet per lot and minimum width of 175 feet.
5. The percentages of relief sought by this application
are as follows:
(a) proposed northerly lot,
area and 10.5% (19 feet)in lot width
(b) proposed southerly lot,
area and 33' lot width ;

6. In considering this application, the Board also finds
and determines:
(a) the relief as granted is not substantial in
relation to lots existing in the vicinity on this same block;
(b) the practical difficulties claimed are sufficient
to warrant a grant of this variance;
(c) there will be no substantial change in the
character of the neighborhood and a precedent would not be set
for the following reasons:
(1)
to the west is the Major Subdivision of
Captain Kidd's Estates which consists of
lots substantially smaller than the subject
proposal and which may not be further
divided;
(2)
the property to the north is a large tract
of land owned and operated as the "Mattituck
Park District," which land is not suitable
for residential development or subdivision
since: a) it has been a public entity
providing beach and park facilities to
Mattituck residents, and b) the
topography of the land is sloping with bluff
areas subjected to erosion problems, and
sensitive beach and other environmentally
sensitive areas;

(d) the difficulties cannot be obviated by some
method feasible to the appellant to pursue, other than a
variance;
(f) that the property to the south consists of an
area of approximately 61,000 sq. ft. which is not suitable for
further subdivision or other increased dwelling density under
the bulk schedule restrictions;
(g) that the properties to the east are located in
different zone districts, i.e. R-40 and M-II, and the grant of
this variance for the appellants is not and will not set a
precedent for other zone districts (across the street or within
other blocks) which may be near this block;
(h) that water is available to homes in this
residential area ~for hook-up through the Suffolk County Water
Authority;
(i) that in view of the manner in which the
difficulties arose, and in considering all the above factors,
the interests of justice will be served by granting the
variance, as conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT the relief as requested (and noted in
paragraph ~3, supra), as applied in the Matter of the
Application of WILLIAM AND VIOLA DeLUCA under Appl. No. 4012.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis and Villa. (Member Dinizio was absent.) This
resolution was duly adopted.

The Planning Board is not in favor of granting the variance for
the subdivision of the. 2.6 acre DeLuca parcel as it will result
in two undersized lots in this two acre zone. (see attached
zoning map).
It appears that the R-40 designation was applied to those areas
which were already subdivided and developed predominately at the
one acre or half acre density. The subject parcel and the
adjacent parcels to the north and south are zoned R-80. The
Planning Board feels that granting this variance will set the
stage for down zoning both of the adjacent parcels to R-40.
Consequently it recommends denial of the variance.
