Mr. Young: I spoke to Larry today and it seemed to meet his
recommendations.
Mr. Wickham: Mr. Piscitello met with the Town Attorney, our
Engineer, myself, the vice-chairman, Mr. Rap-nor, in the office
of the Town Superintendent of Highways and we went over this
and Larry agreed with Young to work it out the best possible
way. It was Alden Young that was there.
Mr. Wickham declared the hearing closed.
Mr. Wickham: The provisions are that you will submit a final
map and we will act on it just as soon as we can. Usually,
it takes longer to get the bond set up so usually we approve
subject to notice received in this office that the Town Board
has accepted and has in their possession the bond. We have
to receive notification from the Town Clerk that the bond is
in their hands before we can sign the map. We will send it
to the County immediately upon receipt of it.
On motion made by Mr. Raynor, seconded by Mr. Grebe,
it was
RESOLVED to grant approval of the preliminary map of
the subdivision known as "Highland Estates" dated March 27,
1975 and including overlay 4B dated March 28, 1975.

DECLARATION made this ~- day of February, 1975, by Flora S.
Luce, residing at 505 Bay Avenue, Cutchogue, New York, and George
L. Penny, residing at New Suffolk Avenue, Mattituck, New York,
hereinafter called the "Owner";
WHEREAS, the Owner has title to certain lands situate, lying
and being at Pine Tree Road, Cutchogue, New York, in the Town of
Southold, County of Suffolk and State of New York, said lands
hereinafter being more particularly described; and
WHEREAS, it is the Owner's intention that the aforesaid
lands be subdivided into a minor subdivision consisting of not
more than four residential lots;
NOW, THEREFORE, the following described lands shall be re-
stricted as hereinafter set forth:
(DESCRIPTION) as set forth on map of minor subdivision drawn
up by Roderick Van Tuyl on January 30, 1975.
DECLARANT does hereby warrant, covenant and represent that
on approval of the aforesaid described lands as a minor subdivi-
sion by the Planning Board of the Town of Southold, no further
application will be made to that Board or to any other Board in
the Town of Southold to further subdivide any of the lots set
forth in said minor subdivision~
DECLARANT does hereby further warrant, covenant and repre-
sent that the aforesaid described lands within the minor subdivi-
sion cannot be subdivided into more than four lots and that each
such lot shall comprise an area of not less than one acre.
DECLARANT does hereby further warrant, covenant and repre-
sent that the foregoing restrictions and agreements shall bind
the undersigned, his heirs, successors and assigns, and any and
all person or persons who shall succeed to the ownership of any
of the lots shown on said aforedescribed premises in said minor
subdivision by transfer or otherwise.

adjoining your property, shown as on the Suffolk County Tax Map as fi 1000-
98-1-7.18 is an extension of Pine Tree Road. According to Town records, the
Parcel designated as 98-1-7. 18 is a right of way for several building lots in the
vicinity. It also contains waterfront which has been designated as Park land,
by deed, a copy of which is attached for your information.
The right of way has been owned by the County of Suffolk for lack of payment
of back taxes since 1988. If the property is auctioned by the County, the
Town would notify the County that this lot (7.18) is not considered a buildable
lot.
Final/y, since access to your property is over a private road, you may need
280a approval from the ZBA if the road is determined to be in need of
improvement by the Building Department.

erty above captioned and discussed same at our meeting held
February 7, 1983. It was noted in the minutes that the area
was in very good condition with the exception of a few pot-
holes. As a result the following resolution was passed by
our Board.
RESOLVED that the Southold Town Planning Board authorize the
Chairman to endorse approval on the final minor subdivision
map of Flora Luce & George L. Penny III at such time as the
potholes have been corrected to the satisfaction of the Plan-
ning Board.

Dear Mr. Raynor:
On November 1, 1982, I w~ote to the Planning Board on behalf of my
client, Mr. Harry wicks. At that time, I wished to have o0nfirmed that the
above property had been properly subdivided so that r~y client oould purc~hase
same and construct a residence.
By letter dated November 24, 1982, you wrote back and indicated
that your Board had not granted any approval and further, that no building
permits could be issued. Since that time, Mr. Henrf Luce has been attempt-
ing to clarify the situation, so as to ultimately lead to the proposed sale.
However, I must admit that I ~n as oonfused as ever. I have not,
as yet, been told by the proposed sellers exactly what they must do in order
to obtain Board approval that could lead %o the consiz~ction of a residence.
It is also my understanding that there is an "on site" inspection
of the property scheduled for Friday, January 28, 1983.
If it is not too great an imposition, could you please advise ~
of the status of any approval. Further, if an approval is not contemplated,
I would like to know what the proposed sellers must de in order to obtain
same from your Board, as well as the results of Friday's inspection.

Dear Henry:
The other day you discussed with me the above subdivision
and asked for direction.
As I understand it, an application for a minor subdivision
of the property was filed with the Planning Board in 1975,
and that a hearing was held thereon on due notice and, there-
after, the Planning Board adopted a resolution approving
the same subject to the applicant making certain street and
drainage improvements.
As I understand it, some of the improvements may have been
made, however, some improvements remain to be completed.
I also understand that some of the lots in the subdivision
have been conveyed out. You have asked that I advise you
of how to handle this situation.
I would suggest that, in lieu of the construction of the
improvements, the Planning Board require the deposit of
funds with the Town in any amount sufficient to complete
the required improvements. I would suggest also that the
Town engineer make an inspection of the property to deter-
mine the extent of the improvements to be made and the
cost thereof in order that the amount of the deposit can

be ascertained with some degree of accuracy. I would further
suggest that the Planning Board provide that no permits or
dwelling construction be permitted until the funds to assure
completion of the improvements have been deposited with the
Town.

There was discussion about this subdivision as regards
Dr. Moor-Jankowski's interest in the property. Mr. Wickham
reported that Dr. Moor-Jankowski told him that he had an
option on the two lots adjacent to his property and he waived
his option on agreement from Mr. Schriever that if he were to
buy the property he would sell Dr. Moor-Jankowski what he
wanted. Mr. Wickham told Dr. Moor-Jankowski to send a letter
and the Board would hold up the subdivision until this matter
is settled.
Mr. Cuddy presented a preliminary map showing a cul-de-sac
rather than a through-road to Village Lane. Mr. Wickham told
Mr. Cuddy about Dr. Moor-Jankowski (Mr..Cuddy.arrived after
Mr. Wickham m~de the above'report.) Mrl Cuddy said that Dr.
Moor-Jankowski had nothing in writing but that Mr. Schriever
said he would sell the outlined property to Dr. Moor-Jankowski.
Mr. Wickham wants to know the terms of the release and wants
it demonstrated to the Board's satisfaction that Dr. Moor-
Jankowski did not have an option, if that is the fact. Mr.
Cuddy asked that the Board consider the first map presented
with the through-road and if they would not consider that,
that they consider the second map with the cul-de-sac.
Mr. Moisa asked what would happen if the DEC would not accept
the cluster and Mr. Cuddy answered that the map would have to
be changed.
Mr. Raynor asked the exact Status of the parcels A through N
and Mr. Cuddy replied that they would remain open space. Mr.
Raynor asked what kind of right--of-way they were talking about
to the open space and Mr. Cuddy said they were thinking about
not paving it but it would depend on what the board had to say.
The secretary was to contact Mr. Crimmins, attorney for Dr.
Moor-Jankowski, regarding this matter.
On motion made by Mr. Moisa, seconded by Mr.

Mr. Wickham read the covenants and restrictions as to
no further subdivision of this property and copy of the

Mr. Wickham: Is there anyone who would like to be heard in
opposition to this subdivision? Hearing none, I will ask for

Any suggestions you may have I am willing to listen and I
would appreciate it if you can see your way clearly to favor

Mr. Wickham: This matter has been before the Planning Board
for almost two years and we have had many changes in it and
this map has been designed to meet the requirements of the
Planning Board. If there is no one else who wishes to speak
on this subdivision, I will declare the hearing closed.
Mr. Wickham: I would like to have written into the minutes
exactly how you and the Board propose to handle the road.
Mr. Luce: It is my understanding that we are to go 150 feet
up on this road going to the Billard property and to about
the middle of lot number three.
Mr. Wickham: We said in view of the fact that this was a
minor subdivision that we were asking for you to surface the
road but not to town standards. What were you thinking on
the width of the surfacing?
Mr.'Luce: It is a fifty foot road all the way in. Twenty
feet would be surfaced keeping it as a private road until
such time if in the future we would turn it over to the town.
Mr. Coyle asked him if he had thought of putting in a fire-
well and Mr. Luce replied that he thought there was one on
Pine Trek Road.
It was agreed by Mr. Luce and the Planning Board to bring
the twenty-f6ot paved road to the park area.

I amenclosing map of the minor subdivision of
Luce and 9enny located at East Cutchogue, New York.
Because of the fact that this is within 500 feet
of meadowlands, it was necessary to send it to the
Suffolk County Department of Planning. They wrote
and asked for a "Tidal Wetlands" letter and an
indication of how the runoff was going to be treated
so that it would be returned to the ground.
The Planning Board has required them to put in
a twenty foot road paved 150 feet along lot #1 and
to the red line on the private road going to the
meadow. Mr. Van Tuyl sent in a map showing quite a
few leaching basins which the Planning Board didn't
think were necessary. They did say they wanted two
leaching basins at the intersection of Pine Tree Road
and the private road. I checked with Ray Dean and
he asked that I refer it to you for your recommenda-
tions. We would appreciate it if you would look this
area over and let us know your suggestions on it.
The above might be a bit confusing to you so give
me a call if you want me to give you any further
explanation.
