The following action was taken by the Southold Town
Planning Board at the regular meeting of May 7, 1984.
RESOLVED that the Southold Town Planning Board accept
Inspector John Davis' report No. 356 with regard to
the approval of the access road within the minor
subdivision of Dr. Meyer Rosenberg located at peconic.
The Planning Board dOESn't request compliance with
the recommendation for a stop sign.
Please excuse for our delay in responding. We were
waiting for a clarification from the Town Attorney
as to our jurisdication is requesting a stop sign
as stated in the report.

Re: Rosenberg Subdivision - Access Road
Dear Mr. Orlowski:
You recently requested my opinion with respect to the Planning Board's
wish to compel the owner of the subdivision to install a stop sign at the
end of the access road.
As near as I can ascertain, this access road appears to be a private
road, and, accordingly, the Vehicle and Traffic Law does not apply to
such road and, therefore, the Planning Board cannot require traffic
signs which will have no legality.

AT PECONIC - ACCESS ROAD
COMMENTS:
I made an inspection of the existing access road in the above
subdivision on 4/18/84 as follows,
The road is 16 ft. in width (from several measurements) and is
curbed on both sides with a 4" concrete curb. It runs to the
Rosenburg residence (See Map) where there is a turnaround and
parking area.
The road between curbs is a crowned macadam type of construction
with a non-skid surface.
The road from end to end is fairly level and in good condition
as are the curbs. I can see no reason for any road improvement.
A stop sign could be placed at Indian Neck Road for exiting traffic.
Approval of the existing road is recommended.

letter addressed to the Board of Appeals, in which we
rescinded our right to the variance previously granted
to us by the Board of Appeals.

Gentlemen:
since professional commitments prevent me from being present
at your meeting on October 10th, may I present the following
facts in support of our application for the Minisubdivision:
1. We originally made application for a Minisubdivision of
our property into four lots in keeping with your regulations.
2. Subsequently I became very ill, underwent cardiac surgery
and decided to make application for a variance to build our
own home, a much smaller one than the present house we occupy.
3. We were granted a variance by the Board of Appeals and
thereafter changed the building lines on one side of the
driveway from two lots to one large lot of close to three acres.
4. At the present time, as you can note from the map submitted
by Mr. Van Tuyl, there are four lots:
a) The house with close to two acres.
b) The variance with over one acre.
c) One lot of close to two acres.
d) One lot of close to three acres.
The only change made was eliminating the line between the two
lots on one side of the driveway and incorporating the variance
as another lot.
We therefore request that our application for the Minisubdivision
as submitted on the map in your possession be granted. We wish to
thank you for your cooperation in considering our application
and beg your indulgence when personal health problems sometimes
make it necessary to intervene in plans originally drawn.

The following action was taken by the Southold Town
Planning Board at a regular meeting held May 23, 1977.
RESOLVED to grant sketch plan approval to the map of
Dr. Meyer Rosenberg, property located at Indian Neck, Peconic,
said map amended May 16, 1977.
I will now need 6 copies of the final map, application
completed in duplicate, fee in the amount of $40, a legal
description of the property. When I have received this, I
will set it up for a publiC hearing. I am also enclosing
a sample of the covenants that the Planning Board will
require you to have filed in the Suffolk County Clerk's
Office.

Your minor subdivision of property at Indian Neck Lane
was discussed at the regular meeting of the Southold Town
Planning Board which was held May 2, 1977.
The consensus of the board was to approve the combining
of lots 1 and 3.
The right-of-way could be maintained at the 16 foot
width but a dotted line on the map should show 25 feet.
The frontage and driveways should be from the right-of-way
and this should be noted on the map, also.
