SOUTHOLD TOWN BOARD OF APPEALS
April 2, 1970
A regular meeting of the Southold Town Board of Appeals was
held at 7:30 P.M~i Thursday, April 2, 1970,. at the Town Office,
Main Road, Southold,. New York.
There were present: Messrs: Robert Wo Gillispie, Jr., Chairman;
Robert Bergen; Charles Grigonis, Jr.
Absent: Messrs: Fred Hulse, Jr.; Serge Doyen, Jr.
Also present: Howard Terry~ Building Inspector
Discussion was held on Appeal No. 1317 Edwin H. King, Main
Road, Orienta N.Y.~ The Chairman reported on his conference with
'the Town Counsel in reference to this matter.
After investigation and inspection the Board finds that the
applicant requests approval of access over private right-of-way
in accordance with the State of New York Town Law, Section 280A.

The Board finds that the applicant was denied a minor subdivision
in this area~ by the Planning Board~ because he owns such a large
parcel of land and they felt that he should apply for a major
subdivision. It is the feeling of this Board that this application
is an obvious attempt to defeat the purpose of the subdivision
regulations~ There is indication that he has already subdivided
land therea he has sold several pieces and given one away° The
Town Counsel does not think that Section 280A~ Sub. Se~III
should be used to require a person to file a subdivision° It is
also the Town Counsel's opinion that it is doubtful whether or
not the Supreme Court would support a denial on the part of this
Board. Howevera the Board is going to suggest a condition of
granting this access. This will be the last approval of access
that this Board will grant for access on this road.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not change
the character of the neighborhood and will observe the spirit
of the Ordinance.
On motion by Mro Gillispie, seconded by Mr. Grigonis, it was
RESOLVED Edwin H. King~ Main Roada Orient~ New York, be
GRANTED approval of access over private right-of-way as applied
for° Location of property: private right-of-way off south side
of Main Road, Orient~ New York. This approval of access is
granted subject to the following condition:
1. This will be the last approval of access that this
Board will grant for access on this road°

the majority of the lots in the neighborhood are 75ft. a but these
were 100ft. lots.
HENRY MAZZAFERRO, JR.: This was originally purchased as
2 lots~ each 150fto deep with 100ft. frontage each. Then Wilkinson,
to the east of the property asked my father if he would sell him
20fto~ so my father sold off 20ft. which left 180 feet°

After investigation and inspection ~the Board finds that the
applicant requests permission to divide property and set off lot
with less than 100ft. frontage. The applicant is the'owner of a
parcel of land 150ft. deep with a road frontage of 180ftyS, which
he purchased as 2 lots prior to the Zoning Ordinance. The applicant
proposes to divide property and set off one lot with 80ft. frontage.
Since the majority of the lots in this area have 75ft. frontage~ the
Board feels that this division will be in keeping with the character
of the neighborhood.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardsh'ip;
the hardship created is unique and would hot be shared by all
properties alike in the immediate vicinitM of this proper~y
and in the same use diatrict; and the variance will no% cnange

RUSSELL MUFF: Yes, I am appearing on behalf of the applicant°
My name is Russell Muff, I operate the marina.
THE CHAIRMAN: What does he propose to put on the sign?
RUSSELL MUFF: I donSt really know. He expected to be here
himself, but because of the bad weather, he called and asked me
if I would come. I presume it is merely "Chappy~'s Restaurant,
2ndright turn", or something to that effect. Is there any size
he has to comply with?
THE CHAIRMAN: 4s x 6~,. the standard size for directional
signs. There should be as little writing on it as possible. The
directional signs that we approve cannot have advertising on them,
they must be strictly directional. Incidently~ there has been
only one directionalwall sign to which we granted approval~ that
I can think of. We prefer to have ~ou erect your own sign to be
maintained by yourself. A free standing ground signa but adjacent

to the building. Would this be satisfactory?
RUSSELL MUFF: Yes~ I think so.

Board has approved in the past for giving directions to restaurants,

After investigation and inspection the Board finds that the
applicant requests permission to erect an off premises directional
sign on the property of Malcolm Po Rackett. Letter of permission
from the property owner is contained in the file. This sign shall
be ~4ft. x 6ft. free standing ground sign adjacent to the building

finds that this is in line with the Board's policy for granting
directional signs~ and this ~ign is in the interest of the
travelling public.

THE CHAIRMAN: This is the one where there is a sharp angle
in the back of the lot~ it is an acute angle° The sign should be
at least 35 fro back from the point. How does he propose to put
a double faced sign on here?
HOWARD TERRY~ BUILDING INSPECTOR: The sign runs north and
south~ you can see it when you go east and west.
MR2 BERGEN: The sign will be more or less parallel to Bergen
Avenue and at a right angle to Sound Avenue.
THE CHAIRMAN: The sign should t~setback at least 10 or 15
feet off the east line (Bergen Avenue) and 35 feet from Sound
Avenue. I think he is entitled to put all this lettering on the
sign~ but it will be hard to read.

Marina Shipyards. Inc. This sign shall be subject to all the
usual sign regulations governing signs in the Town of Southold.
It is the opinion of the Board that this sign is in the interest

LLOYD TERRY: Yes,. I am Lloyd Terry.
THE CHAIRMAN: Do I understand from talking to Mro Howard Terry,
Building Inspector~ that you ~ish to have the permit renewed for the
camp exactly the same as it was the end of last year~ is that correct?
LLOYD TERRY: Yes.
THE CHAIRMAN: Other than the improvements that may have had to
be made because of the Board of Health° Is there anything you would
like to add to this?
TERRY: No~ I don~t think so°
THE CHAIRMA~I: How many people do you have there?
LLOYD TERRY: Fourteen (14)

permit yet?

E~ARD LATHAM: My name is Edward Latham~. I live next door to
the camp. I came to the beaming last year~ I guess I have to come
every year because I never know when he is going to put some more
buildings in. I don~'t favor having any more buildings next door
to me.
THE CHAIRMAn,: How many buildings do you have there now~ Lloyd?
LLOYD TERRY: There are five (5) buildings nowa due to the
demands of the Board of Health. There were three (3) but the Board
of Health required five (5) because of the cubic footage. Not that
I wanted to have any morea but I had to.
EDWARD LATHAM: As I said last year~ thougha~ it burned me up to
have him move buildings from along side of his own house and put them
up along side of my house to make a labor camp. We have zoning that
says that a camp should be no closer to somebody elses house thatnit
is to your own house.
T.TOYD TERRY: It is unfortunate~ I don~'t like to ~ut these
buildings like this. I have to follow the Board of Health regulations.
The Board of Health has told me that I have the nicest camp around°
THE CHAIRMAN: I am sure that everybody agrees with Ed Lathams
that a labor camp is a neccessary adjutant to a farm operation~.
particularly today~, it is far different from the old family farms~
Without it~ there would be no agriculture. There are sever~ other
cases where a farm labor camp is established closer to other" p~oples
residences that the residence of the owner. We are going over this
in the original zoning ordinance~ that was a suggestion that I
personally came up with, ~hat if a person is willing to put a labor
camp closer to his own house than to his neighbors house. A lot of
times they put them way down in the w~ods or the swampa as far away

from anybody as possible, but there are cases where that was not
feasible. I think~we have another one coming up,
LLOYD TERRY: Yes~ I was going to say that I am not the only
one in this predictamento In fact I think Ed Lathamand Henry
Moisa are about the only ones 'that didn't have 'to apply for a
special permit. It is certainly true~ that every time you move
your camp,~ you can~'t pick up your residence and move it too~
there are cesspools and everything else. I have gone to consider-
able expense to improve the camp, how much can you do with a
limited income? I have been giving some thought to moving my
residence back to where I use to live and that would eliminate
this.
THE CHAIRMAN: But that wouldn"t help Ed out at all.
EDWARD LATHAM: I have no desire to have you stop this man
from having a camp, he needs it. I just came here to make ~re
that he doesn~'t move any more buildings in there.
LLOYD TERRY: It is an unfortunate situation~ but I try to
do the best I can.
THE CHAIRMAN: Are there any further questions?

After investigation and inspection the Board finds that the
applicant requests permission to renew a farm labor camp permits
granted April 24~ 1969~ for the coming year. The Board finds
that there have been no changes in the camp during the past year~.
except for the improvements required by the Board of Health° The
applicant has improved the buildings and made application to the
Health Dept, for his annual permit, There will be no changes in
the camp other than those previously approved by the Board of
Appeals, The Board finds that this labor camp is a necessary
adjutant to the appticant~s farm operation,

THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
ROBERT MELROSE: Yes~ my name is Robert Melrosea I am the
owner of the property. The property line on the east side of
the property~ on some of the original maps shows about 120-
125 feet~ actuallya the markers ~hich Van Tuyl laid out show
about 104 feet of'usuable property on the east side.
THE CHAIRMAn,: It says here~ 120 feet.
ROBERT MELROSE: Yes~ but it is actually 104 feet. 120 feet
would be right down into the water° I have located the most east-
erly end of the house exactly 20 feet back from that marker. The
usuable property is divided off in a ratio~, about 35% of the
usuable property is on the Sterling Creek sidea and 40% of it is
on 'the road side. The house I would say is~. in actual numbers~
35.1% and 40.8% on the distribution of the property~ front and
back. The house is very well centered on the property° ~It is
impossible to meet this average setback line and build a house
to keep in with the character of the neighborhood. Another
point of consideration to me is that I am anxious ~to have a
cellar in the house and when we start to excavate we realize
that we are going to have a problem. The edge of the cellar
will be kight in ~the corner of the filled land~ so if I go any
further towards Sterling Creek~ I will have to excavate filled
land.

After investigation and inspection the Board finds that the
applicant requests permission to build new one family dwelling
with reduced front irard setback. The applicant is the owner
of a lot on Sterling Creek with 104 ft. depth. It would be
impossible to meet the average setback and build a house in
keeping with the character of the neighborhood. The Board
is in agreement with the reasoning of the applicant.
The Board finds thatsstrict application of the Ordinance
