Southold Town Planning Board for final approval of their plat known
as 'Peconic Bay Oaks at Indian Neck.Peconic", and
WHEREAS the Southold Town Superintendent of Highways has
inspectedthe plat and found the highways in satisfactory, con
dition for reasonable access and in compliance with the Highway
Specifications of the Town of;Southold, and his report is hereby
approved by the Planning Board; and
WHEREAS the Southold Town Planning Board, pursuant to due
notice thereof, held a. public hearing on the matter of approval

of the plat at which time all interested persons were ,given' an
opportunity to be heard,. and
WHEREAS the Southold Town Planning Board waives the provision
in the Rules and Regulations for the Subdivision of Land requiring
park and playground area or cash equivalent;

JOHN DOE and MARY DOE, his wife, both residing at Main Street

WITNESSETH,that the party of the first part, in consideration of
Ten---dollars,
lawful money of the United States, and other good and valuable consideration paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being ixxhe at Indian Neck, in the Hamlet of Peconic, Town of
Southold, Suffolk, County, New York, known and designated as Lot
Number "X" as shown on a certain map entitled "Map of Peconic Bay
Oaks" made by Otto W. Van Tuyl & Son, Licensed Surveyors, Greenport,
New York, and filed in the Office of the Clerk of the County of
Suffolk on July 8, 1961 as Map No. XXXX.
Subject to the following Covenants and Restrictions:
1. That only one single family dwelling house for residential
purposes containing at least 1000 square feet of living area,
and a private garage for family use only, shall be built on
these premises. No trailer, tents or camping shall be permitted,
and no occupancy of any such dwelling house shall be permitted
until the outside and the roof shall be fully and completely
finished and painted.
2. No traae , craft, business, manufacture, industry, commerce or
profession (medical and dental professions permitted) includ-
ing hotels, boarding and rooming houses, shall be conducted on
said premises
No nuisances nor noises of any kind unwholesome and offensive
to the neighborhood, shall be permitted to exist on said prem-
ises, nor shall any accumulation of rubbish, garbage, junk or
materials of any kind be permitted to remain on said premises .
No advertising signs, billboards or other sign devices shall
be permitted on any of said lots, excepting a developer ' s sign
or a "for sale" or "for rent" sign of reasonable dimensions .
Ido fowl, poultry, animals or livestock shall be kept on said
premises except domestic household pets.
3. Said premises shall be subject to electric, electric light,
gas , water, and telephone easements on the surface or below
the surface along the roadway or lane adjacent to said prem-
ises .
4. No sand, earth or sod shall be removed from the premises, or
excavation be allowed to remain open thereon, except as may
be necessary during building construction periods.
No fence shall be erected or maintained on any lot over four
feet in height. Fences shall be picket, ranch type or privet
only.
5. No title in and to the bed of any private road on said tract
of land bordering said premises is herein conveyed to the
grantee. The grantor retains the said title, and also the
right to dedicate and convey the said title to the Town of
Southold, or in his sole discretion, to convey said title to
an association of owners of lots of said tract.
6. The grantee herein agrees to pay a beach maintenance charge
annually, not to exceed $25.00, to the grantor, his heirs or
assigns, for the upkeep of the beach area and the approach to
it, as shown in said map. In the event the grantor, his heirs
or assigns, conveys said approach road and beach area to an
association of the then owners of lots as shown on said map,
said association shall thereupon become the obligee of this
covenant.
7. The said covenants and restrictions are hereby declared to be
covenants and restrictions attached to and running with the
land, and shall expire of January 1, 1961.
No interest in the parcel marked "Reserved" is hereby conveyed.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,

successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
